About this file
This is a sole source procurement justification document submitted by the Dona Ana County Office of Emergency Management in New Mexico for the renewal of WebEOC Pro software services from ESi Acquisition Inc., a Juvare Company. The county requests continuation of the WebEOC Pro incident management platform, which provides real-time situational awareness, resource tracking, and information sharing capabilities for emergency preparedness, response, mitigation, and recovery operations. The platform enables interoperability with the State Emergency Operations Center and supports seamless coordination during wildfires, floods, public health emergencies, and other critical incidents. The contract is a software-as-a-service (SaaS) renewal with a service period from September 1, 2026, through August 31, 2027. The justification was created on August 7, 2026, and signed by Amanda Bowen, Emergency Manager, on August 10, 2026.
The total contract value is $64,631.40 for Year 1, exclusive of applicable taxes and travel expenses. The quote includes a WebEOC subscription for 150 users ($53,144.91), a SaaS Enterprise Upgrade ($3,188.69), FleetUp Portable Asset Software prorated for two months ($407.88), a Standard Juvare Connector prorated for two months ($944.17), and Juvare DesignStudio Pro ($6,945.75). ESi Acquisition Inc. justifies sole source status based on proprietary ownership of WebEOC source code, trademarks, and associated intellectual property rights since the software's initial development in 1999. The county's existing investment in system configuration, staff training, and data integration, combined with the need to maintain operational continuity and compatibility with state systems, supports the sole source determination. Quote Number Q-22495, dated July 7, 2026, expires on September 1, 2026, and requires inclusion of the quote number and date on any purchase order for acceptance.

RE: Response to Sole Source Inquiry; WebEOC® Software Suite – County of Dona Ana/City of Las
Cruces
Dear Director Bowen, ESi Acquisition, Inc., a Juvare Company (“ESi”), is the sole developer and licensor of the ESi WebEOC® branded Software. Since its initial development and release in 1999, and continuously updated through the present day, ESi has maintained control over the source code, the trademark and all other proprietary rights embodied in the ESi WebEOC Software and its companion products.
As the only entity with access to the ESi WebEOC Software source code, ESi is the only entity which may accurately diagnose software errors and defects, issue corrections and fully integrated enhancements, and warrant performance of the ESi WebEOC Software. ESi also provides a comprehensive range of professional services uniquely tied to the WebEOC platform. These services are specialized in nature and focused on configuration and technical support for the proprietary software technology. These services necessarily require access to ESi proprietary information and are not available through or resold by any third parties. The WebEOC Software Core Subscription services and supporting Emergency Management and Municipal Operations Modules also are available exclusively from ESi.
Sole source acquisition of the ESi WebEOC Software products and services may be justified under Subpart 6.3 of the Federal Acquisition Regulations (“FAR”). In the case of software products and software maintenance, the FAR permits sole source acquisition of unique items which are available from one or a limited number of sources or for proprietary items where only limited data rights are provided under license. The ESi WebEOC Software meets these requirements. State and local government organizations are encouraged to ask their procurement officer if local laws include similar sole source provisions, or if the federal justifications may be used to support sole source procurement.
