VI. Provide a detailed explanation of the criteria developed and specified by the agency as necessary to perform and/or fulfill the contract and upon which the state agency reviewed available sources. (Do not use “technical jargon;” use plain English. Do not tailor the criteria simply to exclude other contractors if it is not rationally related to the purpose of the contract.)

Criteria includes:

Project knowledge and design proficiency required to stamp final design plans without any redesign

Familiarity with the construction plan set for CN 4100383, Experience with providing services listed above, Ability to present and provide information about the design decisions made for the corridor under CN 4100383 Ability to provide any necessary design changes that may occur during construction.

(Please do not state the source is the “best” source or the “least costly” source. Those factors do not justify a “sole source.”)

The prospective contractor is the engineer of record for this project and thus has the most familiarity with the development and design of this project as well as the existing conditions on NM 434 within the limits of the project. They have developed the plans to near-final design and have previously provided information and clarifications about the plan set and other project related matters to various agencies and the public.

VIII. Provide a detailed, sufficient explanation of how the professional service, general service, construction or item(s) of tangible personal property is/are unique and how this uniqueness is substantially related to the intended purpose of the contract.

The services detailed on this form require thorough knowledge about the design proposed in the plan set for CN 4100383 and familiarity of the existing conditions. This knowledge is needed to adequately review and respond to RFIs from the construction contractor, provide input during construction meetings and to provide any modifications or revisions that may be needed on the proposed improvements of this project.

IX. Provide a narrative description of the agency’s due diligence in determining the basis for the procurement, including procedures used by the agency to conduct a review of available sources such as researching trade publications, industry newsletters and the internet;;

contacting similar service providers; and reviewing the State Purchasing Divisions’ Statewide Price Agreements. Include a list of businesses contacted (do not state that no other businesses were contacted), date of contact, method of contact (telephone, mail, e-mail, other), and documentation demonstrating an explanation of why those businesses could not or would not, under any circumstances, perform the contract; or an explanation of why the agency has determined that no businesses other than the prospective contractor can perform the contract.

Radian Engineering initially conducted an engineering study on this stretch of NM 434 back in

2017. Radian has since worked to develop a comprehensive set of construction plans for the reconstruction of NM 434 from approximately milepost 19.6 to milepost 25.8, a corridor that was divided into four construction projects. Radian Engineering will be the engineer of record for this stretch of roadway once construction is complete, regardless of whether or not this sole source contract for Phase III services is executed. CN 4100383 is the fourth and final project in the corridor. Radian Engineering knows the intricacies of the project, both existing conditions and proposed designed conditions, and is therefore determined to be the only firm with the expertise to complete Phase II Services and provide Phase III services on this project for the Department in the most cost effective manner.

NM434 MP23.3-25.8 Cattle Access Agreement T/M Estimate for ROW Mapping Revision and Certification, Agreement Coordination and Legel Description

The linework for the easement provided and the associated Stipulated Judgement describe an access agreement of 40’ in width running within the existing NMDOT ROW from approximate station 545+45 (near the PC of original NM434 alignment, a point where the new ROW departs from the original) northerly to the crossing of Coyote Creek.

The intent of the access agreement is to provide a corridor to allow the movement of cattle and personnel safe access from one side of the highway to the other. There is currently no language that defines the use, maintenance responsibilities and general conditions of the access agreement, NMDOT legal will be responsible for that content. Colliers Engineering & Design will create signed/certified legal description for the access agreement and provide to the NMDOT legal team for further use.

Colliers Engineering & Design performed the original ROW mapping. I was employed by CED at the time as partner in charge and although the PS that signed those ROW maps no longer works at CED I oversaw all projects in this office and am confident in the work performed and used in this access agreement.

No field work will be performed for this project. No stake out of access location will be included in this project scope. This instrument will be created to facilitate the efforts of NMDOT legal team in securing an access agreement with their client.

CED will provide NMDOT legal an access agreement and exhibit that can be an amendment to any document related to the product as needed. The NMDOT will be responsible for Legal review and approval of all documents pertaining to establishment of the new access agreement, and ultimate legal responsibility for ensuring that all terms of the stipulated judgement are met.

