L.12 AWARD

Until a formal notice of award is issued, no communication by the Government either written or oral shall be interpreted as a promise that an award will be made.

The Contracting Officer is the only individual who can legally commit or obligate the Government to expend public funds. No cost chargeable to the proposed Contract can be incurred before receipt of a fully executed Contract or specific written authorization from the Contracting Officer.

As stated in provision 52.215-1, the Government expects to award after review of the initial proposals without discussions. Therefore, your initial offer should contain your best terms from a price and technical standpoint.

Based upon the results of the integrated assessment of the technical, past performance and Cost/Price proposals, the Government may make an award to other than the lowest-priced Offeror or the Offeror with the highest technical rating if the source selection official determines that to do so would result in the best value to the Government.

Offeror’s proposals will be reviewed for page limitations. Pages exceeding the page limitation will be eliminated from evaluation. Technical proposals will be rated High Confidence, Some Confidence, and Low Confidence while Past Performance will be rated Acceptable, Unacceptable, or Neutral.

A proposal receiving a Technical rating of “Low Confidence” or a Past Performance rating of “Unacceptable” will be removed from further consideration for award or continued evaluation and the Offeror will be notified accordingly. However, depending on the number of proposals and the quality of proposals, the Government reserves the right to not remove a proposal from the competition if deemed in the Government’s best interest.

a) TECHNICAL CAPABILITY:

Technical capability proposals will be evaluated and assessed based on the following sub-factors of equal importance:

The proposal demonstrates the Offeror has the necessary background, qualifications, and resources to successfully perform the work;

The proposal demonstrates the Offeror has the necessary understanding of the objectives of this ID/IQ and potential needs for the Government over the term of the award;

The proposal demonstrates a sound and adequate management, staffing, and technical approach to perform the work described in the Performance Work Statement (Section C of the RFP) for the ID/IQ;

Proposal demonstrates an adequate contingency plan to replace key personnel and key personnel have the necessary education, background, recent work experience, and accomplishments to successfully perform the work. The contingency plan must demonstrate that the Offeror has the ability to replace key personnel without any adverse impact on performance;

The proposal demonstrates a sound and adequate quality plan and approach to ensure the quality of deliverables and compliance with Section 508 standards;

The Task Order 0001 Proposal demonstrates a clear understanding of the requirements.

The Task Order 0001 Proposal demonstrates a sound and adequate technical and management approach to successfully perform the PWS requirements; and The Task Order 0001 Proposal demonstrates a realistic staffing mix and level of effort for the work to be performed.

b) PAST PERFORMANCE EVALUATION

The Offeror’s past performance on related contracts will be evaluated to determine, as appropriate, the Performance Risk associated with their Offer as it relates to the requirement for this solicitation. Evaluation may consider past performance information regarding predecessor companies or subcontractors that will perform major or critical aspects of the requirement.

The Government reserves the right to assess the past performance of proposed subcontractors.

The Government will evaluate the relevant merits of the Offeror's past performance on the basis of its reputation and record with its current and former customers. The Government will review the following areas regarding past performance:

a. Quality of products and/or services provided;

b. Timeliness – Schedule of delivery and/or performance;

c. Cost control;

d. Relevance of the prior work to the requirements of the solicitation including scope, size and recency;

e. Overall management; and

f. Regulatory compliance

The Government will use its discretion to determine if the past performance information is relevant. Past Performance information will be determined to be relevant if the performance involves work performed within the past five years (with recent work within the past three years being more relevant) that is the same or similar in size, scope, and complexity to the services being procured under this solicitation.

If an Offeror does not have a history of relevant contract experience, or if past performance information is not available, the Offeror will receive a neutral past performance rating.

The Government will use its discretion to determine the sources of past performance information used in the evaluation. The information may be obtained from references provided by the Offeror, the agency’s knowledge of Contractor performance, other government agencies or commercial entities, and/or past performance databases such as the Contractor Performance Assessment Reporting System (CPARS).

c) COST/PRICE EVALUATION

The Government will perform a Cost and Price analysis. The Government will evaluate the Offeror’s proposed prices and estimated costs to determine whether these reflect a clear understanding of the requirements and are consistent with the unique methods of performance and materials described in the Offeror’s technical proposal. Cost/Price analysis will be the methodology utilized for the evaluation of the ID/IQ rates. The Cost/Price for the effort associated with FAR 52.217-8 Option to Extend Services will not be included in the total awarded value. If, at the end of the period of performance and within the time period established in the clause, the Government chooses to exercise this option, the pricing will be pursuant to the rates specified in the contract.

