About this file
This document is a Solicitation Questions and Answers (Q&A) file for MARAD's Protection & Indemnity (P&I) Policy Services solicitation (693JF726R000003). The Q&A provides critical details about a marine insurance brokerage contract, including key clarifications about policy coverage, proposal submission requirements, and policy specifics. Notable highlights include a $1 billion per-vessel/occurrence coverage limit, confirmation that key personnel can be multiple team members, and specifications that the technical proposal has a 30-page limit including team biographies.
The solicitation seeks a state-licensed marine insurance broker to place and manage P&I coverage for MARAD's vessel fleet, with specific tasks including market canvassing for best value, advising on coverage risks, annual fleet coverage placement, and claims processing support. MARAD is currently considering a potential one-month extension of their existing P&I coverage with the American P&I Club from February 19, 2026 to March 19, 2026, which may impact the first year's contract scope. The Q&A document also clarifies nuanced details about cadet classifications, claims handling authority, and policy structure.

| QUESTIONS AND ANSWERS Issued on January 14, 2026 for Solicitation 693JF726R000003 for Protection & Indemnity Policy | ||||
| Question # | Document Reference | Section Reference | Discussion/Question | Answer |
| 1 | Please provide a copy of a current loss ration report from American Club. | MARAD has had no loss claims with American Club. American Club Loss Ration is available to the public on their website at: 2024 American Club Annual Report | ||
| 2 | Please provide a currently valued listing of claims since 2/20/2019 or since entered with the American Club (both open and closed) | MARAD has filed $0 in claims since MARAD entered with American Club in 2020 | ||
| 3 | Pg. 24 | SPECIAL MARAD P&I CLAUSE | Please provide details on the current deductible structure | The deductible structure is detailed in the attached Certificate of Entry (COE) |
| 4 | Pg. 24 | SPECIAL MARAD P&I CLAUSE | Please provide a Sample Certificate of Entry | See current Certificate of Entry COE (attached) |
Note: in order to mitigate risk of coverage lapse on 20 Feb 26, MARAD is considering extension of the current P&I coverage afforded by the American P&I Club from February 19, 2026 to March 19, 2026 (at minimum). In that case, the current broker would generate a new Certificate of Entry before 19 Feb 26, but it is NOT an extension of that brokerage contract. This extension may reduce this contract scope for the first year, in that the SOW Tasks under Subparagraphs 1.3.1 through 1.3.5, and 1.3.11 will have been accomplished for the next year’s coverage, by the incumbent, prior to award of the follow-on contract. Of course, MARAD may still elect to provide the brokerage fee to the potential awardee so that the broker would be funded to manage the policy (SOW subparagraphs 1.3.6 through 1.3.10).
| 5 | If a copy of the Sample COE is not avaliable, please: a. Confirm if the entry is Mutual or Fixed; b. Confirm is any P&I coverage extensions are required and if so the details of those extensions. | The COE is attached. | ||
| 6 | Pg. 29 | 5.7 Format and Instructions for Proposal Submission | Should the team biographies in the appendix of our proposal count towards the 30-page limit? | Yes, the key personnel and the like are inclusive of the 30 page limit for the technical proposal |
| 7 | Pg. 10 | 1.9 KEY PERSONNEL | Can you please clarify if the key personnel is one person or can be multiple team members? | Key personnel can be multiple team members who have a significant level of effort towards the overall project. |
| 8 | Limit Structure: The RFP references a minimum of $1 billion per vessel. Can MARAD confirm whether this limit is intended to apply on a per-vessel, per-occurrence basis and whether any fleet-wide aggregate limit is contemplated or prohibited under the policy structure? | The current Certificate of Entry (COE) posted on SAM.Gov limits Association's liability for all claims to US $1,000,000,000 any one accident or occurrence. Additional stipulations for Protection & Indemnity War Risks are included in the COE. No fleet-wide aggregate limit is contemplated or prohibited. | ||
| 9 | Pg. 8 | Accumulation Risk: In the event of a single occurrence involving more than one scheduled vessel (e.g., same port or incident), is MARAD’s intent that the $1B limit apply independently to each vessel involved? | Coverage is $1B in any one accident or occurrence regardless of number of vessels involved. See COE. | |
| 10 | Cadet Exposure: For underwriting purposes, can MARAD clarify how cadets aboard the training vessels are classified (e.g., trainees, seamen, passengers), and whether there are any specific indemnity expectations related to cadet injury or illness? | The COE does not stipulate between cadets and other individuals covered. Cadets are classified as “cadets” in MARAD Memorandums of Agreement, the Custodial Care Guide, and US Coast Guard Certificates of Inspection (COI). They are designated as “cadets” in the Safety Management Manual, which defines cadet as “A student enrolled at a State Maritime Academy and participating in the Regiment of Cadets or student enrolled at USMMA”. Cadets are not crew or passengers. There are no specific indemnity expectations related to cadet injury or illness. | ||
| 11 | Trading & Navigation: Are there any geographic trading limitations, excluded regions, or routine international trading patterns MARAD expects proposers to assume for these vessels? | The current COE provides the relevant limitations and territory restriction clauses. | ||
| 12 | Pg. 8 | Claims Handling: Can MARAD clarify expectations regarding claims handling authority, including whether insurers retain primary adjusting authority with broker coordination, and whether any settlement authority thresholds or government approvals apply? | Insurers retain the authority to settle claims, however Department of Justice has the final say on litigation positions and legal defense strategies. | |
| 13 | No Recourse Requirement: To confirm, is MARAD’s intent that the P&I program prohibit any form of supplementary call, assessment, or recourse to assureds, including modified P&I club structures unless fully compliant with this requirement? | Yes, this is expected to be a fixed premium coverage. |
