SECTION C

DESCRIPTION/SPECIFICATION/STATEMENT OF WORK (SOW)

C.1. The Department of Health Services (DHS) located in Patten Hall at the United States Merchant Marine Academy (USMMA) seeks an option allowing midshipmen to obtain behavioral health counseling from a licensed professional care provider using an already existing and developed downloadable app. USMMA has Midshipmen assigned throughout the United States as well as international/globally. International/global assignments include being on board oceangoing vessels for long periods of time. Access to the downloadable App is required for approximately 1000 Midshipmen. Support would be required for 24/7/365 days, globally and within the United States.

C.2 OVERVIEW

United States Merchant Marine Academy is a Federal Service Academy that educates and graduates licensed Merchant Marine officers of exemplary character who serve America’s marine transportation and defense needs in peace and war. With 95 percent of the world's products transported over water, these leaders are vital to the effective operation of our merchant fleet for both commercial and military transport during war and peace.

USMMA Department of Health Services (DHS) is responsible for the overall management of the Midshipmen medical care, dental care, and Midshipmen emergency services. DHS works to help midshipmen maintain all medical standards for United States Coast Guard (USCG) Licensing and United States Naval Commissioning requirements. Further information is available at:

h. Group chat feature to allow Midshipmen to connect with fellow Midshipmen or non-Midshipmen experiencing mental health issues. The intention is to provide group peer support access without feeling the need to formalize a conversation with a provider.

i. This should be designed to encourage use without fear or judgement issues that often prevent reaching out for care (stigmas)

i. Include, if possible, a telephone access option for those who wish to not use an App.

j. Provide confidential management of protected health information to ensure Midshipmen feel http://www.usmma.edu/academy-life/activitiesservices/health-services#sthash.kLTKsCpA.dpuf https://www.usmma.edu/academy-life/activitiesservices/counseling comfortable discussing sensitive mental health issues.

4. Counselor’s education, experience, and skill requirement:

a. DOT/MARAD requires that providers be licensed and credentialed as either Clinical Psychologists

(having earned a doctorate degree in clinical psychology or Doctor of Psychology), with a minimum of 3 years’ clinical experience or higher.

b. Mental Health Counselor, Social Worker or Clinical Social Worker (having earned a Master’s Degree in the appropriate aforementioned fields of study). All providers must be clinically experienced within a medical scope of practice that includes patients up to the age of 24. Providers with a minimum of 3 years’ experience are preferred.

C.5. Deliverables:

a. The contractor shall be responsible for providing monthly report to the Contracting Officer’s

Representative (COR) and the Contracting Officer (CO) clearly identifying:

i. Number of midshipmen accessed the app monthly.

ii. Types of clinical issues midshipmen sought care for.

iii. Clearly identify if the care was ongoing or resolved.

iv. Identify the number of needed referrals to a higher level of care, (if any).

v. Number of midshipmen referred to USMMA health services.

vi. Number of midshipmen identified as emergency care and actions taken to secure safety.

C.6.1. Performance standards:

a. This Quality Assurance Surveillance Plan (QASP) is designed to provide the Maritime Administration (MARAD) and The United States Merchant Marine Academy (USMMA) with an effective surveillance method of monitoring and evaluating the contractor’s performance pursuant to the requirements listed in the Statement of Work (SOW) for behavioral health counseling from a licensed professional care provider using an already existing and developed downloadable app. From Federal Acquisition Regulation (FAR) Part 37.601, performance-based contracting methods are intended to ensure that the required performance quality levels are achieved and that the total payment is related to the degree that services performed, or outcomes achieved meet contract standards. The QASP shall focus on the level of performance, rather than the methodology used by the contractor to achieve that level of performance. This QASP defines the roles and responsibilities of all members of the integrated project team, identifies the performance objectives, identifies the performance quality level standards, and describes the methods of surveillance to identify quality levels for monitoring and evaluating the Contractor’s performance. It is intended to be a dynamic and variable document based on the Contractor’s performance throughout the contract. Flexibility allows for the method to change and the level of surveillance to increase or decrease over time depending on the level of confidence in the Contractor’s performance. This QASP is based on the premise that the contractor, not the Government, is responsible for the management and quality control actions needed to meet the standards of the contract. The contractor is responsible for performing the requirements of the contract and for providing quality control measures to ensure that contract requirements are met.

b. Roles and Responsibilities - Contracting Officer

i. The Contracting Officer (CO) will have overall responsibility for overseeing the contractor’s performance. The CO shall be responsible for monitoring the Contractor’s performance in the areas of contract compliance and contract administration. The CO will review the COR or designee’s written inspections and assessments of the contractor’s performance and resolve any discrepancies that may arise between the contractor and COR or their designee.

