1.2 PROJECT INFORMATION

A. Project Identification:

FY-20 Air Handler Units Replacement Project: Air Route Traffic Control Center (ARTCC), Houston, Texas

B. Project Location:

Air Route Traffic Control Center (ARTCC), 16600 JFK Blvd., Houston, TX 77032.

1.3 SUBMITTALS

A. Plan of Action: Provide written Plan of Action as specified in Article "Plan of Action" of this Section.

B. Letters of Certification: From Contractor certifying that products installed in this Project do not contain asbestos or lead.

1.4 WORK COVERED BY CONTRACT DOCUMENTS/PHASING PLAN

A. All requests for deviation from the construction phasing plan must be submitted to and approved by the COR/RE in writing (14) working days in advance of performance of the work.

The contractor shall not move to the next phase before the previous phase is complete and verified by cor. All materials and equipment needed for the next phase shall be onsite and ready for use or installation. The work of the project is defined by the Contract Documents and consists of the following construction phasing plan:

1. PHASE I: Demolish AHU 207. Provide and install a new AHU 207, complete all work associated with AHU 207 as described in the contract documents.

2. PHASE II: Demolish AHU 206 and AHU 208. Provide and install new AHU 206 and AHU 208. Complete all work associated with AHU 206 and AHU 208. Complete all work associated with AHU 206 and AHU 208 as described in the contract documents. A single AHU will be removed from service at a time unless otherwise approved by the COR in writing.

3. PHASE III: Refurbish AHU 201, AHU 202, AHU 203, and AHU 204. Complete all work associated with AHU 201, AHU 202, AHU 203, and AHU 204. See drawings and specifications for additional requirements. Only a single AHU will be removed from service at a time unless otherwise approved by the COR in writing.

4. PHASE IV: Demolish AHU 209. Provide and install new AHU 209. Complete all work associated with AHU 209, including the replacement of all VAVS associated with AHU

209. Spot check North wall for mold and water damage. Replace EWH 201. See drawings and specifications for additional requirements. This work takes place in an active air traffic break area, contractor shall work with the COR, facility, and all subcontractors to develop a plan of action that will limit disturbance to occupants. The plan of action shall be submitted to the COR for approval.

5. PHASE V: Demolish AHU 16 and AHU 17. Provide and install new AHU 16 and AHU

17. Complete all work associated with AHU 16 and AHU 17. See drawings and specifications for additional requirements. Only a single AHU will be removed from service at a time unless otherwise approved by the COR and CO in writing. Temporary air conditioning may not be required for this phase. Contractor shall confirm that AHU 216 and AHU 217 provide adequate temporary air conditioning to all affected zones.

6. PHASE VI: Demolish AHU 216, AHU 217, AHU 219, AHU 220, and AHU 221.

Provide and install new a AHU 216, AHU 217, AHU 219, AHU 220, and AHU 221..

Complete all work associated with AHU 216, AHU 217, AHU 219, AHU 220, and AHU 221.. See drawings and specifications for additional requirements. Only a single AHU will be removed from service at a time unless otherwise approved by the COR in writing.

Temporary air conditioning may not be required for the replacement of AHU 216 and AHU 217. The contractor shall confirm that new AHU 16 and AHU 17 provide adequate temporary air conditioning to all affected zones.

7. PHASE VII: demolish AHU 301. Provide and install new AHU 301. Complete all work associated with AHU 301, including the replacement of all VAVS associated with AHU 301, and the replacement of FC 401, EF 402, RF 101 and RF 301. See drawings and specifications for additional requirements. This work takes place in an active air traffic work area, contractor shall work with the COR, facility, and all subcontractors to develop a plan of action that will not disturb occupants. The plan of action shall be submitted to the COR for approval.

B. All facility operations will continue as normal. The contractors work shall be non-intrusive and the contractor shall not prevent facility access to any location or equipment without first receiving approval from the COR.

