1. RFQ INFORMATION AND INSTRUCTIONS FOR PREPARATION OF QUOTATIONS

FAR 52.212-1 Instructions to Quoters—Commercial Products and Commercial Services (SEP 2023)

[DEVIATION APR 2026]

1.1 GENERAL INFORMATION

This is a combined synopsis/solicitation for commercial products or commercial services prepared in accordance with Revolutionary FAR Overhaul (RFO) FAR Subpart 12.2. Quotations are being requested and a separate written solicitation will not be issued.

This is an unrestricted, firm-fixed price (FFP) RFQ. This solicitation is prepared in accordance with Revolutionary FAR Overhaul (RFO) Federal Acquisition Regulation (FAR) Part 12-Acquisition of Commercial Products and Commercial Services, specifically subsection 12.201 Solicitation Procedures. The Government has determined that this requirement is a commercial service and that an award resulting from this solicitation will use Commercial Procedures. RFO FAR 2.101 defines a commercial service. The use of “commercial products or services” or the term “commerciality” under RFO FAR is attributable to the products and/or services and not to the company, firm, entity, or institution providing or offering its products or services to the Government. The successful awardee/quoter will be required to accept all applicable terms and conditions pursuant to applicable RFO FAR Parts, Transportation Acquisition Regulations (TAR) and applicable Federal Highway Administration (FHWA)/Agency regulations.

The North American Industry Classification System (NAICS) code is 541990 with an industry size standard of $19.5 Million. It is the quoter’s responsibility to be familiar with applicable clauses and provisions. RFO FAR provisions and clauses may be viewed and/or downloaded from https://www.acquisition.gov/far-overhaul

All quoters are required to have a current active registration in the System for Award Management (www.SAM.gov) at the time of Technical Submission Phase 1 and Phase 2 to be eligible to receive an award under this RFQ. A responsible quoter is one whose technical submissions and price quotation conform to the RFQ and the Government’s requirements which are detailed in the Statement of Work (SOW).

Failure to furnish all information required in this RFQ may result in the quote/submission being considered non-responsive and being removed from further consideration.

This is an electronic procurement. Paper solicitations will not be sent. Hard copies of quotes/submissions will not be accepted.

1.2 DRAFT RFQ COMMUNICATIONS AND QUESTIONS

The due date for questions concerning this DRAFT RFQ is 12:00 Noon Eastern Time (ET) Friday , November 6 2026. Quoters are limited to three (3) questions each, no exceptions. Each question must be separately numbered, framed/stated as a question, and include a question mark at the end. Multiple questions within a single numbered question will not be accepted or answered, no exceptions. All questions must be emailed to BOTH myla.wyatt@dot.gov and carolyn.lethert@dot.gov. It is highly recommended that quoters carefully and thoroughly read both the RFQ instructions and Statement of Work (SOW) because not all questions will be answered. Any question(s) received after the time and due date will generally not be answered.

Please reference the RFQ number and title: RFQ- The National Performance Management Research Data Set (NPMRDS) and Technical and Data-Sharing Support on all correspondence including the https://www.acquisition.gov/far-overhaul https://www.acquisition.gov/far-overhaul http://www.sam.gov/ subject line of any e-mails related to this RFQ.

Format for Questions: Each prospective quoter e-mailing questions should attempt to state each question in such a way that the quoter would have no objection to the Government publishing that precise question (and its answer) in a formal Amendment to the RFQ. Each prospective quoter shall not word or formulate questions in such a way that the publication of the question (and its answer) would divulge any information that the prospective quoter considers to be proprietary or confidential.

Late Submissions, modifications, revisions, and withdrawals of technical submissions and price quotations

(1) Quoters are responsible for submitting technical submissions and price quotations and any modifications or revisions to the Contracting Officer(s) via email by the time(s) and due date(s) specified in the RFQ.

(2) Any technical submission and price quotation, modification, or revision received after the time(s) and due date(s) specified for receipt of quotations is “late” and will not be considered unless it is received before award is made and the Contracting Officer determines that accepting the late offer would not unduly delay the acquisition. However, a late modification of an otherwise successful quoter that makes its terms more favorable to the Government MAY be considered at any time it is received and may be accepted.

(3) If an emergency or unanticipated event interrupts normal Government processes so that technical submissions and price quotations cannot be received by the Contracting Officer by the exact time(s) and due date(s) specified in the RFQ, and urgent Government requirements preclude amendment of the RFQ or other notice of an extension of the closing date, the time(s) and due date(s) specified for receipt of technical submissions and price quotations will be deemed to be extended to the same time specified in the solicitation on the first work day on which normal Government processes resume.

(4) Quoters may withdraw their technical submissions and price quotations by written notice to the Contracting Officer at any time before award.

ATTENTION QUOTERS: Quoters shall direct ALL communications to the attention of the Contracting Officer and/or alternate point of contact listed above (myla.wyatt@dot.gov and Cc..

carolyn.lethert@dot.gov) Please do not include any other @dot.gov email addresses or other government email addresses on the To, Cc, or Bcc lines when emailing inquires, questions, technical submissions, and price quotations.

Communications with other Government officials may compromise the competitiveness of this acquisition, and result in the disqualification of the quoter and/or cancellation of the RFQ.

The Government intends to conduct this acquisition through a two-phased technical submission with an advisory down-select. A notional schedule for the requirement is below:

Event Time and Due Date Technical Submission-Phase 1 Technical Experience (Phase 1- advisory down select)

Quoters are strongly encouraged to submit their best technical solutions and price in response to this RFQ. Once the Government determines the quoter that is the best-suited (i.e., the apparent successful quoter), the Government reserves the right to communicate with only that quoter to address any remaining issues, if necessary, and finalize the contract with that quoter. These issues may include technical and price. If the parties cannot successfully address any remaining issues, as determined pertinent at the sole discretion of the Government, the Government reserves the right to communicate with the next best-suited quoter based on the original analysis and address any remaining issues. Once the Government has begun communications with the next best-suited quoter, no further communications with the previous quoter will be entertained until after the task order has been awarded. This process shall continue until an agreement is successfully reached and a contract is awarded.

