Responses to Bidder’s Questions

1. Is the contractor required to water until turf has been established in the 1.0 acre area indicated in the plans?

EFLHD Response: Per Subsection 625.09, it is the Contractor’s responsibility to protect and care for seeded areas, including watering as many times as needed until turf is established or final acceptance.

2. Section 635.13 addresses removal of temporary pavement markings via sandblasting or other methods that do not damage the surface of the pavement. The bid schedule requires the removal of existing markings, Line A0170. Is there a required method of removal of existing permanent markings or will it following the same requirements of Section 635.13 indicated?

EFLHD Response: For the removal of existing pavement markings, follow the requirements of Subsection 635.13. An amendment will be issued to clarify this requirement.

3. PDF Page 36 of 105 Sheet K01 has a requirement for 12” pipe culvert. What type of 12” Pipe is required? RCP, CMP, or PVC?

EFLHD Response: Use RCP for the 12” pipe. An amendment will be issued to clarify the pipe material.

4. Can excavated on-site material be used as “Unclassified borrow”?

EFLHD Response: If the on-site material meets the requirements of Subsection 704.06, then it can be used as unclassified borrow.

5. For roadway obliteration shown on Page 18 of 105 (Sheet D01), What depth of obliteration is required?

EFLHD Response: Refer to Subsection 211.02 for the requirements of obliteration.

6. Method 1 obliteration states that proposed contours after obliteration are to match existing contours. Can the required embankment material be obtained on-site or will import be required?

EFLHD Response: Yes, on-site soil material can be used as embankment for roadway obliteration.

7. Method 1 reads “Keep excavated material within the original construction limits”. Are we to stockpile material generated from obliterated roadway? If so, please identify stockpile location.

EFLHD Response: The asphalt material generated from the obliteration should be disposed of according to Subsection 211.02(a)(2). Non-asphalt material may be stockpiled within the construction limits at the discretion of the Contractor.

8. Does aggregate base need to meet TxDOT Specs/Requirements?

EFLHD Response: Per 703.05(b)(1), the gradation only of the aggregate base may conform to TxDOT Specs/Requirements. Other qualities will need to conform to SCR/FP-14 requirements.

9. Will revegetation of this area be required?

EFLHD Response: It is not clear which area or type of revegetation (i.e. turf establishment or other plantings) the question is referring to. However, there is no vegetation other than turf establishment. The limits of turf establishment are shown on the typical sections.

10. The specifications indicate several permits obtained by the government. What specific permits is the contractor required to obtain and pay for associated with this contract?

EFLHD Response: The Contractor is responsible for identifying and obtaining any permits that are required based on the proposed method of operation.

EFLHD Response: It is the responsibility of the Contractor to determine whether or not the project is tax exempt.

15. Where are General Conditions costs expected to be included in the Bid Schedule? For example the Quality Control Managers expense, Site Superintendent expense, etc. Should this all go on the Mobilization line item?

EFLHD Response: Per Subsection 109.05 (b), work for which direct payment is not provided is a subsidiary obligation of the Contractor. Payment for such work is indirectly included under other pay items listed in the bid schedule. It is the responsibility of the Contractor to decide where they want to put the cost for work that is not paid directly.

16. Who from the contractor side will be responsible for measurements for payment? Is this a Quality Control function?

EFLHD Response: It is the responsibility of the Contractor to decide who from the Contractor side will perform the measurements for payment. However, the Quality Control Manager is responsible for certifying the accuracy of the measurements.

17. Section 109.02.b Contract Quantity states that the quantity to be paid is the quantity listed in the bid schedule. Please confirm that any overage beyond the quantity in the bid schedule will be paid to the contractor since specific bid quantities have been provided for bidding purposes.

Payment will be made for the actual quantities of work performed and accepted or material furnished according to the contract.

18. Section 109.03 provides Weighting Procedures and Devices for determination of pay quantities. Are there any elements on this job that will require the contractor to follow 109.03.c requiring furnish, erection, and maintenance of automatic digital scales? 19. Section 109.03.c alludes to scales that are contractor provided. 109.03.b states that invoices are also acceptable but that periodic check weighting may be required. This would allude to having to have scales per 109.03.c. Please advise if the contractor is required to include scales in our proposal or if weighing is required the government will provide that service?

EFLHD Response: The Government will not provide weighing services. See response to Question 18.

20. If we are to include scales in our proposal where should that cost be included?

EFLHD Response: Per Subsection 109.05 (b), work for which direct payment is not provided is a subsidiary obligation of the Contractor. Payment for such work is indirectly included under other pay items listed in the bid schedule. It is the responsibility of the Contractor to decide where they want to put the cost for work that is not paid directly.

21. Section 153.02.b discusses inspectors. Is the contractor required to provide inspectors for this project in addition to the Quality Control Manager or is only a Quality Control Manager required and additional inspectors are optional?