1.5 ACCESS TO SITE

A. General: Contractor shall have limited use of Project site for construction operations as indicated on Drawings by the Contract limits and as indicated by requirements of this Section.

B. Use of Site: Limit use of Project site to areas within the Contract limits indicated. Do not disturb

portions of Project site beyond areas in which the Work is indicated.

1. Driveways, Walkways and Entrances: Keep driveways loading areas, and entrances serving premises clear and available to FAA, FAA's employees, and emergency vehicles at all times. Do not use these areas for parking or storage of materials.

a. Schedule deliveries to minimize use of driveways and entrances by construction operations.

b. Schedule deliveries to minimize space and time requirements for storage of materials and equipment on-site.

1.6 GENERIC SEQUENCE OF WORK

A. Generic Sequence of Work:

1. Security badging of personnel;

2. Submittal approval;

3. Notice to Proceed. Submit work plan information to RE to include in Work Permit;

4. Mobilization – Establish limits of work: i.e. signs, pedestrian protection.

5. Follow the Phasing plan as described in this section.

6. Clean work site daily;

7. Furnish as-built drawings, O&Ms, and other contract documentation;

8. Contract complete.

1.7 COORDINATION WITH OCCUPANTS

A. FAA Occupancy: FAA will occupy site during entire construction period. Cooperate with FAA during construction operations to minimize conflicts and facilitate FAA usage. Perform the Work so as not to interfere with FAA's day-to-day operations. Maintain existing exits unless otherwise indicated.

1. Maintain access to existing walkways, corridors, and other adjacent occupied or used facilities. Do not close or obstruct walkways, corridors, or other occupied or used facilities without written permission from FAA and approval of authorities having jurisdiction.

2. Notify the FAA not less than 10 days in advance of activities that will affect FAA's operations.

1.8 WORK RESTRICTIONS

A. Work Restrictions, General: Comply with restrictions on construction operations.

1. Comply with limitations on use of public streets and other requirements of authorities having jurisdiction.

B. On-Site Work Hours: Limit work in the existing building to normal business working hours of 7:00 a.m. to 3:30 p.m., Monday through Friday, except as otherwise indicated. Optional

Four/Ten schedule shall be coordinated with COR.

C. Existing Utility Interruptions: Do not interrupt utilities serving facilities occupied by FAA or others unless permitted under the following conditions and then only after providing temporary utility services according to requirements indicated:

1. Notify FAA not less than 10 days in advance of proposed utility interruptions.

2. Obtain FAA's written permission before proceeding with utility interruptions.

D. Noise, Vibration, and Odors: Coordinate operations that may result in high levels of noise and vibration, odors, or other disruption to FAA occupancy with FAA.

1. Notify FAA not less than 10 days in advance of proposed disruptive operations.

2. Obtain FAA's written permission before proceeding with disruptive operations.

E. Normal Operation: Provide 30 days notice to COR for activities that interrupt normal operations, including, but not limited to, elevator, stairwell, hallway, and exit closure.

F. Nonsmoking Building: Smoking is not permitted within the building or within 25 feet of entrances, operable windows, or outdoor air intakes.

G. Controlled Substances: Use of tobacco products and other controlled substances on the Project site is not permitted.

1.9 PLAN OF ACTION

A. Do not perform any work which will require shutting down any services or that will disturb, distract or affect facility occupants without an approved Plan of Action.

B. Submit Plan of Action consisting of a written report describing the construction necessary, the utilities, piping or other services that will be affected, the length of time that each service or utility will be disturbed, and the procedures to be employed by the Contractor to carry out the work in a timely manner. Include action to be taken in case of emergencies, and an alternate plan that can be employed in the event that the original schedule cannot otherwise be met. The Resident Engineer (RE) must approve the plan prior to any work being performed.

C. Shutdowns shall be coordinated with the operations of the RE in all circumstances, and shall be scheduled in a manner to create the minimum amount of interference with existing FAA or airport facility operations. When shutdowns are necessary and have been approved by the COR, employ additional labor and work overtime as necessary to restore the facilities to operation at the earliest possible time at no additional cost to the FAA. Work shall proceed continuously until all service is restored.

