FAA & Acquisition Reform
The 1996 DOT Appropriations Act provided the FAA with the opportunity for major reforms in acquisition. The legislation exempts the FAA from many of the existing Federal procurement laws and regulations including the Federal Acquisition Regulations (FAR)
EXEMPT
FAA - Acquisition Management System (AMS)
• The Acquisition
Management System (AMS) establishes policy and guidance for all aspects of lifecycle acquisition management for the Federal Aviation Administration (FAA). It defines how the FAA manages its resources -money / people / assets
- to fulfill its mission.
• FAA Acquisition System Toolset (FAST) https://fast.faa.gov/
Recent AMS Small Business Related Updates
• Noncompetitive Threshold for Acquisitions that include BIL
Funds:
– SDB, 8(a), WOSB, EDWOSB, and HUBZone AMS interim change allows noncompetitive awards to up to $20M if the acquisition includes Bipartisan Infrastructure Law (BIL) funding.
– In place through FY26.
– See AMS Policy section 3.6.1 and AMS Guidance section T3.6.1 for additional information regarding noncompetitive awards and small business.
– Note – noncompetitive award threshold for 8(a) certified was increased to $10M for all acquisition types (includes non- BIL funded).

• FAA approved Mentor-Protégé Program joint ventures are acceptable and/or Small Business Administration approved Mentor- Protégé Program joint ventures are acceptable.
• To receive an exclusion from affiliation, the MPA must be approved before a mentor and its protégé submit and offer for a small business contract as a JV.
Joint Ventures
• A JV must have a separate agreement and must be a separate legal entity identified in SAM.gov with its own UEI and Cage Code.
• Performance of work:
– For any contract set aside or reserved for small business that is to be performed by a joint venture between a small business protégé and its SBA-approved mentor or FAA-approved mentor, the joint venture must perform the applicable percentage of work in accordance with AMS Clause 3.6.1-7 Limitations on Subcontracting (15% for general construction not including materials)

33Federal Aviation
Scenario – Survey Questions The FAA has 30 towers across the nation (Eastern, Central and Western Service Area) that must be awarded and constructed expeditiously. A new standard design will be provided in the SIR package that will required contractor to site adapt the design and build the tower.
1. What are GCs concerns with executing this many towers?
i. Bonding Capability
ii. GC capacity
2. How many tower could a GC efficiently construct utilizing a Design-Bid-Build or Design- Build?
i. Service Areas vs Across the US
ii. Advantages to executing multiple sites on a single contract
iii. Sequentially vs Concurrently
iv. Geographically vs Tower Requirement
3. What capacity do the GC’s have to partner with manufacturing plants?
4. What is the ideal number of tower site to award under one contract?
5. 12 month construction schedule… Is this feasible?
34Federal Aviation
Scenario – Survey Questions – Cont’d
6. Does the GC’s have any concerns with supply chain issues? What can be done to mitigate those concerns? Ex. Steel, Mechanical, Electrical
7. What are the impacts vendors will encounter should be Project Labor Agreements (PLA) be required? How many subcontractors participation will be at risk? What is the potential pricing mark-up for including PLAs?
