B.1 SUMMARY
B.1.1 Supplies/Services/Requirements
The Contractor shall provide the qualified personnel, facilities, materials, supplies, equipment and services, except as identified in Section H.3, Government Furnished Property (GFP), necessary to perform inspection, compliance testing, and reporting services to determine conformance of motor vehicles to the requirements of the following Federal Motor Vehicle Safety Standards
(FMVSS):
The FMVSS No. 212, 219, and 301 tests shall be performed in conjunction with the FMVSS No.
208 crash tests as specified in the Office of Vehicle Safety Compliance (OVSC) Test Procedure TP-208-14. FMVSS No. 212, 219 and 301 tests shall be noted as indicant tests and specified as such on the test reports. An “indicant” test refers to a test that provides a good indication of how a vehicle performs, although the test is not conducted in full accordance to the standard.
At the request of the NHTSA Contracting Officer (CO) and/or Contracting Officer’s Representative (COR), the FMVSS No. 305 test shall also be performed in conjunction with the FMVSS No. 208 crash test. If performed, the FMVSS No. 305 test shall be noted as an indicant test and specified as such on the test reports.
Following completion of vehicle testing, the vehicle shall undergo a post-test restraint deactivation process. The deactivation process may include, at the request of the COR, the disposal of certain types of batteries used in the vehicle propulsion system.
B.1.2 Contract Type
This is an Indefinite Delivery, Indefinite Quantity (IDIQ), Firm Fixed-Price (FFP) Contract with Cost Reimbursement elements for the following items: (1) Towing, Parts, and Dealer Repairs;
(2) Contractor Purchased Child Restraints; and (3) Battery Disposal.

C.2 BACKGROUND
The National Highway Traffic Safety Administration (NHTSA) is an operating administration of the United States Department of Transportation (DOT). NHTSA’s mission is to save lives, prevent injuries and reduce economic costs due to road traffic crashes. The agency develops, promotes, and implements effective educational, engineering and enforcement programs with the goal of ending preventable tragedies associated with vehicle use and highway travel.
As part of its mission to reduce fatalities and injuries caused by motor vehicle crashes, NHTSA promulgates Federal Motor Vehicle Safety Standards (FMVSSs). Manufacturers of motor vehicles and items of motor vehicle equipment are required to certify that each product they sell in the United States meets the requirements of all applicable FMVSS.
Under this compliance test program, NHTSA’s Office of Vehicle Safety Compliance (OVSC) will select vehicles and items of motor vehicle equipment for compliance testing. OVSC relies upon the data and analyses generated by the testing to determine whether vehicle manufacturers’ self-certifications are valid.
Please note that the Government reserves the right to conduct any or all of the compliance tests required in this contract each year, and including any other occupant protection related testing and analysis that may be needed in any area of general traffic safety.
C.3 GENERAL REQUIREMENTS
The Contractor shall furnish the necessary qualified personnel, facilities materials, supplies and equipment to perform inspection and compliance testing services in accordance with FMVSS No.
208, Occupant Crash Protection, FMVSS No. 212, Windshield Mounting, FMVSS No. 219, Windshield Zone Intrusion, FMVSS No. 301, Fuel System Integrity (Frontal), and FMVSS No.
305, Electric Powered Vehicles: electrolyte spillage and electrical shock protection. The Government will provide the Contractor with the test vehicles, anthropomorphic test devices (dummies) without instrumentation, and child restraint systems (CRSs) as Government Furnished Property (GFP).
The compliance tests for FMVSS No. 208 include low risk static deployment tests, inflatable restraint suppression tests, and full scale dynamic crash tests. Each GFP test vehicle shall undergo a full scale dynamic crash test. Testing for FMVSS Nos. 212, 219, 301 and 305 (where applicable) shall be performed in conjunction with the full scale dynamic crash test. All testing shall be performed as specified in the OVSC Test Procedure, TP-208-14. At the conclusion of each test using a GFP test vehicle and prior to GSA sale, and upon request by the Contracting Officer’s Representative (COR), the Contractor shall make all test vehicle safety restraints inactive by safely deploying all undeployed air bags and seat belt pretensioners and removing no less than 1 foot (12 in.) of seat belt webbing from each seat belt. Prior to GSA sale, if applicable, the Contractor shall initiate the battery pack disposal process which involves removing the high voltage battery pack or energy storage device used for propulsion from the vehicle and properly packing the device for shipping or disposal, and using shippers and recyclers for battery pack disposal that comply with applicable Federal and State laws.
