The governing body for The State of New York for addictions and co-occurring treatment is The Office of Alcoholism and Substance Abuse Services (OASAS). Source: https://www.oasas.ny.gov/regs/credential.cfm
Per OASAS, Medication Assisted Treatment can be prescribed at addiction treatment programs, clinics, primary care setting and mental health clinics https://oasas.ny.gov/opioid-use-disorder with the exception of methadone. Programs that provide MAT are certified by OASAS per 14 NYCRR Part 822 General Service Standards for Substance Use Disorder Outpatient Regulations.
https://oasas.ny.gov/system/files?file=documents/2019/05/Part822.pdf The use of MAT is covered under their outpatient operating certificate.
Medication-Assisted Treatment (MAT) Licensing
To administer, dispense, and prescribe buprenorphine, physicians are required to apply to the Drug Enforcement Agency for a waiver. Those physicians who want to treat more than 30 patients at any one time, must also take the 8-hour waiver course.
The SUPPORT Act affords practitioners greater flexibility in the provision of MAT and extends the privilege of prescribing buprenorphine in office-based settings to qualifying other practitioners (Nurse Practitioners (NPs), Physician Assistants (PAs), Clinical Nurse Specialists (CNSs), Certified Registered Nurse Anesthetist (CRNAs), and Certified Nurse-Midwifes (CNMs) until October 1, 2023.
To receive a practitioner waiver to administer, dispense, and prescribe buprenorphine practitioners must notify SAMHSA’s Center for Substance Abuse Treatment (CSAT), Division of Pharmacologic Therapies (DPT) of their intent to practice this form of MAT.
