About this file

This document is a Questions and Answers (Q&A) file for RFP 693JJ325R000015, related to the Mobile Concrete Technology Center (MCTC) Program. The Q&A addresses three key clarification requests from potential offerors: (1) labor hour quantities for each labor category across option periods, (2) a potential conflict regarding Subject Matter Expert (SME) reimbursement rates, and (3) conflicting statements about the small business set-aside status.

The government's responses are consistently terse, directing respondents to review the updated RFP for resolution. For the first question, the government emphasizes that it is the offeror's responsibility to propose appropriate labor hours to fulfill statement of work requirements. The SME rate question involves complex pricing considerations, with the potential for SME costs to be treated similarly to Other Direct Costs (ODCs) and Travel. The small business classification query highlights an apparent discrepancy between the solicitation's competitive small business set-aside designation and a potential 8(a) program participant award expectation.

Number Question Government Response

Please provide labor hour quantities for each labor category for each Option Period in J.2 Schedule of Rates so that we can determine the FFP amounts to go in RFP Section B.2 Contract Pricing .

It is the responsinility of the offeror to propose the appropriate number of hours it believes are necessary to fulfill the requirements as described in the statement of of work.

Please clarify and resolve the apparent conflict between the requirement for us to provide hourly rates for Subject

Matter Experts in J.2 Schedule of Rates and the statement in the second paragraph of RFP Section C.4 that “… subject matter expert use shall be reimbursed at cost.”

a. Because “at cost” for SMEs implies that we will bill FHWA at the rate that we are invoiced by each SME, it appears that SME cost should be treated in the same way as ODCs and Travel. This approach is strengthened by the SME CLINs in RFP Section B.2 Contract Pricing being Not To Exceed. If this is correct, we request that the Government remove SME labor rates from J.2 Schedule of Rates and provide the Not To Exceed amounts for the SME CLINs.

b. If this interpretation is incorrect, then we request that the Government remove the requirement in Section C.4 that

SMEs be reimbursed at cost

See RFP for update.

SF 33 Block 9 states that “this procurement is issued as a competitive small business set-aside.” However, RFP Section B.2 states the Government anticipates award to a Small Business Act Section 8(a) program participant.

Is this solicitation 8(a) or just small business?