Re: PF24-0000 Phase III Geotechnical Support – NM 434, NMDOT CN 4100383, MP 23.3 to MP 25.8 Colfax County, New Mexico

Dear Mr. Padilla:

At your request, WSP USA Inc. is pleased to submit this proposal to support Construction Phase III engineering services for the above-referenced project. The contents of this proposal are based on written/verbal information supplied by you, and on our knowledge of subsurface conditions on this project.

WSP E&I proposes to provide geotechnical support and quality assurance of Contractor supplied submittals and work activities. The overall fee for the Phase III geotechnical engineering services outlined in this proposal are based on estimated effort on a time and materials basis.

Construction is anticipated to begin in 2027. Safety and operational enhancements will include widening the roadway to accommodate two 12-foot driving lanes with 6-foot outside shoulders, and associated alignment and roadside improvements. There will be a short 0.38-mile stretch that will be offset about 400-feet to the east along the new alignment and will include a new bridge crossing over Coyote Creek at the Black Lake outfall.

The anticipated scope of Phase III Services will include the following:

Task 1: Project Setup Upon notice of start of construction, WSP will set up the project in our systems. This task will also include project management (invoice reviews, project correspondence, project closeout). Our estimated fee for Task 1 is $6,679.92.

Task 2: Pre-Bid Meeting and Pre-Construction Meeting Support

WSP will provide Radian Engineering, LLC Pre-Bid and Pre-Construction meeting geotechnical engineering support with respect to cuts-fills, gabion retaining walls, slope stability, and bridge foundation drilled shaft issues. Our estimated fee for Task 2 is $10,912.52.

Task 3: Response to Contractor Requests for Information (RFI’s)

Given that this project consists of the possibility of unanticipated conditions, we estimate that there may be several RFI’s. Our estimated fee for Task 3 is $29,776.36.

Task 4: Review of Submittals

Contractor submittals such as completed cross-hole sonic logging (CSL) and low strain integrity (LSI) tests on the bridge drilled shafts will be reviewed by WSP. WSP should also review contractor proposed embankment fill sources, footing/subgrade conditions for gabion walls, evaluation and resolution of compaction issues, and other miscellaneous geotechnically related construction issues. Also included in this task is one (1) potential site visit as well as virtual coordination meetings and calls with the NMDOT. Our estimated fee for Task 4 is $30,579.68.

Subject: Pre-Bid/Pre-Construction Support and Phase III Services- Geotechnical Discipline

1. Introduction The proposal includes supporting the Radian Engineering LLC team with support through the construction phase of the project. The work will be based on a Time and Materials, As-needed basis.

The estimated hours and fees are the anticipated not-to-exceed amounts per task. We anticipate that geotechnical support will be needed for work related to supporting the Pre-Bid and Pre-Construction Meetings Contractor submittals, reviewing specialized crews work progress, evaluating adequacy of footings, and evaluating backslope conditions for gabions. Other services related to earthwork observations and field testing to recommend acceptance of roadcuts.

1.1 Pre-Bid/ Pre-Con RFI/ Contractor Submittal Reviews

YeDoma will provide Senior Geotechnical support for pre-bid and pre-construction meetings and other support prior to construction. The work will also include providing a disposition for approval of submittals and RFI’s based on design intent, experience and understanding of the contract documents.

The task may include supporting project level meetings, site meetings, and be available to support the design team in resolving materials related issues. YeDoma will check submittal calculations and review and verify the Supplier's assumptions and parameters. YeDoma will also verify that the calculations meet the NMDOT Standard Specifications. It is assumed that one quality assurance review will be performed by YeDoma, which will be followed by Contractor resolution of comments and corrections.

RFI’s related to geotechnical work activities will be evaluated as needed.

1.2 Geotechnical QA Probing, Geotechnical Material Testing and Compliance Reviews YeDoma will be available to support the project with independent construction phase field testing to evaluate adequacy of footing conditions on an as needed basis. The work may include dynamic probing, seismic refraction work, and observing construction work. It is assumed that up to six visits will be needed during the construction phase of the project to gather field data and probe ground conditions.

YeDoma will reference contract specifications, Contractor’s Materials Test Sheets and associated certifications prepared for the NM DOT. YeDoma will conduct materials testing (sieve/Pl/corrosivity, etc…) on a limited basis to provide independent revies of conditions and support the NMDOT in determining conformance with the NMDOT Standard Specifications and Contract Provisions.