1.10 HAZARDOUS MATERIAL CERTIFICATION

A. Asbestos free materials will be used on this project.

1. Provide letters of certification for the project at completion, certifying that no asbestos was used.

B. Lead-free materials.

1. Provide letters of certification for the project at completion, certifying that only lead-free paints, plumbing materials and flashings were used.

1.11 ACCEPTANCE AND WARRANTIES

A. Upon substantial completion of work the FAA will conduct Contractor Acceptance Inspections (CAI). At the appropriate stage after the CAI, the Work will be considered Substantially Complete, and the FAA will assume occupancy of the Work at a date identified as Beneficial Occupancy Date (BOD). Other Contractor Acceptance Inspections will be conducted prior to partial FAA occupancies. A final inspection, called Joint Acceptance Inspection (JAI), to determine FAA acceptance of the total Work, will then be conducted.

B. The Contractor shall warranty material and equipment furnished by the various manufacturers in writing for period of five (5) years (or not less than the industry standard for the material specified, nor the manufacturer’s standard warranty period, whichever is greater) on building systems, finishes or equipment from the date of final project acceptance by the FAA. The costs of any extended warranties will be included in the contract sum.

1.12 SPECIFICATION AND DRAWING CONVENTIONS

A. Specification Content: The Specifications use certain conventions for the style of language and the intended meaning of certain terms, words, and phrases when used in particular situations.

These conventions are as follows:

1. Imperative mood and streamlined language are generally used in the Specifications. The words "shall," "shall be," or "shall comply with," depending on the context, are implied where a colon (:) is used within a sentence or phrase.

2. Specification requirements are to be performed by Contractor unless specifically stated otherwise.

B. Division 1 General Requirements: Requirements of Sections in Division 1 apply to the Work of all Sections in the Specifications.

C. Drawing Coordination: Requirements for materials and products identified on the Drawings are described in detail in the Specifications. One or more of the following are used on the Drawings to identify materials and products:

1. Terminology: Materials and products are identified by the typical generic terms used in the individual Specifications Sections.

2. Abbreviations: Materials and products are identified by abbreviations published as part of the U.S. National CAD Standard and scheduled on Drawings.

3. Keynoting: Materials and products are identified by reference keynotes referencing Specification Section numbers found in this Project Manual.

1.13 MORATORIUMS

A. FAA Holiday Moratorium. No work shall be scheduled or take place during the week of and the weekend preceding and following: the Thanksgiving, Christmas, and New Year holidays.

Only emergency work to restore critical services to the Facility will be considered and a moratorium waiver must be submitted and approved. The moratorium period will not be counted against the contract construction duration of the project. The contractor shall confirm moratorium date with the COR.

SECTION 01 14 00 – WORK RESTRICTIONS

PART 1 - GENERAL

1.1 SUMMARY

A. Perform administrative job related requirements necessary for the proper conduct of the Work as indicated in this section and to comply with the General Conditions.

1.2 SUBMITTALS

A. Project Safety Program: Provide Project Safety Program for review and approval by the COR.

B. Construction and Demolition Plan and Solid Waste Management Plan required by FAA Order 3900.57A.

PART 2 - PRODUCTS

2.1 MATERIALS

A. Materials shall be in accordance with the requirements of the individual sections of these specifications.

2.2 MATERIALS CONTAINING ASBESTOS

A. Materials or products used on this project are to be asbestos free.

2.3 LEAD FREE PAINT, PLUMBING AND FLASHING MATERIALS

A. Only lead free paint, plumbing and flashing materials may be used on this project.

PART 3 - EXECUTION

3.1 FIELD MEASUREMENTS

A. Installer and sub-contractors are responsible for making complete field measurements. Check all dimensions at the job site for components requiring fit to surrounding conditions. Check shop drawings and indicate the actual dimension available at all locations.