Based upon the results of the holistic assessment of each quoter’s technical submissions (Phase 1 and 2), past performance, small business subcontracting plan, and price the Government may make an award to other than the lowest-priced quoter or the quoter with the highest technical rating if the source selection official determines that to do so would result in the best value to the Government.

PAST PERFORMANCE

Past performance information is evaluated as a predictor of future contract performance. Using past performance information for each quoter, the Government will assess the probability that the instant requirement will be successfully completed in accordance with contract terms.

In evaluating past performance, the Government will consider information provided by the contractor in its submission, as well as any other information available to the Government. The Government, at its sole discretion, may seek additional past performance information from other sources such as the Contractor Performance Assessment Reporting System (CPARS). The past performance evaluation may include but is not limited to:

1. Timeliness – Delivery or Performance,

2. Quality of products or services provided

3. Cost control (if applicable)

4. Relevance and recency of the prior work to the requirements in the RFQ/solicitation including scope, size, and currency.

5. Overall Management of the project;

6. Compliance with subcontracting plans/goals; and

7. General trends in past performance.

The Government will consider past performance information submitted by the quoter on its predecessor companies, key personnel who have relevant experience, or its performance as a subcontractor performing major or critical aspects of the requirement. The Government reserves the right to assess the past performance of proposed subcontractors. The Government will use its discretion to determine the sources of past performance information used in the evaluation, and the information may be obtained from references provided by the quoters, the Agency’s knowledge of contractor performance, other government agencies or commercial entities, or past performance databases. In the case of an offeror without a record of relevant past performance or for whom information on past performance is not available, the Quoter will not be evaluated favorably or unfavorably.

SMALL BUSINESS SUBCONTRACTING PLAN

The Small Business Subcontracting Plan (if applicable) will be evaluated on a “Pass/Fail” basis considering the Government’s socio-economic goals as stated in Attachment 7 and in compliance with the requirements of

FAR 52.219-9.

PRICE EVALUATION

The price element of the price quotation will not be given a confidence rating The Government will evaluate the quoter’s total quoted price to determine if prices is fair and reasonable. The Government will evaluate total price inclusive of all options. The "total evaluated price" will be evaluated for price reasonableness through comparison with other quoted prices and may include other price analysis techniques. The price evaluation will determine whether the proposed prices are complete and reasonable in relation to the RFQ and SOW requirements.

The quoter’s prices must be entirely compatible with the quoter’s technical submissions and consistent with the pricing requirements listed in this RFQ. Price quotation(s) that do not align to the quoter's technical submissions may indicate an inability to understand the requirements and therefore may be considered a high-risk approach to contract performance.

This RFQ and resulting contract (if awarded) includes optional task(s). Prices will be evaluated and included in total contract value but may not be funded at time of task order award. If exercised, optional tasks are subject to availability of funds. Please identify/label optional tasks in price quote as detailed in Schedule of Services.

National Performance Management Research Data Set (NPMRDS) Support

Statement of Work (SOW)

BACKGROUND

The FHWA, an agency within the U.S. Department of Transportation (USDOT) is charged with the broad responsibility of ensuring that America’s roads and highways continue to be the safest and most technologically up to date. With continued growth in both traffic and freight volumes, significant portions of the transportation system experience congested conditions on a regular basis, leading to unreliable service to the American people. FHWA has engaged in broad activities in partnership with State and local transportation agencies to improve travel reliability and mitigate congestion. From a traffic flow standpoint, these activities include but are not limited to:

• Real-time and forecasted information;

• Measuring/monitoring passenger and freight system performance;

• Analytical foundation/tools/data;

• State of the art technologies and strategies, including operational tests of intelligent transportation system technologies;

• Development of standards for information exchange;

• Guidance and funding for infrastructure and Intelligent Transportation System (ITS) Projects;

• Integration across system elements, jurisdictions, and modes; and

• Assistance for transportation and planning professionals in developing the knowledge and skills needed to do their jobs effectively.

Together, these activities build the solution set required to proactively operate the transportation system. Proactively operating the transportation system begins with awareness that routine operation is not addressing significant congestion or regular operational problems. Proactive management can only happen where there is good available information about what is currently happening, how the operation of the system is being impacted, and what actions are necessary to make the system operate better.

This is only possible with a good analytical foundation, and a plan for how the transportation system should be operated. This foundation should include the use of appropriate performance metrics, establishing targets for system performance, and the use of appropriate analysis tools to identify, develop, and evaluate solutions to operational problems, and an investment plan exhibiting a capable workforce necessary to implement the chosen solutions.

To date, the FHWA has evaluated measures of travel time, travel time variability, reliability, speeds, and related metrics through efforts such as the data and value-added products derived from the Urban Congestion Report (UCR), Freight Mobility Trends (FMT) program, and the National Performance Management Research Data Set (NPMRDS). The FHWA has supported transportation agencies and their needs to plan for and better manage the transportation network throughout the United States and continues to do so in response to the performance measure and management requirements of Moving Ahead for Progress 21 (MAP-21), the Fixing America’s Surface Transportation (FAST) Act, and the current Infrastructure Investment and Jobs Act (IIJA).

Through this contract, named as ”Acquiring the NPMRDS Data, Obtaining Technical Support, and Conducting Data Analysis”, FHWA Office of Highway Policy Information (HPPI) seeks to continue to provide the NPMRDS…
