RFP: 693JJ919R000006

Title: ATD Management Laboratory Parts, Supplies and Services

Questions and Responses

1. Question - Is this requirement a new requirement or is there a current or previous contractor who has performed similar services? If available, please provide incumbent information.

NHTSA Response:

The intended award(s) will be a follow on to an existing contract program. Existent contract holders/numbers are as follows:

DTNH22-13-D-00300 – Diversified Technical Solutions, Inc.

DTNH22-13-D-00301 – Humanetics Innovative Solutions, Inc.

DTNH22-13-D-00302 – Jasti USA, Inc.

DTNH22-13-D-00303 – SACO Research, LLC

2. Question - Reference Section II, Subsection 5. The last public THOR-50M drawing package released by NHTSA is the August 2016 release. However, NHTSA has developed an updated THOR-50M drawing package and plans to publicly release this design package in the near future. Can NHTSA provide this updated THOR-50M design package to interested offerors so that the offerors can provide THOR-50M dummy and parts pricing per the updated design as part our proposal?

NHTSA Response:

There is no information regarding the release of a subsequent THOR-50M design package at this time. As such, NHTSA has no intention to purchase Anthropomorphic Test Devices (ATD’s) / Dummies under the referenced prospective design until such a time as said design package is released. If parts/devices similar to those described in the prospective design package are required by NHTSA, said parts will be purchased as prototype equipment; and the specifications for said prototype parts will be released at the time of solicitation for such parts.

3. Question - Will NHTSA allow Offerors to include in their cost proposal the parts and the ATDs that have patents or patents pending?

NHTSA Response:

Items for which Offerors hold current, or pending, patents may be included in cost proposals.

4. Question – Can Offerors include company and/or item terms and conditions for proposed models within the cost proposal?

NHTSA Response:

Any procurements for devices, parts, and other goods will be subject to government terms and conditions, as described in any resultant, subsequent contracts. Additional terms and conditions must be proposed for NHTSA’s consideration prior to award. As such, Offeror/item specific procurement terms and conditions may be proposed as part of an Offeror’s proposal and will be subject to review prior to incorporation into any resultant contract.

5. Question - If company terms and conditions are not allowed in the Cost Proposal, can NHTSA specify the best approach to include proposed models?

NHTSA Response:

See response to question 4. Offeror/Item specific terms and conditions may be proposed for NHTSA’s consideration. Please note that overly strict terms and conditions may present an obstacle

RFP: 693JJ919R000006

Title: ATD Management Laboratory Parts, Supplies and Services such that the government may not consider award in its best interest. However, proposal of Offeror/item specific terms and conditions do not inherently preclude an offeror from receiving an award.

6. Question - Can Offerors submit proposals using another NAICS code other than NAICS code 339999 “All Other Miscellaneous Manufacturing” as specified in the solicitation?

Offeror NAICS codes, as presented in an Offeror’s proposal, must match that recorded in SAM.gov.

Any proposed changes to the Offeror’s NAICS code designation or applicable size standard should be proposed, along with a selection rationale, for NHTSA’s consideration.

7. Question - Is there a concern with Offerors changing the NAICS Code to 339999?

See response to question 6. Also, the NAICS code noted in question 7 is the actual NAICS code designated in the solicitation. Therefore, a change in NAICS is not applicable.

8. Question – Reference Section 5, Labor Categories and Descriptions. Please confirm that

Offerors can add to the Labor Categories and Descriptions.

NHTSA Response:

The Labor Categories and Descriptions are illustrative per the text in Section I – Supplies or Services and Prices/Costs, Subsection 5, Labor Categories and Descriptions:

“The types of labor categories that the Contractor may need to provide upon receipt of Delivery and Task Orders are [provided in the solicitation under Section I, Subsection 5]. This list is not all-inclusive; rather, it represents a pool of expertise the Contractor may need to draw from in fulfilling this contract’s requirements. Subject to prior written approval of the Contracting Officer, the Contractor may revise the list and/or labor category descriptions provided.”

The Government is aware that not all Offerors may have the capacity to provide the full spectrum of Labor Categories and Descriptions indicated. As such, Offerors who contain only a portion of the described Labor Categories are still encouraged to submit a proposal. Similarly, Offerors who are able to supply Labor Categories in excess of those provided in the solicitation are encouraged to propose information regarding an expanded list.