3.2 JOB SAFETY PROGRAM REQUIREMENTS

A. All on-site work under this Contract shall be performed in compliance with the requirements of all Federal and State Occupational Safety and Health laws and regulations as they apply to construction site activity.

1. Comply with applicable Occupational Safety and Health Standard (29 CFR 1910 and 1926) promulgated pursuant to authority of the Occupational Safety and Health Act of 1970.

2. Comply with any other applicable Federal, State, or local regulations governing workplace safety to the extent that they do not conflict with other clauses of this contract. If a conflict exists between sections of this Contract, the more stringent requirement takes precedence.

3. Take all other proper precautions to protect the safety and health of Contractor’s employees, Federal Aviation Administration employees, and the public. Provide and maintain barricades, guard rails, covered walkways, lighting devices and other protective devices necessary to warn and protect the workmen and general public from hazards.

B. A minimum of 30 days prior to the start of construction, the Contractor shall submit a preliminary Project Safety Program, and meet with the COR to review the preliminary program and to discuss overall project safety requirements. The project safety plan shall incorporate the requirements described in section 01 15 00 of this specification.

C. Prior to the start of construction activity, the Contractor shall revise the preliminary Project Safety Program addressing FAA comments and provide FAA one copy of the final Project Safety Program. This program shall provide an aggressive action system by which hazardous conditions and unsafe practices shall be eliminated during the performance of this Contract. Construction work under this Contract shall not begin until the Project Safety Program has been approved by RE. Approval shall not relieve the Contractor of the responsibility for full compliance with all applicable statutory and regulatory requirements.

1. In addition to compliance with applicable statutory and regulatory requirements, the Project Safety Program shall contain provisions for mandatory safety orientation for every Contractor, subcontractor, and vendor employee assigned or sent to the site. Safety orientation shall cover as a minimum the rules and regulations governing on-site construction activities, special known hazards, accident prevention, emergency procedures, and personal protection equipment requirements.

D. The Contractor will maintain an accurate record of exposure data and all incidents performed under this Contract resulting in death, traumatic injury, occupational disease, or damage to property, material, supplies, or equipment. The Contractor must report the exposure data and accidents as prescribed by the RE.

E. All subcontracts and vendor purchase orders related to this project shall contain provisions requiring compliance with the Contractor’s approved Project Safety Program.

3.3 FIRE PROTECTION

A. Fire alarm detection equipment disabled during construction activities shall be enabled and working properly before leaving the site after a work shift.

B. Maintain fire extinguishers at construction site in sufficient number to adequately protect the structures during construction. Provide at least one fire extinguisher at each construction office.

Provide at least one fire extinguisher for welders or other trades using open flames in the execution of their work. Maintain “Fire Watch” personnel, with fire extinguisher in hand, during all welding/cutting or other open flame operations on, within, or near existing facility.

3.4 DISRUPTION TO SERVICES

A. The loss or shut down of existing FAA air traffic control equipment or associated support equipment for any amount of time will jeopardize safety of the flying public.

B. Disruption to existing utilities, piping, or electrical services must be held to a minimum. Carefully plan work in a manner that such disruptions are coordinated with the RE. All operations which require shut down of some portion of the facilities operation shall be in compliance with other Sections of Division 01.

3.5 ENVIRONMENTAL PROTECTION AND POLLUTION CONTROL

A. The Contractor shall perform all work necessary to implement and accomplish a program to prevent environmental pollution during or as a result of construction performed under this contract.

B. Take measures to prevent dispersal of pollutants into the atmosphere. Do not dump or otherwise discharge noxious, volatile or harmful fluids into drains or sewers.

3.6 HANDLING OF HAZARDOUS MATERIALS

A. Hazardous material which has been identified and requires removal, encapsulation or other protection shall be performed only by qualified, independent asbestos and/or lead base paint abatement contractor(s). Disposal of hazardous material resulting from this work shall be in accordance with applicable Federal, State and local regulations.

