(6) Past Performance: The quotation will be evaluated on past performance questionnaire responses. Only recent (shall be within the past 36 months) and relevant (shall be directly related to providing janitorial services) past performance will be considered.
Only records for the previous 36 months will be reviewed. Note: In cases where the offeror has supplied no past performance questionnaire, the offeror will receive neither a favorable nor an unfavorable past performance rating.
(7) Price: Quoters shall submit a price quote utilizing the price quote template, attached to the solicitation.
(8) Submissions: Quoters must complete and submit (1), Blocks 13, 14, 15, and 16 on page one of this SF-18 form (RFQ Packet), (2) completed price quote template, (3) completed past performance questionnaire and (4) Technical Proposal no later than 09/12/2025 by 4:00 p.m. ET to the following email: amoz.j.samuel@cbp.dhs.gov. Please only submit a quote for the county where you are located.
9 Any questions concerning this solicitation, including requests for an extension, shall be submitted via email to amoz.j.samuel@cbp.dhs.gov no later than 09/10/2025 at 4:00 p.m. ET. All quotes shall only be submitted via SAM.gov. Government responses to questions may be published via SAM.gov so that all interested quoters will have access to the same information. Late questions may not be answered.

This is a combined synopsis/solicitation for commercial items and services is *prepared in accordance with the format in FAR Subpart 12.6 as supplemented with additional information included in the notice. This announcement constitutes only the solicitation; quotes are being requested and a separate written solicitation will not be issued.
The solicitation number is 70B03C25Q00000375 and is issued as a Request for Quotes (RFQ). The solicitation documents and incorporates provisions and clauses which are in effect through Federal Acquisition Circular (FAC) 2024-03. This RFQ is set aside 100% for small business. The associated North American Industrial Classification System (NAICS) code for this procurement is 922140 with a small business size standard of 500 employees.
All qualified, responsible sources may submit an offer that shall be considered by the agency. Offerors are advised that they are responsible for obtaining amendments.
The resulting contract shall be awarded to the offeror who provides the best value to the Government, after tradeoffs. Technical Capability and Past Performance is more important than price.
The Department of Homeland Security (DHS), Customs and Border Protection (CBP), Procurement Directorate, intends to award a for the procurement of Jail Space Services meeting the specifications set forth in the attached STATEMENT OF WORK (SOW). It is required that all quoters submitting a quote review the attached SOW to review all requirements. All quoters submitting a quote shall be required to meet the requirements found in the SOW.
5) Technical Capability/Management Approach: Quoters shall submit a technical proposal outlining how your company plans to fulfill the specific needs of the customer. Please include a detailed description of your approach, methodologies, equipment, and resources demonstrating how you can meet the requirements of the SOW.

I.12 GENERAL EVALUATION INFORMATION (OCT 2008)
In addition to the specific evaluation criteria contained in the RFQ, the Contracting Officer will consider the following factors in the source selection process.
a. The offeror must respond to all the requirements of the solicitation and must include in its proposal all information specifically required in all sections of the solicitation.
b. Award of a contract may not be made to any offeror unless an agreement can be secured for all stated terms, conditions, representations, certifications, and all other information required by the solicitation.
c. Award of a contract can only be made to an offeror:
1. Whose proposal is technically acceptable or represents best value; and
2. Whose proposed price is determined reasonable; and
3. Who is considered to be responsible within the meaning of FAR 9.104.
If "Past Performance" is identified in the solicitation as an evaluation criterion, an assessment of the offeror’s past performance information will be made, which is separate from the responsibility determination. In addition to the past performance information submitted by offerors, the Government will use the Department of Defense's Past Performance Information Retrieval System (PPIRS) (https://www.ppirs.gov) and other available sources to obtain contractor past performance data for consideration in the evaluation process. The Government will determine the relevance of similar past performance information to the instant acquisition.
In the case of an offeror without a record of relevant past performance, or for whom information on past performance is not available, the offeror may not be evaluated favorably or unfavorably on past performance.

