The contract encompasses four primary program initiatives: Community Cultural Enrichment Program featuring traditional arts workshops, film industry partnerships, and youth education outreach; Community Empowerment and Cultural Celebration including commercial kitchen operations, a two-day hot air balloon festival, and art and culture week celebrations; Community Collaboration and Advancement supporting youth fellowships, literary collaborations, and acequia partnerships; and Access and Infrastructure Support ensuring reliable site access and functioning infrastructure. The contract period runs from August 5, 2026, through June 30, 2027, with the sole source request posted for the required thirty-day protest period and approved by the State Purchasing Agent on August 6, 2026.

The total contract value is $300,000 before tax, with no estimated tax amount, funded through House Bill 2 of the 2026 General Appropriation Act. VI. Provide a detailed explanation of the criteria developed and specified by the agency as necessary to perform and/or fulfill the contract and upon which the state agency reviewed available sources. (Do not use “technical jargon;” use plain English. Do not tailor the criteria simply to exclude other contractors if it is not rationally related to the purpose of the contract.)

The criteria used for this contract are dictated by the appropriations of the funding legislation which states that the department is to contract for an economic development program and cultural programming at Los Lucero’s State Historic Site.

This contract is required per the 2026 General Appropriation Act, House Bill 2.

House Bill 2, Section 5, Special Appropriations, item 112, provides the department with a total of three hundred thousand dollars ($300,000) to contract for economic development activities at Los Lucero’s Historic Site.

VII. Provide a detailed, sufficient explanation of the reasons, qualifications, proprietary rights or unique capabilities of the prospective contractor that makes their company the only source capable of providing the required professional service, general service, construction or item(s) of tangible personal property. (Please do not state the source is the “best” source or the “least costly” source. Those factors do not justify a “sole source.”)

The Northern Rio Grande National Heritage Area (NRGNHA), established by

Congress in 2006, has the mission of preserving the cultures and traditions of New

Mexico, including fostering culturally based economic development. The NRGNHA provides direct technical assistance (including grants) to numerous projects in Santa

Fe, Taos, and Rio Arriba County. NRGNHA is currently executing a contractor with the department providing similar services in FY27.

VIII. Provide a detailed, sufficient explanation of how the professional service, general service, construction or item(s) of tangible personal property is/are unique and how this uniqueness is substantially related to the intended purpose of the contract.

The Northern Rio Grande National Heritage Area is the only national heritage area in New Mexico with the mandate to work directly with the National Park Service to facilitate culturally based economic development. The NRGNHA has a track record of working with local communities, counties, and educational institutions on culturally based economic development. Examples include preservation of heritage weaving practices, artists marketing initiatives, cultural property preservation and creation of a regional food hub in Espanola.

IX. Provide a narrative description of the agency’s due diligence in determining the basis for the procurement, including procedures used by the agency to conduct a review of available sources such as researching trade publications, industry newsletters and the internet;;

contacting similar service providers; and reviewing the State Purchasing Divisions’

Statewide Price Agreements. Include a list of businesses contacted (do not state that no other businesses were contacted), date of contact, method of contact (telephone, mail, e-mail, other), and documentation demonstrating an explanation of why those businesses could not or would not, under any circumstances, perform the contract; or an explanation of why the agency has determined that no businesses other than the prospective contractor can perform the contract.

Agency research showed that there are no other businesses or non-profits that meet the legislative criteria requiring the department to contract for an economic development program and cultural programming at Los Lucero’s State Historic Site.

Agency certifies this sole source submission complies with NMSA 1978, Sections 13-1-28 through 13-1-199, the New Mexico Administrative Code (NMAC) and Governmental Conduct

Act, NMSA 1978, Sections 10-16-1 through 10-16-18.