3.7 INITIAL MAINTENANCE

A. Maintain equipment until the project is turned over to the FAA.

SECTION 01-15-00 - Special Contract Requirement: COVID-19

PART 1 - GENERAL

1.1 SUMMARY

This supplemental document provides requirements Contractor must take to reduce the spread and/or exposure of COVID –19 on FAA contracts at Federal Aviation Administration (FAA) facilities.

The term “Contractor” in this document will include the Contractor employees, sub-Contractor employees, delivery personnel, and visitors.

1.2 COVID-19 SAFETY PLAN

The COVID-19 Safety Plan (CVSP) must include, but is not limited to, the following:

A. COVID-19 Wellness Self-Check (See Appendix A), this is a sample Wellness Self-Check questionnaire. Contractor should refer to CDC and local guidance for latest symptoms self-check list.

1. Contractor must conduct and complete the Wellness Self-Check form prior to reporting to the FAA facility and/or work site. The Contractor Superintendent/COVID-19 Safety Officer must review each form.

2. The person responsible for administering the Wellness Self-Check must have authority to deny anyone entering the FAA work site who displays any symptoms prior to entering, as well as, authority to remove persons develop symptoms after beginning work at the FAA facility.

3. Wellness Self-Check must be completed immediately prior to accessing the FAA work site. Contractor must note in their CVSP the physical location of where Wellness Self-check will be completed. Testing site must be outside the FAA property.

4. Contractor must take same precautions for deliveries entering FAA property regardless of driver exiting truck.

5. CVSP must include how Contractor plans to manage the delivery of product samples, batch tickets, and large project/shop drawings to the FAA.

B. COVID-19 Exposure Reduction Plan:

1. Face Covering: Contractor must wear a face covering while on the FAA work site and/or within a FAA facility. All face coverings, at a minimum, must adhere to the following:

a. Cover the nose and mouth;

b. Fit snugly, but comfortably, against the side of the face;

1.3 ADDITIONAL COVID-19 REQUIREMENTS

A. Prior to departing the FAA work site, the Contractor must wipe and disinfect all high touch point areas with approved wipes and/or disinfectant. High touch point areas include, but not limited to:

a. Doors and door hardware

b. Handrails

c. HVAC components

d. Gates

e. Light controls

f. Desks

g. Telephones

h. Chairs

B. Contractor must provide separate temporary sanitary facilities dedicated to Contractor use.

Contractor is not permitted to use FAA restrooms within a facility. High touch points on/within the temporary sanitary facilities (door handles, toilet seat, etc.) must be wiped and disinfected after each use by the individual using the facility. Contractor must supply the required wipe and/or disinfecting supplies.

C. Remove all trash and accumulated waste daily.

1.4 SITE ACCESS/EGRESS

A. The Contractor must meet with the FAA’s Contracting Officer Representative (COR) and local FAA management prior to the start of the project to establish the Contractors’ access, badging, and security requirements.

B. If a Contractor is not feeling well for any reason and COVID-19 symptoms exist, the individual will

C. be denied access to the FAA facility. If a Contractor develops COVID-19 symptoms while at the FAA facility, the Contractor is required to immediately remove the symptomatic individual from the FAA facility, notify the FAA Contracting Officer (CO) and/or COR and immediately inform the FAA of any concerns regarding the work that was expected to be performed by that Contractor. The Contractor must also provide details on all locations where the symptomatic individual visited within the FAA facility.

1.5 FAA NOTIFICATIONS

A. Contractor is required to notify the FAA immediately when a suspected or confirmed case of COVID-19 has visited the FAA facility and/or work site within past 14 days; been in contact with someone that may have visited a FAA facility; and/or had contact with a FAA employee and/or another agency Contractor. Reporting must include the information outlined below to allow the FAA to make a timely and appropriate response. Report any suspect or confirmed cases to 9-AFN-ACQ- EM@faa.gov, with a courtesy copy to the CO and COR. The report must include, for each affected individual:

a. Date of self-quarantine

b. Whether the case is suspected or confirmed.

c. Where the individual visited (building address) or with whom they met and the date of latest contact.

d. To ensure privacy information is protected, do not include specific information about the individual via e-mail.

e. Once information is received, a FAA official will contact the Contractor directly to obtain additional information regarding the case(s) to coordinate a proper response.

