FOR:

Tug Services Blanket Purchase Agreement (BPA)

1. This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in Federal Acquisition Regulation (FAR) Subpart 12.6, Streamlined Procedures for Evaluation and Solicitation for Commercial Items, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; quotations are being requested; and a written solicitation will not be issued. This solicitation will be accomplished under the authority of FAR Part 12, Acquisition of Commercial Items, and FAR Subpart 13.303, Blanket purchase agreements (BPAs).

2. The solicitation number is 6991PE21Q000001 and issued as a Request For Quotation (RFQ).

3. The solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular (FAC) 2022-03, effective January 1, 2022.

4. This procurement is an unrestricted procurement under North American Industry Classification System (NAICS) code 488330, Navigational Services to Shipping, with a small business size standard of $41.5 million. To be considered eligible to participate in this procurement, contractors must be certified under NAICS code 488330. Contractors interested in participating in this procurement should verify their NAICS codes.

5. Description of Requirements

The U.S. Department of Transportation (DOT), Maritime Administration (MARAD), Suisun Bay Reserve Fleet (SBRF) has a requirement for a multiple award Tug Services Blanket Purchase Agreement (BPA) as described in the attached BPA Performance Work Statement (PWS) and BPA Terms and Conditions. The objective of this BPA is to provide towing services to the SBRF, General Anchorage #26, located in Benicia, California to accomplish intra-fleet ship moves within the anchorage and mooring maintenance by adjusting or deploying anchors and chains to/from ships.

6. Required Responses

Questions or comments regarding this solicitation shall be submitted to the Contracting Officer via email at lynda.luo@dot.gov by January 26, 2022 at 1:00 PM (PT), to allow the Government sufficient time to respond. Any questions received after this date are not guaranteed to be addressed.

Quotations shall be submitted electronically via email to the Contracting Officer at lynda.luo@dot.gov by February 2, 2022 at 1:00 PM (PT). Late quotations may not be considered.

(1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor’s directly pertinent records involving transactions related to this contract.

(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.

(3) As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of type and regardless of form. This does not require the Contractor to create or maintain any record that the Contractor does not maintain in the ordinary course of business or pursuant to a provision of law.

8.3 MARAD Clauses

MCL.E-1 Delegation of Inspection and Acceptance (AUG 2005)

The Contracting Officer's Technical Representative shall be delegated the responsibility and authority to conduct inspection and acceptance duties for this contract.

MCL.H-6 Standards of Employee Conduct (AUG 2005)

The Contractor shall be responsible for maintaining satisfactory standards of employee competency, conduct, and integrity, and shall be responsible for taking such disciplinary action with respect to its employees as may be necessary.

MCL.H-13 Supervision (AUG 2005)

The Contractor shall provide at all times the quantity and quality of supervision necessary for the effective and efficient management of the operation. All supervisors shall have an intimate knowledge of the various tasks, equipment, and materials so as to be able to properly train and direct the workers in their individual tasks and to maintain and control an effective operation.

MCL.L-2 Agency Protests (AUG 2005)

(a) Prior to submission of an agency protest, all parties shall use their best efforts to resolve concerns raised by an interested party at the Contracting Officer level through open and frank discussions. At any time the Contracting Officer and Protestor are encouraged to employ the use of alternative dispute resolution techniques to resolve the protest.

When this cannot be accomplished interested parties may submit an agency protest to the Contracting Officer set forth in the Service of Protest provision of this solicitation.

(b) Protests based on alleged apparent improprieties in a solicitation shall be filed before bid opening or the closing date for receipt of proposals. In all other cases, protests shall be filed no later than 10 days after the basis of protest is known or should have been known, whichever is earlier.

(c) Protests shall include the following information. Failure to substantially include any of the following may be grounds for dismissal of the protest.

(i) Name, address, and fax and telephone numbers of the protester.

(ii) Solicitation or contract number.

