SPE8EF-27-Q-0003
1. Statutory Authority for Restricting Competition
This procurement utilizes simplified procedures for certain commercial products and commercial services under the authority of 41 U.S.C. 1901, as implemented by Federal Acquisition Regulation (FAR) Subpart 13.5 and FAR Part 12, in conjunction with applicable Class Deviations and DoD guidance. Acquisition procedures are streamlined in accordance with FAR Subpart 12.201-1 for items meeting the definition of a commercial product.
2. Basis for Award (Addendum to FAR 52.212-2)
The Government will award a firm-fixed-price contract resulting from this 100% Service-Disabled Veteran-Owned Small Business (SDVOSB) Set-Aside solicitation to the responsible, eligible SDVOSB offeror whose offer, conforming to the solicitation, represents the best value to the Government.
To be considered for award, an offeror must supply the approved product manufactured by COLUMBUS JACK CORPORATION (CAGE: 00994) or demonstrate acceptable traceability as an authorized distributor/dealer supplying the exact product manufactured by COLUMBUS JACK CORPORATION.
Evaluation will be conducted as a comparative assessment among eligible SDVOSB offerors using the following factors:
Price: The Government will evaluate proposed pricing for reasonableness using price analysis techniques in accordance with FAR 13.106-3 and FAR Subpart 15.4.
Past Performance: Performance risk will be assessed using data available to the Government, primarily from the Supplier Performance Risk System (SPRS) in accordance with DFARS 252.204-7024 and DLA Procurement Note L08. Evaluation will consider up to the last three (3) years of delivery and quality data. The Government may also consider information from other federal, state, and local databases, as well as contracting officer knowledge.
3. Item Identification and Traceability
All offerors must supply the exact item identified in the Purchase Order Text (POT). Any offeror that is not the approved manufacturing source (COLUMBUS JACK CORPORATION, CAGE 00994) must be prepared to submit evidence of traceability establishing the identity of the product and its authentic manufacturing supply chain.
In accordance with DLA Procurement Note L04 (Offers for Approved Products):
The Contracting Officer may request traceability documentation at any time prior to award.
Failure to provide complete, acceptable documentation within two (2) business days of request (or as otherwise specified by the Contracting Officer) may result in the rejection of the offer.
The Contracting Officer retains sole discretion in determining the acceptability of traceability documentation.
4. Applicable Terms, Conditions, and Notes
Technical and Quality Requirements: This order incorporates technical and quality requirements (designated by "R" or "I" numbers) where applicable. The full text of these requirements is found in the DLA Technical and Quality Master List of Requirements at: http://www.dla.mil/HQ/Acquisition/Offers/eprocurement.aspx. The revision in effect on the solicitation issue date (or award date, as specified) controls.
Delivery Terms & Transportation: Delivery shall be quoted in calendar days After Date of Order (ADO). Because this procurement involves ocean vessel shipment, delivery shall be FOB Origin, Vessel, Port of Shipment in accordance with FAR 52.247-37. Shipping instructions and clearance must comply with FAR 52.247-52 and DLA First Destination Transportation (FDT) program instructions (Procurement Note C15/C16).
Contract Formation: A written notice of award or acceptance of an offer furnished to the successful offeror within the acceptance period results in a binding contract without further action by either party.
Solicitation Cancellation: The Government reserves the right to cancel this solicitation at any time without liability for any costs incurred by offerors in submitting quotes.

If the item shipping costs, based on the actual shipping characteristics, exceed the item shipping costs used for evaluation purposes, the Contractor agrees that the contract price shall be reduced by an amount equal to the difference between the transportation costs actually incurred, and the costs which would have been incurred if the evaluated shipping characteristics had been accurate.

(a) Definitions. As used in this clause -- “Foreign-flag vessel” means any vessel that is not a U.S.-flag vessel.
“Ocean transportation” means any water-borne transportation aboard a ship, vessel, boat, barge, ferry, or the like outside the internal waters of the United States as defined in 33 CFR 2.24.
“Subcontractor” means a supplier, materialman, distributor, or vendor at any level below the prime contractor whose contractual obligation to perform results from, or is conditioned upon, award of the prime contract and who is performing any part of the work or other requirement of the prime contract.
“Supplies” means supplies that are clearly identifiable for eventual use by or owned by DoD at the time of transportation by sea, or are otherwise transported by DoD, regardless of ownership or use by DoD. An item is clearly identifiable for eventual use by DoD if, for example, the contract documentation contains a reference to a DoD contract number or a military destination.
“U.S.-flag vessel” means either a vessel belonging to the United States or a vessel of the United States as that term is defined in 46 U.S.C. 116..

(3) Are commissary or exchange cargoes transported outside of the Defense Transportation System in accordance with 10 U.S.C. 2643.

(1) U.S.-flag vessels are not available at a fair and reasonable rate for commercial vessels of the United States; or
(2) U.S.-flag vessels are otherwise not available.
(d) The Contractor must submit any request for use of foreign-flag vessels in writing to the Contracting Officer at least 45 days prior to the sailing date necessary to meet its delivery schedules. The Contracting Officer will process requests submitted after such date(s) as expeditiously as possible, however, if a DoD waiver is not approved prior to shipper's sailing date, this will not of itself constitute a compensable delay under this or any other clause of this contract. Requests shall contain at a minimum --
(1) Type, weight, and cube of cargo;
(2) Required shipping date;
(3) Special handling and discharge requirements;
(4) Loading and discharge points;