Prior to the full scale dynamic crash test, numerous low risk static deployment tests and/or inflatable restraint suppression tests, along with other passenger restraint systems tests may be performed. After each low risk, static deployment test, the Contractor shall procure from a dealership*, original equipment manufacturer (OEM) parts** to repair the vehicle to like new condition. The Contractor shall obtain approval from the COR to either perform the repair in-house, or have the dealership perform the repair. In preparation for the full scale dynamic crash test, the Contractor shall have the GFP test vehicle transported to and repaired by a dealership after the completion of the low risk static deployment tests, inflatable restraint suppression tests, or other passenger restraint systems tests.
*Note: Dealership refers to a franchise associated with the OEM of the GFP test vehicle and authorized by the OEM to sell OEM parts and perform repairs.
**Note: The windshield is a possible exception. If a windshield is damaged during a low risk deployment test, the Contractor shall notify the NHTSA COR. If the COR determines that a replacement windshield is needed, the Contractor shall make arrangements with a dealer or windshield replacement company to replace the windshield on-site with an OEM windshield. If an OEM windshield is not available, an aftermarket windshield may be used upon approval from the COR. The costs for the windshield and services from the dealer or windshield replacement company shall be reimbursed under the Towing, Parts and Dealer Repairs CLIN.
When necessary, the Government may require additional investigation support. This may include, but is not limited to, additional pictures/videos, removal of parts from the vehicle, installation of new parts, and providing additional measurements. The Government shall reimburse the Contractor for these costs in accordance with the Price Schedule specified in B.4.
Upon request of the Government, the Contractor shall purchase additional child restraint systems for the compliance tests. The Government shall reimburse the Contractor for the actual cost plus the administrative cost of purchasing the restraints in accordance with the Price Schedule specified in B.4. The Contractor shall store the child restraint systems in an environmentally controlled storage area/facility.
The Contractor shall perform and complete testing and associated inspections within the timeframe specified in Section F.4.1, Deliverables/Milestones Schedule, and shall submit deliverables as required by the Schedule.
C.4 KICK-OFF MEETING
On the effective date of contract award, the Contractor shall contact the NHTSA COR to plan for the kickoff meeting. Within two (2) weeks of the effective date of the contract award, the Contractor shall participate in a Kickoff meeting with the Contracting Officer’s Representative (COR), Contracting Officer (CO), and other NHTSA staff. The Kickoff meeting may take place via teleconference. This meeting will be approximately two hours in length. The Contractor shall make a brief presentation of their understanding of the contract requirements. After the presentation, the parties shall discuss basic contract requirements, including the schedule for testing and test procedures.
C.5 SPECIFIC CONTRACT REQUIREMENTS
C.5.1 Fully Operational Test Site
The Contractor shall possess and maintain a fully operational test site furnished with qualified technical personnel, facilities, equipment and test devices necessary to perform the inspection, compliance testing and reporting services in accordance with the terms and conditions of this contract for the full potential performance period outlined in Section F.2, Period of Performance.
The Contractor’s fully operational test site shall be sufficiently staffed to perform and complete testing and associated inspections, and to generate and submit deliverables within the timeframes specified in Section F.4.1, Deliverables/Milestones Schedule.
C.5.2 Test Procedures and Data Collection Project Plan
The Contractor shall perform all work in accordance with the requirements of the FMVSSs, the OVSC Test Procedures (TPs), and any applicable federal regulations. The list of applicable TPs is in Section J and each TP is incorporated into this contract. Applicable federal regulations are available for reference via the following link: www.ecfr.gov.
http://www.ecfr.gov/
Specific contract requirements supersede all requirements in the OSVC Test Procedures (TPs) incorporated by reference in Section J. If there is a conflict between the OVSC TPs and the requirements of the contract, the contract shall prevail.
Detailed “in-house” check-off-sheet style test procedures created by the Contractor will be referred to hereinafter as “Contractor Test Procedures.” Contractor Test Procedures are subject to the COR approval.
In addition to meeting the requirements of the test procedures, the Contractor shall follow its internal data collection project plan developed specifically for this compliance program. Within four (4) weeks of the effective date of the contract, the Contractor shall provide the COR with an update to its data collection project plan that was originally submitted as part of its technical proposal. The updated plan shall reflect any changes made since submission of the original submitted plan. The Contractor shall submit proposed revisions to its data collection project plan to the COR in advance for review and approval before implementing any such revisions.
C.5.3 Government Furnished Property (GFP)
Government Furnished Property refers to property in the possession of, or directly acquired by, the Government and subsequently furnished to the Contractor for performance of this contract (Refer to Section H.3). The Contractor shall notify the COR within 24 hours of receipt of any