(iii) Detailed statement of the legal and factual grounds for the protest, to include a description of resulting prejudice to the protester.

(iv) Copies of relevant documents.

(v) Request for a ruling by the agency.

(vi) Statement as to the form of relief requested.

(vii) All information establishing that the protester is an interested party for the purpose of filing a protest.

(viii) All information establishing the timeliness of the protest.

(d) Upon receipt and review of the protest to determine that adequate information is contained therein, the Contracting Officer will acknowledge receipt of the protest and inform the protester of the expected decision date. The Contracting Officer shall render a decision on the protest within 30 calendar days or notify the protestor of an extended decision date.

(e) Upon receipt of the Contracting Officer's decision, the protestor may appeal the decision within 15 calendar days of decision receipt. The appeal will result in an independent review of the protest by the Head of the Contracting Activity, the Associate Administrator for Administration. The Head of the Contracting Activity will impartially review the protest as presented, taking into consideration all of the available information, and render a decision. To the extent permitted by law and regulation, the Head of the Contracting Activity shall request relevant information from both parties.

The Head of the Contracting Activity will render a decision on the appeal within 15 calendar days of receipt. Agency appellate review of the Contracting Officer's decision on the protest will not extend GAO's timeliness requirements. Therefore, any subsequent protest to the GAO must be filed within 10 days of knowledge of initial adverse agency action (4 CFR 21.2(a)(3)).

(f) Upon receipt of a protest, the Contracting Officer shall follow the procedures set forth in the FAR Subpart 33.103 (f) with regard to contract award and continued performance.

9. SUBMITTAL INSTRUCTIONS

In addition to the referenced provision at FAR 52.212-1, Instructions to Offeror – Commercial Items, quoters shall follow the instructions below.

9.1 General Instructions

(1) Format. Non-price quotations shall be formatted for viewing/printing using 8.5 by 11 inch paper size, 1 inch margins, using at least a Times New Roman 11 point font.

(2) System for Award Management (SAM) Registration. SAM REGISTRATION IS REQUIRED.

Contractors may obtain information on registration and annual confirmation requirements via SAM accessed through https://www.sam.gov. Lack of registration in https://www.sam.gov/

(3) Representations and Certifications. If a quoter has not completed the annual representations and certifications electronically at the SAM website, the quoter shall submit a completed copy of the representations and certifications at FAR 52.212-3 available at https://www.acquisition.gov/browse/index/far with the quotation.

9.2 Quotation Instructions

At a minimum, include the following:

(1) Capability Statement. The quoter shall provide a capability statement which specifically demonstrates the quoter’s ability to perform the requirements of the BPA. Due to the nature of the work and the Government’s intent to reduce excessive transit time costs to and from the SBRF site, the quoter must have a local office and access to tugs within a 65-mile radius of SBRF. Provide a short narrative in the capability statement indicating compliance with this requirement and the location and address of local office.

(2) Subcontractors/Teaming Arrangements. The quoter shall provide a description of any subcontractors or teaming arrangements, including the name of the company, their location and address of local office, and the services to be provided by the subcontractor or teaming partner. Subcontractors and teaming partners proposed to provide tugs must also have a local office and access to tugs within a 65-mile radius of SBRF. If the quoter is not proposing any teaming/subcontractor arrangements, the quoter should indicate so in its quotation.

(3) Detailed Tug Specifications. Provide detailed specifications for each tug offered for the services. Detailed specifications shall include the following information for each tug:

• Tug name

• Horse power

• Tug type (twin-screw conventional, ASD tractor, Z-drive tractor, etc.)

If detailed tug specifications are available on the quoter’s website, the quoter may provide the direct link to the website showing the detailed tug specifications.

(4) Past Performance. A Past Performance Questionnaire (PPQ) is included as Attachment 3 to this solicitation and shall be sent to references to complete for up to three (3) relevant projects completed within the past five (5) years. Relevant is defined as a project of similar or greater size, scope, and complexity to some or all of the requirements of the PWS.

