About this file
This document is an Amendment (Amendment 02) to Solicitation Number 697DCK-25-R-00226 for the Federal Aviation Administration's (FAA) William J. Hughes Technical Center electricity procurement. The amendment includes responses to nine supplier questions covering topics such as contract terms, PJM ancillary services, proposal submission dates, and hedging practices. Key updates include extending the proposal submission deadline to April 28, 2025 at 1:00 p.m., with a contract award date no later than May 1, 2025 at 10:00 a.m. The FAA confirmed this is a commercial item acquisition for non-residential electricity sales, requires all PJM ancillary services be included in pricing, and clarified that the agency has not made and does not intend to make any hedges during the contract term. The solicitation remains a firm-fixed price contract with all original clauses remaining in effect, and the FAA emphasized that taking exception to any contract terms would render a proposal unresponsive and unacceptable.

RESPONSES TO SUPPLIERS QUESTIONS
1. Question: Would the supplier be able to recover for what we deem to be a loss from reselling their hedges due to an early termination of the contract?
Answer: The Government reserves the right to terminate this contract for its sole convenience in accordance with contract clause 3.10.6-1 Termination for Convenience of the Government (Fixed Price) (Oct 1996). This clause and any other referenced clauses in Solicitation Number 697/DCK-25-R-00226 apply. If the supplier takes exception to any of the clauses in the FAA's Solicitation Number 697/DCK-25-R-00226 your proposal will be rendered unresponsive and unacceptable.
2. Question: Please confirm the FAA considers this SIR to be a commercial item acquisition?
Answer: The FAA considers Solicitation Number 697/DCK-25-R-00226 to be a commercial acquisition per Section G.2 (q) Non-Residential Sale.
Question: The FAA included clause 3.3.2-1 FAA Cost Principles on page 15 of the SIR.
According to the Prescription for that clause it "Must be used in all SIRs and contracts except for firm-fixed price contracts and fixed-price contracts with economic price adjustments (where adjustments are not based on actual costs incurred) for commercial items." The SIR also includes the clause 3.2.4-1 Type of Contract which indicates the FAA will issue a FIRM FIXED PRICE contract. Because the resulting contract will be firm-fixed price, will the Government consider removing clause 3.3.2-1? If 3.3.2-1 FAA Cost Principles is removed, please confirm whether clause 3.2.2.3-3 1 Facilities Capital Cost of Money should also be removed based on its Prescription?
Answer: The FAA views this question and clarification as an exception to Solicitation Number 697DCK-25-R-00226 and the FAA does not agree to this exception. All clauses referenced in Solicitation Number 697DCK-25-R-00226 apply. If you take exception to the FAA's Solicitation Number 697DCK-25-R-00226, your proposal will be rendered unresponsive and unacceptable.
Question: Is the Attestation for the retirement of Energy Attribute Certificates required given the recent Executive Orders around CFE?
Answer: Yes, the Attestation for the retirement of Energy Attribute Certificates are required per the terms of Section G.4 Contractor Attestation Confirming Compliance With NJ RPS.
5. Question: Option 1 and 2 Adders both list "all PJM Ancillary services". Can you please confirm this will require all suppliers to fix the following ancillaries:
a). Reactive Services b). Black Start c.) Reactive Supply & Voltage Control
Answer: Per the terms of Section C.4. 1 of Solicitation Number 2971DCK-25-R-00226, the Real-Time Fixed Price Adder and the Day-Ahead Fixed Price Adder include all PJM ancillary services with no exceptions.
6. Question: Per the requested hold period from submission due April 23 1 p.m., April 26 is a Saturday. Is this to be amended to April 25 by 10 a.m.?
Answer: The FAA will issue an Amendment to Solicitation Number 297/DCK-25-R-00226, Section L. Instructions, Conditions, and Notices to Bidders that will extend the proposal submission due date to no later than 1:00 p.m. on April 28, 2025 with a contract award date no later than 10:00 AM on May 1, 2025.
7. Question: Can you advise on the typical award notification period your prior bids for this facility?
Answer: See response to Question 6 above.
8. Question: Has the FAA made any hedges in the last 5 years of service?
Answer: No, the FAA has not made any hedges in the last 5 years of service.
9. Question: Does the FAA intend to make any hedges in the upcoming contract term?
Answer: No, the FAA does not intend to make any hedges in the upcoming contract term.