Cost realism analysis shall be performed to determine the probable cost of performance for each offeror. Cost realism determines how well the proposed costs represent what the cost of the contract should be for the technical and management approach proposed, assuming reasonable economy and efficiency. The Government will evaluate the offeror’s proposed staffing plan against its proposed technical capabilities to determine that the associated costs are realistic for the requirement. Any proposal lacking these attributes, regardless of its relative position with other proposals, will be considered lacking realism and may result in a higher evaluated cost. In performing the cost analysis, the Government may use:

1. Supporting data provided with each offer;

2. Past procurement history; and

3. DCAA/DCMA audit findings for direct and indirect rates.

A Government-calculated IGCE may be utilized in the realism evaluation and considered in the contract best-value determination. The IGCE will not be disclosed to the public.

Realism will be determined by the extent to which proposed costs indicate a clear understanding of solicitation requirements, and the proposal reflects a sound approach to satisfying those requirements and is consistent with the approach described in the Offeror’s technical capability proposal.

If available, DCAA/DCMA audits may be the basis for determining cost element (indirect rates) validity. Cost elements recommended by DCAA/DCMA will be considered realistic for this requirement. If DCAA/DCMA audits are not available, then FHWA will use the last 5 years of indirect rates as approved by an external auditor to determine reasonable rates for analysis purposes. The analysis of the offeror’s proposal against audited rates, or the submitted historical rate information, will support a realism analysis.

The Government will perform a Cost Realism and Price Analysis. The Government will evaluate the Offeror’s proposed prices and estimated costs to determine whether the proposed prices are complete, fair, realistic, and reasonable in relation to the solicitation requirements and market rates. Proposed prices must be entirely compatible with the technical proposal and consistent with the pricing requirements listed in this solicitation.

The price for the effort associated with FAR 52.217-8 Option to Extend Services will not be included in the total evaluated price. If, at the end of the ordering period and within the time period established in the clause, the Government chooses to exercise this option, the pricing will be pursuant to the rates specified in the contract.

Price Analysis for FFP Rates:

Adequate price competition will be a consideration in determining the rates are reasonable. The price analysis will consist of a comparison of the fully loaded rates received in response to the solicitation and the Government’s total evaluated price. The Government will calculate the total evaluated price by multiplying the proposed fully burdened fixed-prices/hourly rates for each labor category by the Government’s estimated number of labor hours for that labor category over the five-year ordering period. The Independent Government Cost Estimate (IGCE) will not be disclosed to the public. The Government will verify the escalation rates for the hourly rates to determine the change from year to year for each propose rate is reasonable.

Cost Realism Analysis for CPFF ID/IQ Rates:

Cost Realism analysis will be the methodology utilized for the evaluation of the ID/IQ CPFF rates.

Supporting data provided with each offer.

Past procurement history.

DCAA/DCMA audit findings for direct and indirect rates.

A Government-calculated IGCE may be utilized in the realism evaluation and considered in the contract best-value determination. If DCAA/DCMA audits are not available, then FHWA may use the last 5 years of indirect rates and the support for direct labor including escalation to determine reasonable rates for analysis purposes. The analysis of the offeror’s proposal against audited rates, or the submitted historical rate information, will support a realism analysis.

NOTE TO OFFERORS: The Government intends to award a single task order immediately upon award of the ID/IQ, Task Order 0001. The price proposal for Task Order 0001 will not be factored into the base ID/IQ price evaluation and source selection process. The price proposal for Task Order 0001 will be evaluated as a separate and distinct evaluation. The price proposal for Task Order 0001 will be evaluated to determine whether the proposed prices are complete, fair, realistic, and reasonable in relation to the task order requirements. Proposed prices, to include the proposed hourly rates and the level of effort, must be entirely compatible with the technical proposal and consistent with the pricing requirements listed in the ID/IQ Labor Rate Schedule. In accordance with Section M.1 of the RFP, the Government may enter into negotiations with the presumptive awardee of the Task Order regarding their Task Order 0001 price