B. Provide medical documentation by an authorized medical professional stating the individual no longer poses a transmission risk and is safe to re-enter the FAA work site. Return to work documentation must be provided to the CO and COR.

1.6 SUBMITTALS

A. The Contractor must provide the following:

a. COVID-19 Safety Plan

b. Washing/Sanitizing Station(s)

c. Temporary/Portable Sanitary Facility

d. Cleaning/Disinfection supply Safety Data Sheets (SDSs)

e. Hand Sanitizer SDSs

A. Shared use of trailer between FAA and Contractor personnel is not permitted.

G. Identify all the personnel coming from outside of the State/local commuting area at least one week prior to coming onto the FAA facility.

NOTE: Any breach to CVSP or other requirement listed in this document will result in removal of the Contractor and/or issuing Stop Work Notice by the CO.

PART 1 - GENERAL

A. This Section includes administrative provisions for coordinating construction operations on Project including, but not limited to, the following:

4. Administrative and supervisory personnel.

1.2 SUBMITTALS

A. Coordination Drawings: Prepare Coordination Drawings if limited space availability necessitates maximum utilization of space for efficient installation of different components or if coordination is required for installation of products and materials fabricated by separate entities.

1. Indicate relationship of components shown on separate Shop Drawings.

2. Indicate required installation sequences.

3. Refer to Section 23 05 00 "Common Work Results for HVAC" and Section 26 05 00

"Common Work Results for Electrical" for specific Coordination Drawing requirements for mechanical and electrical installations.

B. Staff Names: Within 10 days of starting construction operations, submit a list of principal staff assignments, including superintendent and other personnel in attendance at Project site. Identify individuals and their duties and responsibilities; list addresses and telephone numbers, including home and office telephone numbers. Provide names, addresses, and telephone numbers of individuals assigned as standbys in the absence of individuals assigned to Project.

1. Post copies of list in Project meeting room, in temporary field office, and by each temporary telephone.

C. Utility Service Interruptions: The Project is located at an FAA facility with 24 hour, 7 day a week operation and prohibits any interruption of electrical, natural gas or water services. For minor interruptions in these services, provide not later than 10 calendar days prior to the first planned interruption a utility service interruption plan, followed by confirmed scheduled shut-down notices at least 3 calendar days prior to each interruption.

1.3 ADMINISTRATIVE AND SUPERVISORY PERSONNEL

A. General: In addition to Project superintendent, provide other administrative and supervisory personnel as required for proper performance of the Work.

1. Include special personnel required for coordination of operations with other contractors.

A. Inspection of Conditions: Prior to installations, require the installer of each major component to inspect both the substrate and conditions under which work is to be performed.

2. Coordinate temporary enclosures with required inspections and tests to minimize the necessity of uncovering completed construction for that purpose.

B. Construction in Progress: Keep construction in progress, and adjoining materials in place, clean during handling and installation. Apply protective coverings where required for protection from damage or deterioration.

C. Completed Construction: Clean completed construction, and provide maintenance, as frequently as necessary to prevent damage or soiling or other deterioration through the remainder of the construction period.

D. Limiting Exposures: Supervise construction operations to prevent exposure of any part of construction, completed or in progress, to harmful, dangerous, damaging or otherwise deleterious conditions during the construction period. Such conditions including but not limited to the following:

1. Puncture.

2. Abrasion.

3. Heavy traffic.

4. Soiling, staining, and corrosion.

5. Electrical current.

6. Contact between incompatible materials.

7. Improper shipping or handling.

8. Theft or vandalism.

1.2 SUBMITTALS

A. Qualification Data: For firms and persons specified in "Quality Assurance" Article and in-house scheduling personnel to demonstrate their capabilities and experience. Include lists of completed projects with project names and addresses, names and addresses of architects and owners, and other information specified.

