About this file
This document is a Resident Veteran's Preference Affidavit form used by the State of New Mexico for procurement solicitations. The form allows vendors to certify their eligibility for a resident veteran's business preference discount on state contracts. To qualify, a business must possess a valid Resident Veteran's Preference Certificate and demonstrate that its prior year revenue does not exceed $3 million, which allows the vendor to receive a 10% preference discount on the solicitation. The affidavit requires an authorized business representative to sign under penalty of perjury, certifying the accuracy of all statements provided regarding the veteran's preference claim.
The form establishes critical conditions and reporting obligations for vendors claiming the preference. Resident veteran businesses may not benefit from the preference for more than ten consecutive years, and an individual owner cannot benefit from the preference for more than ten consecutive years based on more than one business concurrently. Vendors awarded contracts based on veteran's preference status must submit annual reports to the State Purchasing Division of the General Services Department, declaring the awarded contract amount and categorizing it as either a public purchase or public works contract. False or misleading information provided in the affidavit or subsequent reports constitutes a crime, and misrepresentations are subject to protest and may result in denial or unaward of the procurement.
