About this file

This document is a set of questions and answers related to a Request for Proposals (RFP) for Federal Motor Vehicle Safety Standard (FMVSS) No. 121, Air Brake Systems, and FMVSS No. 136, Electronic Stability Control for Heavy Vehicles. The RFP is issued by the National Highway Traffic Safety Administration (NHTSA), an operating administration of the U.S. Department of Transportation, to enable the agency to assure that motor vehicles meet the requirements of these safety standards through compliance testing.

The key details include: NHTSA will only perform non-destructive portions of the compliance tests; NHTSA agrees to omit using a test dummy and high-speed video specifications; NHTSA agrees to the use of K-type thermocouples instead of J-type; NHTSA is open to reaching out to manufacturers to provide trucks and buses for the testing; NHTSA will have a "Not to Exceed" limit on lease cost reimbursements; the requirement for 5 separate proposal copies on flash drives has been removed; and NHTSA reserves the right to request a full FMVSS 121 test, a combination of full FMVSS 121 and partial FMVSS 136 tests, or a full FMVSS 136 test only.

SOLICITATION #693JJ924R000012

FMVSS No. 121, Air Brake Systems & FMVSS No. 136, Electronic Stability Control for Heavy Vehicles.

Questions and NHTSA Response

ADVISORY: The numbering for the sections of Attachment J.3 have been revised in the attached amended solicitation. Responses to the questions refer to the revised section numbering for Attachment J.3.

1. TECHNICAL QUESTIONS

a. Question: Do the laboratory tests from the NHTSA Test Procedure for FMVSS 121 such as water pressurization, air over pressurization, etc. have to be performed or can those tests be omitted?

NHTSA Response: NHTSA will only perform non-destructive portions of our compliance tests.

b. Question: In Section H.17 “SPECIFICATION FOR HIGH-SPEED VIDEO”, can we omit using a test dummy, and change the stated video resolution and speed (the stated resolution does not match NHTSA Test Procedure for 121, and high-speed is meant for crash-testing)?

NHTSA Response: NHTSA agrees with test dummy omission for the FMVSS 121/136 Compliance tests and for the omission of crash-testing high-speed video specifications.

c. Question: In Section L.11.3 “Facility and Equipment (Evaluation Factor M.2.2)” Can we use K-type thermocouples instead of J-type?

NHTSA Response: NHTSA agrees with usage of the K-type thermocouples instead of J-type thermocouples.

2. COST/PRICE QUESTIONS

a. Question: In Section B.3.3 “PRICE SCHEDULE – BASE PERIOD (CONTRACT YEAR

1) – KNOWN REQUIREMENTS”, is NHTSA willing to ask manufacturers to provide any trucks and buses needed for this testing? From experience these are very difficult to lease.

NHTSA Response: NHTSA is open to reaching out to manufacturers for possible supply of trucks and buses for compliance testing.

b. Question: In Section M.5.1 “BASE PERIOD (CONTRACT YEAR 1) – KNOWN

REQUIREMENTS”, are lease cost reimbursements in bid set in stone or can those be exceeded?

NHTSA Response: NHTSA will have a “Not to Exceed (NTE)” limit proposed on final

contract award.

c. Question: In Section L.8 “PROPOSAL CONTENT”, are 5 copies of proposal on separate flash drives actually required?

NHTSA Response: RFP Section L is hereby updated to remove references to flash drives.

d. Question: In Section L.11.3 “Facility and Equipment (Evaluation Factor M.2.2)”, should a drawbar pull test be required? Can that portion of the test be subcontracted?

NHTSA Response: Contractor should be capable of performing a drawbar pull test if NHTSA requests such test to be performed. Subcontracting is not permitted under this contract except for calibration services as required under this contract. Subcontracting of tests or any portion of a test is NOT permitted.

e. Question: In Section M.5.1 “BASE PERIOD (CONTRACT YEAR 1) – KNOWN REQUIREMENTS”, is the intent to only require a partial 136 if the test vehicle previously had 121 performed on it?

NHTSA Response: Yes. NHTSA reserves having the options to requesting any/all of (1) Full FMVSS 121 Compliance Test Only, (2) Full FMVSS 121 and Partial FMVSS 136 Compliance Tests Combination and (3) Full FMVSS 136 Compliance Test Only.