1.3 Geotechnical Design Support of Earthwork and Rock Excavation YeDoma will conduct up to six trips to review construction progress and document earthwork activities.

The work will include observing the rock excavation, rockfall mitigation and scaling work conducted by the Contractor. YeDoma will provide technical design services during construction on an as needed basis.

Hi Paul, Here you go. Can we change the milestone dates? Because this project is bond funded, we can't obligate funds as early as I had initially thought.

I would like to change the following dates:

PSE Review - February 1, 2027 Production - February 22, 2027

Also I'm not sure where the proposed contract expiration date came from but 3/1/28 will for sure not be long enough. Please include a contract expiration date of 7/1/2029

Thanks, Dana

2021 Sole Source Form

STATE OF NEW MEXICO

SOLE SOURCE REQUEST AND DETERMINATION FORM

A sole source determination is not effective until the sole source request for determination has been posted for thirty (30) calendar days without challenge, and subsequently approved in writing by the State Purchasing Agent or, for Professional Services Agreements, the Secretary of the General Services Department. The foregoing requirement is regardless of whether the sole source request for determination has been signed by the Agency and/or the Contractor.

I. Name of Agency: NMDOT

Agency Chief Procurement Officer: Christina Baca

Telephone Number: (505) 469-8800

Agency Contact for this request: Dana Garcia

Telephone Number & Email Address: (505) 231-7663 Dana.Garcia@dot.nm.gov

II. Name of prospective Contractor: Radian Engineering, LLC

SHARE Vendor Number (must be active):

Address of prospective Contractor: 509 Camino de los Marquez, Ste. 2, Santa Fe, NM 87505

Contact Name, Telephone Number and Email Address: Carlos Padilla (505) 984-1212

Amount of prospective contract before tax: $407,781.38

Estimated tax amount (tax is subject to change): $36,700.32

Term of prospective contract: 3 years

Note: For terms longer than one year, Request for Policy Exemption from DFA MUST be included.

III. Agency is required to state purpose/need of purchase and thoroughly list the services (scope of work), construction or items of tangible personal property of the prospective contract (if this is an amendment request to an existing contract, include current contract number issued by SPD):

Radian is the engineer of record for the roadway improvements on NM 434 under NMDOT construction project CN 4100383. The sole source contract is intended to allow Radian to complete Phase II Services (final design) now that the project construction is planned to be funded with 2026 bond funds, and to provide Phase III Services, technical engineering support during construction. Under Radian’s previous, competitive-bid contract, they completed final design for this project but NMDOT District 4 did not have the funds for construction. The Statewide Transportation Improvement Plan (STIP) showed this project in the planning years where funds are just for planning purposes. With the recently passed NMDOT bond legislation, the construction funds are now expected to be in place in 2026, requiring us to update the final design and prepare construction bidding documents.

The list of services include general technical consultation, attending meetings, responding to contractor Request for Information (RFIs), review of shop drawings and contractor submittals, evaluating change orders, and construction engineering.

IV.

· Project knowledge and design proficiency required to stamp final design plans without any redesign

· Familiarity with the construction plan set for CN 4100383,

· Experience with providing services listed above,

· Ability to present and provide information about the design decisions made for the corridor under CN 4100383

· Ability to provide any necessary design changes that may occur during construction.

V. Provide a detailed, sufficient explanation of the reasons, qualifications, proprietary rights or unique capabilities of the prospective contractor that makes the prospective contractor the one source capable of providing the required professional service, service, construction or item(s) of tangible personal property.

VI. Provide a detailed, sufficient explanation of how the professional service, service, construction or item(s) of tangible personal property is/are unique and how this uniqueness is substantially related to the intended purpose of the contract.

VII. Explain why other similar professional services, services, construction or item(s) of tangible personal property cannot meet the intended purpose of the contract.

The services needed to complete Phase II Engineering Services and provide Phase III Engineering Services during Construction cannot be adequately provided without professional knowledge about the design proposed in the plan set and the experience needed to respond to concerns or complications that may arise during construction.

VIII. Provide a narrative description of the agency’s due diligence in determining the basis for the procurement, including procedures used by the agency to conduct a review of available sources such as researching trade publications, industry newsletters and the internet;; contacting similar service providers; and reviewing the State Purchasing Divisions’ Statewide Price Agreements.

Radian Engineering initially conducted an engineering study on this stretch of NM 434 back in 2017.