I.3 Description: This acquisition will be conducted using the Federal Acquisition Regulation (FAR) Parts 12 and 13. This solicitation will result in a multiple-award Blanket Purchase Agreement (BPA). Under the BPA, the awardees shall provide the and facilities required to provide Detention Center Services to Customs and Border Protection (CBP) Office of Field Operations (OFO) on an as-needed basis, in accordance with the Statement of Work (SOW) attached.
I.I.4 Authorization Only authorized persons may place calls/orders against the BPA once established. It is the awardee’s responsibility to ensure that sales are made only to the authorized individuals. At award, the Contracting Officer shall designate the official who shall be authorized to place calls under the BPA in the name of CBP, not to exceed the BPA call limit.
I.5 Extent of Obligation: The Government is obligated only to the extent of authorized purchases actually made under the anticipated BPA. This BPA will not obligate any funds. Funds will be obligated by placement of duly authorized calls.
I.6 Purchase Limitation: There shall be no overall total purchase limitation for the BPA, but individual calls shall not exceed $25,000 each. CBP will not assume responsibility for sales made to individuals other than those designated by the Contracting Officer nor shall CBP assume responsibility for sales made in excess of the specified individual call purchase limit.
I.7 Schedule of Supplies/Services: Refer to the Price Quote Form Attachment for pricing information. The anticipated BPA will establish daily rates for jail spaces for each 12-month period within the BPA’s ordering period.
I.8 Ordering Period: The ordering period of the anticipated BPA shall be date of award through sixty
(60) months from date of award (five years total).
I.9 Procedures for Placing Calls: All calls under the anticipated BPA shall be in writing (including via email), submitted by a duly designated authorized individual.
I.10 Invoices: Invoices for calls against the BPA shall be submitted in arrears at the end of each month. All original invoices must be provided to Customs and Border Protection, National Finance Center, 613800 Old Gentilly Road, New Orleans, Louisiana 70129. To submit invoices electronically, email them to:

(d)Comptroller General Examination of Record. The Contractor shall comply with the provisions of this paragraph (d) if this contract was awarded using other than sealed bid, is in excess of the simplified acquisition threshold, as defined in FAR 2.101, on the date of award of this contract, and does not contain the clause at 52.215-2, Audit and Records- Negotiation.
(1)The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor’s directly pertinent records involving transactions related to this contract.
(2)The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.
(3)As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of type and regardless of form. This does not require the Contractor to create or maintain any record that the Contractor does not maintain in the ordinary course of business or pursuant to a provision of law.

Alternate I (FEB 2000). As prescribed in 12.301 (b)(4)(i), delete paragraph (d) from the basic clause, redesignate paragraph (e) as paragraph (d), and revise the reference to "paragraphs (a), (b), (c), or (d) of this clause" in the redesignated paragraph (d) to read "paragraphs (a), (b), and (c) of this clause".
Alternate II (JAN 2025). As prescribed in 12.301 (b)(4)(ii), substitute the following paragraphs (d)(1) and (e)(1) for paragraphs (d)(1) and (e)(1) of the basic clause as follows:
(d)(1) The Comptroller General of the United States, an appropriate Inspector General appointed under section 3 or 8 G of the Inspector General Act of 1978 ( 5 U.S.C. App.), or an authorized representative of either of the foregoing officials shall have access to and right to—
(i) Examine any of the Contractor’s or any subcontractors’ records that pertain to, and involve transactions relating to, this contract; and
(ii) Interview any officer or employee regarding such transactions.
(e)(1) Notwithstanding the requirements of the clauses in paragraphs (a), (b), and (c), of this clause, the Contractor is not required to flow down any FAR clause in a subcontract for commercial products or commercial services, other than—
(i) Paragraph (d) of this clause. This paragraph flows down to all subcontracts, except the authority of the Inspector General under paragraph (d)(1)(ii) does not flow down; and
(ii) Those clauses listed in this paragraph (e)(1). Unless otherwise indicated below, the extent of the flow down shall be as required by the clause-