c. Roles and Responsibilities - Contracting Officer’s Representative

i. The Contracting Officer’s Representative (COR) is responsible for monitoring, assessing, recording, and reporting on the performance of the contractor. The COR is responsible for technical administration of the project and ensures proper government surveillance of the contractor’s performance. The COR is not empowered to make any contractual commitments or to authorize any contractual changes on the Government’s behalf. Any changes that the contractor deems may affect contract price, terms, or conditions shall be referred to the CO for action. The COR will have the responsibility for completing quality assurance monitoring forms used to document the inspection and evaluation of the contractor’s work performance.

d. Methods of Surveillance

i. The method of surveillance is based on the performance criteria of the contract terms and specifications. Each requirement will describe the tasks to be performed and the acceptable quality level for successful performance. To minimize the performance management burden, simplified surveillance methods shall be used by the Government to evaluate contractor performance when appropriate, which may be on a daily, weekly, monthly, quarterly, semi-annual, or annual basis.

MARAD intends to monitor and evaluate the contractor’s performance based on any or all the following surveillance methods:

1. Validated User / Customer Feedback

a. Relies on the user of the service to identify deficiencies. Also combines elements of user complaints and random inspection to solicit user interviews. Feedback is investigated and validated to help focus on areas that may require further action.

Customer feedback may be obtained either from the results of formal customer satisfaction surveys or from random customer complaints.

2. Random Inspection

a. Evaluates by randomly selecting and inspecting outputs. There is no set percentage or minimum/maximum number of assessments conducted. The quantity of assessments will be based on findings and performance.

3. Unscheduled Inspection

a. Any aspect of the contractor’s performance may be inspected at any time during the period of performance of the contract. Variation of random inspection, however, inspection is taken when a pattern of performance deficiencies is suspected or when there are concerns that need attention.

4. Periodic Inspection

a. Surveillance tasks that do not require 100 percent inspection and performed at specific intervals of daily, weekly, monthly, quarterly, semi-annually, or annually that anticipates task perceived as user critical.

e. Performance Requirements Summary

i. To enhance clarity, an evaluation rating for acceptable quality levels is determined based on a standard for successful performance and will be defined as follows for the assessment of contractor performance:

1. Exceptional. Performance meets contractual requirements and exceeds many to the Government’s benefit. The contractual performance of the performance standard being assessed was accomplished with few minor problems for which corrective actions taken by the contractor were highly effective.

2. Very Good. Performance meets contractual requirements and exceeds some to the Government’s benefit. The contractual performance of the performance standard being assessed was accomplished with some minor problems for which corrective actions taken by the contractor were effective.

3. Satisfactory. Performance meets contractual requirements. The contractual performance of the performance standard contains some minor problems for which corrective actions taken by the contractor appear or were satisfactory.

4. Marginal. Performance does not meet some contractual requirements. The contractual performance of the performance standard being assessed reflects a serious problem for which the contractor has not yet identified corrective actions. The contractor’s proposed actions appear only marginally effective or were not fully implemented.

5. Unsatisfactory. Performance does not meet most contractual requirements and recovery is not likely in a timely manner. The contractual performance of the performance standard contains a serious problem(s) for which the contractor’s corrective actions appear or were ineffective.

A. Definition.

Payment request, as used in this subpart, means a bill, voucher, invoice, or request for contract financing payment with associated supporting documentation.

B. Electronic payment requests—invoices.

(a) Requirements. Contracts shall require the electronic submission of payment requests, except for—

(1) Purchases paid for with a Governmentwide commercial purchase card;

(2) Classified contracts or purchases when electronic submission and processing of http://www.login.gov/ payment requests could compromise classified information or national security; or

(3) As directed by the contracting officer to submit payment requests by mail.

(b) Alternate procedures. Where a contract requires the electronic submission of invoices, the contracting officer may authorize alternate procedures only if the contracting officer makes a written determination that the Department of the Transportation (DOT) is unable to receive electronic payment requests or provide acceptance electronically and it is approved one level above the contracting officer.

For contractors/vendors who are unable to utilize DOT’s Delphi eInvoicing web-portal, waivers may be considered on a case-by-case basis. Vendors should contact the Contracting Officer’s Representative for assistance and reach out to the Accounts Payable department for review and approval.

C. DOT electronic invoicing system. DOT utilizes the Delphi eInvoicing web portal to facilitate the electronic submission and approval of vendor invoices and certain grantee payment requests. Except as provided in paragraphs (a) and (b) of this section, contracting officers and DOT finance officials shall process electronic payment submissions through the Delphi eInvoicing web portal. If the requirement for electronic submission of payment requests is waived under paragraph (a) or paragraph (b) of this section, the contract or alternate payment authorization, as applicable, shall specify the form and method of payment request submission.

D. Electronic authentication.
