About this file

This document is a Questions and Answers (Q&A) file for a federal contract opportunity (Solicitation Number 693JJ326R000003) issued by the Federal Highway Administration (FHWA). The document contains six key questions and corresponding government responses addressing critical aspects of the solicitation, including:

  1. Proposal submission deadline (no extension granted) 2. Organizational Conflict of Interest terms (prohibiting contractors from competing on "related work" for three years after contract end, defined as work assisting in developing future procurement requirements) 3. ISO 17025 certification requirements for the FOIL (Facility of Optical Instrumentation Laboratory), with accreditation assessed yearly 4. Equipment considerations, specifically noting that a FARO scanner is not government-furnished and offerors can propose their own modeling technologies and cover associated equipment costs through other direct costs.

# Reference Question Response

L.10 IMPORTANT DELIVERY

INFORMATION:

Due to the RFP being released prior to a major holiday and with consideration for question submissions to impact proposal development, will the proposal submission deadline be extended?

Because a draft of the solicitation was provided prior to the issuance of the solicitation and very few changes were made to the final version of the solicitation, an extension will not be granted.

H.6 ORGANZATIONAL CONFLICT

OF INTEREST AND LIMITATION ON

FUTURE CONTRACTING: “Therefore, the contractor is expressly prohibited from competing on related work during the performance of the contract and for a period of three years from the end date of this contract as a prime contractor, subcontractor or consultant.” Is there a definition for “related work”?

Related work includes any work in which the contractor assists in developing requirements for future procurements.

H.6 ORGANZATIONAL CONFLICT

OF INTEREST AND LIMITATION ON

FUTURE CONTRACTING: “Therefore, the contractor is expressly prohibited from competing on related work during the performance of the contract and for a period of three years from the end date of this contract as a prime contractor, subcontractor or consultant.”

This requirement might severely limit the sources necessary for project execution. Would you consider striking this line?

This language will remain in the solicitation and future contract. However, FHWA believes it is not likely that the contractor will work on efforts that will impact future procurements that they will be required to recuse themselves from.

ATTACHMENT J.2 - TASK 1 –

OPERATE AND MAINTAIN THE

FOIL: “The Contractor must maintain the International Organization for Standardization (ISO) 17025 certification of the FOIL.” Who holds this accreditation?

Accreditation is under the FOIL with key personnel, both federal and contractor, mentioned in the accreditation.

ATTACHMENT J.2 - TASK 1 –

OPERATE AND MAINTAIN THE

FOIL: “The Contractor must maintain the International Organization for Standardization (ISO) 17025 certification of the FOIL.”

What is the time period allotted for achieving accreditation?

Accreditation assessments are conducted on a yearly basis, with the current cycle based on a mid-summer timeframe. New personnel will have to show competence to the accreditation board during the assessment.

ATTACHMENT J.3 - LIST OF

GOVERNMENT-FURNISHED

PROPERTY

There is no FARO scanner listed in the asset list.

Will the contractor be expected to budget the purchase of this equipment or price out the rental of this equipment from the contractor?

The FARO scanner is not owned by FHWA, and therefore is not on the list.

The use of the FARO scanner is not required, as Offerors can propose to create models using whichever technology or technique they propose. If an Offeror would like to purchase or rent the FARO scanner, the costs associated with that would be covered under other direct costs.
