Federal Aviation Administration | Statement of Work | Phase I Environmental Site Assessment - 1-

Reques t for Quotation:

Phas e I Environmental Site As s es s ment

FAA Airport Surveillance Radar (ASR) Francisco C. Ada/Saipan International Airport Saipan, Northern Mariana Islands

January 02, 2023

The Federal Aviation Administration (FAA) requests a quotation from a qualified consultant to prepare a Phase I Environmental Site Assessment (ESA) for one (1) location for the proposed Airport Surveillance Radar (ASR) at the Francisco F. Ada/Saipan International Airport. The response to this Request for Quotation (RFQ) shall be based on the Statement of Work (SOW) contained herein.

1.0 Scope

1.1 Overview

1.1.1 Background

The FAA plans to construct a new Airport Surveillance Radar (ASR) facility at the Saipan International Airport. A Phase I ESA is required for the proposed ASR site prior to the real estate transaction.

1.1.2 Site Location Details

The site is located southeast of the airport. Site details are shown in the table below. Please refer to the appendix for an aerial photograph of the site location and layout.

1.2 Scope of Work

The Phase I ESA must be prepared in general conformance with the latest version of FAA Order 1050.19, Environmental Due Diligence in the Conduct of FAA Real Property Transactions. FAA Order

1050.19 requires that a Phase I ESA be conducted in accordance with the U.S. Environmental Protection Agency (EPA) standards on “all appropriate inquiries (AAI)” as defined in 40 CFR Part 312.

These EPA standards further reference conformance with the latest version of ASTM International Standard E 1527, Standard Practice for Environmental Site Assessments: Phase I Environmental Site Assessment Process, as a guideline for conducting Phase I ESAs.

The Phase I ESA report shall be formatted in general conformance with the “Recommended Table of Contents and Report Format” in Appendix X5 of ASTM International Standard E1527-21.

Specific inquiries that are required as part of the EPA AAI standards may not be relevant to FAA real property transactions. However, these inquiries must be performed to the extent possible to minimize potential environmental liabilities. As required by 40 CFR §312.29, persons must consider the relationship of the purchase price to the fair market value of the subject property if the property was not contaminated. For FAA real property transactions, the purchase price may not be relevant, given that property may be obtained through a no cost lease or may be ceded to the government. In such cases, an explanation of the lease or purchase circumstances in the Phase I ESA report will suffice to meet this requirement.

As required by 40 CFR §312.24, historical documents and records must be reviewed for the purposes of achieving the objectives and performance factors of “all appropriate inquiries.” A chain of title search may not be practicable for proposed FAA real property transactions, which may involve small parcels of land within much larger parcels, such as within an airport. Note that there may not be chain of title documents for Federal property which have been owned for a substantial period (i.e., 100 or more years), or the chain of title documents may not provide detailed information about land use.

Although listed as a user responsibility under the latest version of ASTM E1527, the consultant will be responsible for the search of environmental liens and Activity and Use Limitation’s (AUL’s) in order to meet the EPA’s standard for AAI.

1.3 Period of Performance

The period of performance for this SOW shall begin when the FAA credit card holder or Contracting Officer provides notification that the consultant has been selected to perform the work and the FAA primary point of contact has provided the notice to proceed to prepare the Phase I ESA report. The period of performance shall conclude when the FAA primary point of contact has provided written notification to the consultant that the Final Phase I ESA report has been accepted. The projected schedule is summarized in Table 1.

3.1 Tasks and Deliverable Materials

The deliverables are list in Table 2.

(Microsoft Word and PDF) 15 business days after the site reconnaissance.

Final electronic copy (PDF) 2 business days after final FAA review (FAA review is estimated at 30 days)

Single final hard copy of the Phase I ESA report

3 business days after final FAA review: After the consultant provides the final electronic copy, the consultant shall send the FAA point of contact a single bound hard copy of the final Phase I ESA report via overnight delivery.

The draft electronic report will require multiple FAA review cycles, including technical and legal reviews. The consultant must provide the FAA with each version of the revised draft report within three business days of receipt of the comments.

3.2 Other Considerations

The Phase I ESA report may require the inclusion of items not within the scope of AAI and ASTM International Standard E1527-21. Local environmental authorities may impose environmental requirements on the seller of real property, including federally-owned real property, where a hazardous substance has been managed or released. The requirements established by these local authorities roughly fall into four general categories:

1. Actual cleanup of hazardous substances prior to sale.

2. Notice to the purchaser prior to sale.

3. Registration/approval by state or local agency.

4. Hazardous waste management facility notices in deed.

If applicable, these items shall be addressed for FAA real estate transfers (e.g., sale, leases) in the “non-scope” section of the Phase I ESA report.

3.3 Consultant Qualifications

The Phase I ESA report must be authored by an individual who meets the definition of a qualified Environmental Professional, as specified by the latest version of FAA Order 1050.19 and the EPA AAI Rule and/or ASTM International 1527-21.

3.4 Assumptions

It is assumed that the consultant shall be able to gain site access through public rights of way or from an official escort coordinated by the FAA.

It is assumed that the FAA will guarantee right of entry to the site for the consultant on the mutually-agreed upon site reconnaissance date.

It is assumed that the consultant shall have unhindered access and view of the site during the site reconnaissance.

It is assumed that the consultant shall provide their own appropriate safety gear for the site conditions present at the time of the site reconnaissance. Appropriate safety gear may include, but may not be limited to work boots, high visibility vest, hard hat, and other personal protective equipment.

5.0 RFQ Submis s ion Ins tructions

Responses to this RFQ must include a final fixed price lump sum quote and narrative in which the consultant demonstrates technical and logistical understanding of the tasks contained in this SOW.

Payment will not be made until after the consultant has obtained written approval from the FAA primary point of contact that the final Phase I ESA report copies have been received.
