About this file

This document is Amendment No. 3 to Solicitation No. 697DCK-25-R-00226, issued by the Federal Aviation Administration (FAA) Southwest Region on 04/21/2025. The amendment provides Revision 2 to the Supplier's Questions and Answers, adding Question 10, and updates several key procurement details. Specifically, the amendment extends the proposal submission due date to no later than 1:00 p.m. on April 28, 2025, with a contract award date no later than 10:00 AM on May 1, 2025.

The solicitation seeks firm load following electric supply services for the William J. Hughes Technical Center at Atlantic City International Airport, including electric energy, ancillary services, PJM marginal losses, NJ Renewable Portfolio Standards, and various transmission-related charges. Key clarifications in the Q&A include confirmation that the FAA considers this a commercial acquisition, confirmation that all PJM ancillary services must be included in the pricing adders, and clarification that Transmission Enhancement Charge (TEC) rates shall be directly passed through with no markup. The FAA also confirmed it has not made and does not intend to make any hedges during the contract term.

RESPONSES TO SUPPLIERS QUESTIONS

1. Question: Would the supplier be able to recover for what we deem to be a loss from reselling their hedges due to an early termination of the contract?

Answer: The Govenm-ient reserves the right to terminate this contract for its sole convenience in accordance with contract clause 3.10.6-1 Termination for Convenience of the Government (Fixed Price) (Oct 1996).

2. Question: Please confirm the FAA considers this SIR to be a commercial item acquisition?

Answer: The FAA considers Solicitation Number 697/DCK-25-R-00226 to be a commercial acquisition per Section G.2 (q) Non-Residential Sale.

Question: The FAA included clause 3.3.2-1 FAA Cost Principles on page 15 of the SIR.

According to the Prescription for that clause it "Must be used in all SIRs and contracts except for firm-fixed price contracts and fixed-price contracts with economic price adjustments (where adjustments are not based on actual costs incurred) for commercial items." The SIR also includes the clause 3.2.4-1 Type of Contract which indicates the FAA will issue a FIRM FIXED PRICE contract. Because the resulting contract will be firm-fixed price, will the Government consider removing clause 3.3.2-1? If 3.3.2-1 FAA Cost Principles is removed, please confirm whether clause 3.2.2.3-31 Facilities Capital Cost of Money should also be removed based on its Prescription?

Answer: No, the FAA will not remove clauses 3.3.2-1 or 3.2.2.3-3 1 from Solicitation Number

697DCK-25-R-00226.

Answer: Per the terms of Section C.4. 1 of Solicitation Number 297/DCK-25-R-00226, the Real-Time Fixed Price Adder and the Day-Ahead Fixed Price Adder must include J.i PJIM ancillary services with no exceptions.

6. Question: Per the requested hold period from submission due April 23 1 p.m., April 26 is a Saturday. Is this to be amended to April 25 by 10 a.m.?

Answer: The FAA will issue an Amendment to Solicitation Number 297/DCK-25-R-00226, Section L. Instructions, Conditions, and Notices to Bidders that will extend the proposal submission due date to no later than 1:00 p.m. on April 28, 2025 with a contract award date no laterthan 10:00 AM on May 1, 2025.