The quoter shall fill in the information in the Sections 1 – 3 of the PPQ. References shall complete Section 4 and 6 of the PPQ.

(5) Price Quotation. Submit pricing using the price worksheet in Attachment 4. All hourly rates shall be fully burdened. Please ensure that the price quotation is valid for at least 30 days from the date of established for receipt of quotations. The price quotation should be included in a separate document to facilitate an independent evaluation.

10. Basis of Award and Evaluation Criteria

The Government intends to establish three (3) BPAs as a result of the solicitation. This number is an approximation and the Government reserves the right in its sole discretion to establish a fewer or greater number of BPAs if determined to be in the best interest of the Government.

Award will be made to the responsive quoter that is technically capable of providing a complete or partial solution to the requirements of the PWS, having an acceptable or neural past performance, and proposed hourly rates are deemed fair and reasonable. Award preference may be given to quoters that propose a complete solution over quoters that only propose a partial solution.

The Government plans to evaluate quotations and make award without conducting discussions.

Quoters may be given the opportunity to clarify certain aspects of their quotation or resolve minor or clerical errors. The Government reserves the right to conduct discussions if later determined by the Contracting Officer to be necessary.

10.1 Evaluation Factors

The following factors shall be used to evaluate quotations:

1. Technical - Technical information, to include the quoter’s capability statement, subcontractors/teaming arrangements, and tugs specifications will be evaluated to determine if the proposed solution meets the Government’s requirements.

If the quoter does not have access to tugs within a 65-mile radius of SBRF, no further evaluation of the non-price and price quotation will be conducted by the Government. This also includes tugs provided by a subcontractor/teaming partner.

2. Past Performance - Past performance information will be evaluated to determine the quoter’s ability to perform the contract successfully and degree of performance risk associated with a quoter. MARAD will use its discretion to determine the sources of past performance information, and the information may be obtained from references provided, MARAD’s knowledge of contractor performance, other government agencies or commercial entities, or past performance databases.

For the purpose of evaluating past performance, relevant is defined as a project of similar or greater size, scope, and complexity to some or all of the requirements of the PWS. A quoter with no relevant past performance for work completed within the past five (5) years will be evaluated with neither a favorable nor unfavorable rating.

3. Price – The hourly rates provided in Attachment 4, Price Sheet, will be evaluated for the entire duration of the BPA. For evaluation purposes, the total evaluated price will be based on adding the proposed hourly rates for each year for the entire three-year period.

10.2 Adjectival Rating Definitions

The following ratings definitions will be utilized in the evaluation of the non-price evaluation factors:

Technical

Rating Definition Acceptable (A)

All of the minimum acceptable criteria are clearly met by the quotation. The quoter’s total or partial solution meets the performance and technical capability requirements defined in the specifications and solicitation.

Unacceptable (U)

Not all of the minimum acceptable criteria are met by the quotation.

An unacceptable quotation contains one or more deficiencies. The quoter’s total or partial solution fails to meet specified minimum performance and technical capability requirements defined in the specifications and solicitation.

Past Performance

Rating Definition Acceptable (A) Quoter’s relevant past performance record provides essentially no doubt that the quoter will successfully perform the required effort.

The quoter has received satisfactory or better reviews regarding past performance. The quoter demonstrates from past performance examples an ability to provide services that were of satisfactory or better quality on a timely basis with little to no risk of unacceptable performance.

Unacceptable (U) Quoter’s relevant past performance record provides essentially substantial doubt that the quoter will successfully perform the required effort. The quoter has received unsatisfactory reviews regarding past performance. The quoter demonstrates from past performance examples an inability to provide services that were of satisfactory quality on a timely basis with high risk of unacceptable performance.

Neutral (N) A quoter without a record of relevant past performance or for whom information on past performance is not available; the quoter may not be evaluated favorably or unfavorably. In this case, the Government will provide a “Neutral” rating.