B. Contractors Construction Schedule: Submit three copies of the project construction schedule large enough to show entire schedule for entire construction period. Submit for approval within 7 days prior to Notice to Proceed.

C. Field Condition Reports: Submit two copies at time of discovery of differing conditions.

1.4 COORDINATION

A. Coordinate preparation and processing of schedules and reports with performance of construction activities and with scheduling and reporting of separate contractors.

PART 2 - PRODUCTS

2.1 REPORTS

A. Field Condition Reports: Immediately on discovery of a difference between field conditions and the Contract Documents, prepare a detailed report. Submit with a request for information.

Include a detailed description of the differing conditions, together with recommendations for changing the Contract Documents.

B. Weekly Progress Meeting: Provide a weekly progress meeting, discuss Construction Schedule Updates, Submittals, Requests for Information, Contract Changes. COR and contractor may request additional topic of discussion.

SECTION 01 33 00 – SUBMITTAL PROCEDURES

PART 1 – GENERAL

1.1 GENERAL

A. Submittals must be provided by the Contractor for review and approval prior to construction. This section includes instructions for scheduling and submitting submittals as required herein, by drawing, or in the various sections of the specifications. Any submittal required by the contract specifications or drawings must be included on the Contractor's submittal register.

B. Submittals Format: All submittals are to be provided to the FAA in electronic format. Three hard copies of submittals where material samples or color choices are being submitted for selection or validated are to also be provided along with the electronic copy. Also, hard copies of O&M manuals are to be provided; see paragraph 1.7 below and Section 01 78 23, “Operation and Maintenance Data” for O&M manual detailed requirements.

C. All submittals are required to be submitted and approved prior to issuance of Notice to Proceed.

1.2 DEFINITIONS

A. Submittals: A submittal is a contractor or manufacturer's product information, drawing, brochure, sample, certificate, warranty, or other information that provides detail for construction and quality control of the permanent work.

B. Submittal timetable: A tabulated list using the Submittal Register in a format approved by the COR, showing the date when the Contractor intends to submit each item. Coordinate with Submittals Schedule Section 01 32 00 – 2.2.

C. Submittal material: The information concerning each item of specified equipment or material as required for establishing conformance with the specifications, identifying a specified item of equipment or material, or supplementing the contract specifications or drawings. The Submittal Register must include, but not be limited to:

1. Manufacturer's or supplier's product data, brochures, or descriptive literature.

2. All Contractor-prepared or procured shop drawings.

3. Manufacturer’s installation instruction, including testing, which the Contractor must following unless specified otherwise.

4. Schedules.

5. Certificates of compliance.

6. Manufacturer’s operation and maintenance manuals, which the Contractor must following unless specified otherwise.

7. Warranties, including the Contractor’s one-year construction warranty.

1.3 SUBMITTAL REGISTER

A. The Contractor must track and maintain the submittal register by filling-in the submittal transmittal numbers, Contractor, and Government actions as the submittals progress, and provide updated submittal registers with each monthly pay request.

1.4 CONTRACT SUBMITTALS

A. The Contractor is responsible for the adequacy of submittals for compliance with the Contract.

B. The Contractor must thoroughly review in detail, approve, and certify that each submittal is in strict conformance with contract specifications and drawings, except as may be otherwise explicitly stated, before submitting it to the Government for review and approval.

C. Submittals must be in sufficient detail when first submitted to enable ready determination of the acceptability of the equipment or material. The submittal must be complete, as applicable, with all required working drawings, schedules, diagrams, charts, certificates, samples, test specimens, manufacturer's qualifications, descriptive literature, and performance curves as applicable. Every characteristic of the item specified in the specification must be positively identified in the submittal. The location or use of each unit of equipment or material must be identified in the submittal. The Contractor must make all annotations required to finish any incomplete submittals originating from subcontractors or suppliers. If a submittal is disapproved by the Contracting Officer, or if the Contracting Officer’s Representative (COR) determines that the submittal is not adequate to justify the Contractor's approval, the Contractor must make corrections and resubmit the same number of copies as for an original submittal.

D. Failure by the Contractor to make a required submittal for any item of work prior to construction will result in withholding of progress payments for that item.

E. The Contracting Officer may issue an order stopping any work for which the prescribed submittals have not been submitted and processed as required. No part of the time lost due to any such stop orders will be made the subject of a claim by the Contractor for extension of performance time, for excess costs, or damages.

F. Submittals must be delivered to the COR a minimum of 3 weeks prior to the date the Contractor requires return of the approved submittals with exceptions as otherwise specified. The Contractor is cautioned that this time period does not include any allowance for resubmittal in cases where the Contracting Officer determines that the Contractor's approval and certification are not adequately justified.

G. Delays caused by inadequacies in the Contractor's review process will be the responsibility of the Contractor, and will not be made the subject of a claim for extension of time or for excess costs or damages by the Contractor.

H. Where substitutions are being proposed, the requested substitution shall indicate if affect to the Contractor's construction schedule.

I. Any item purchased and/or installed by the Contractor that does not comply with the contract specifications are subject to rejection and replacement with conforming items without additional

cost to the Government and without any extension of performance time. This provision applies to deficiencies resulting from erroneous Contractor approvals or work performed prior to the Contracting Officer's approval.

J. Approval by the Contracting Officer must not be construed as assuming responsibility for the Contractor’s work. The Contracting Officer will rely upon the Contractor's certification on the submittal that a complete check has been made and conformance with the contract has been met.

Approval must not be construed as authorizing any deviations from the contract specifications and drawings, unless the deviation itself is explicitly designated as the subject of the approval. If a proposed deviation from the original Contract requirements is approved, the new contract requirements will be established as provided in the Contract Clause: “Specifications, Drawings, and Material Submittals”.

K. Submittals must include a transmittal in a format to be approved by the COR.

1. An electronic copy of a signed original version must be furnished to the COR as part of each submittal. When hard copies of a submittal are required, a copy of the signed original transmittal shall be the first page of each submittal copy.

2. The prime Contractor will be fully responsible for this form and the adequacy of all submittals containing information prepared by its subcontractors.

3. The transmittal number identifies the specification section number and are then numbered sequentially starting with the number “1” for that specification section, such as “26 51 00 – 01” for the first Interior Lighting submittal. Note that the transmittal number is different than the item number. For example, the first transmittal in a specification section could be for the third item number, and the second transmittal could be for the first item number in the specification section. A resubmittal shall differentiate from the original number by adding the letter A, or subsequent letters, i.e. -1A for the first resubmittal of -1, -1B for the second resubmittal of -1A, and so forth. Reference the original transmittal in remarks column/portion of the form.

4. Identify that the submittal is from the Contractor, regardless if a vendor or subcontractor first submitted the item to the Contractor for its review and approval before the Contractor submits it to the Government for review and approval. Include the Contractor’s name, mailing address, contact name and telephone number.

5. All submittals for this work are for Government review and approval.

6. Each transmittal should cover only one section of the specifications or drawings. However, if an item applies to more than one section, a single submittal is acceptable provided the paragraphs of each applicable section are identified on the transmittal and all applicable item numbers are listed on the form.

7. Include a Remarks column, and if additional space is needed, the Contractor may write “See Attached”, and attach a supplemental sheet.

L. Deviations: For submittals that do not meet the specifications and drawings, the Contractor may propose a deviation (variation) and a Variation Column on the form must be checked. The Contractor must set forth in writing the justification and all the reasons for any deviations and annotate such deviations on the submittal. The variance must be correlated to the specific
