Baltimore-Washington Parkway Pavement Rehabilitation from The Little Patuxent River Bridge to Jessup Road (MD 175) Solicitation: 693C73-19-B-000018
The purpose of this Amendment is to:
1) Revise the Special Contract Requirements (J Pages) as follows:
a) Section 156 to clarify portable changeable message signs, and drains and inlets.
b) Section 203 to add measurement and payment for curb and gutter.
c) Section 418 to correct instruction reference and add measurement and payment for concrete curb and gutter.
d) Section 609 to add measurement and payment for curb and gutter.
2) Revised the Plans to modify the asphalt concrete pavement patching callouts and add reference note.
3) Provide a summary of responses to questions/clarifications asked by potential bidders.
The Bid Opening date remains April 24, 2019, at 2:00 p.m. EST.
Bidders are reminded to submit any questions to eflhd.contracts@dot.gov. All questions should be submitted as early as possible so the bid opening will not be delayed. Questions submitted within 3 days of the bid opening have the potential of not being answered with enough time for bidders to finalize their bids.

Special Contract Requirement (J Pages) changes
1. Delete the second paragraph of Subsection 156.04 of the Special Contract Requirements, page J-8, and substitute the following:
Provide a minimum of five portable changeable message signs (PCMs) and place where directed by the CO. Additional PCMs may be necessary to meet Maryland State Highway Administration (MdSHA) requirements.
2. Delete Subsection 156.04(f) of the Special Contract Requirements, page J-9, and substitute the following:
Clean drains and inlets that become clogged during construction operations.
3. Add the following to Section 203 of the Special Contract Requirements, page J-10:
203.07. Add the following:
Measure the removal of concrete curb and gutter required for asphalt concrete pavement patching under Section 418.
4. Add the following to Section 418 of the Special Contract Requirements, page J-21:
418.03(b). Add the following:
Remove concrete curb and gutter as directed by the CO according to Section 203.
5. Add the following to Section 418 of the Special Contract Requirements, page J-21:
418.03(c). Add the following:
If required, install concrete curb and gutter in patch areas according to Section 609.
6. For Section 418 of the Special Contract Requirements, page J-21, delete the “412.08” instruction reference and substitute with “418.08”.
7. Add the following to Section 418 of the Special Contract Requirements, page J-21:

Questions / Clarifications
The following questions and issues were submitted via email at eflhd.contracts@dot.gov. The Government response or clarification is provided. Due to the repetitive nature of several questions and issues, the wording of the questions may have been revised and some questions have not been included. The Government’s direct response to the sender may also have been updated below for better clarity.
1. No plan has been provided indicating temporary pavement marking requirements and there are no line items for payment of temporary pavement markings (both paint and tape). Please provide pay items for this work.
Response: Temporary traffic control is paid for by the Lump sum (LPSM), measured according to Subsection 635.25 of the FP (standard specifications book) and paid under pay item 63501-0000. Please refer to Subsection 156.04 for coordination with the Maryland State Highway Administration (MdSHA) and temporary traffic control plans for CO’s approval.
As outlined in Subsection 635.04(j) of the Special Contract Requirements (SCRs), temporary pavement markings are included in the list of minimum temporary traffic control devices required for the LPSM pay item.
2. There are no pay items established for PCMS. The project special provisions on sheet J-8 state "Provide portable changeable message signs and place where directed by the CO." How many PCMS will the CO want installed at one time? Please provide pay items for this work.
Response: Please see response above for LPSM temporary traffic control measurement.
Minimum requirements for portable changeable message signs (PCMS) have been clarified in Amendment 2.
3. There are no pay items established for temporary construction signs. For ramp work, it would be required to close ramp and detour traffic during the work shift to perform the work safely. There are no traffic plans provided in the documents for this work, and Per Special provisions J-8, "Submit a traffic control plan for approval at least 15 days before intended use in accordance with Subsection 104.03..." We do not know what plan, nor quantity of signs, PCMS's, etc. that would be approved by CO. Please provide a pay item for temporary construction signs.
Response: As stated in Subsection 156.04 of the SCRs, the Contractor is responsible for submitting a temporary traffic control plan for approval. The Contractor will have to determine the type of traffic control situations needed based on the existing roadway and traffic conditions, the Temporary Traffic Control (635) Details (S sheets) provided in the plans, and the traffic control restrictions found in Section 156 of the FP and SCRs, and then determine the quantities of devices required.
Please see response above for LPSM temporary traffic control measurement.
Amendment No. 002
4. On drawing B02, Asphalt Concrete Pavement Patch, Type 1, indicated to remove existing curb and gutter and construct new curb and gutter 13". The Contractor cannot determine how many linear feet of curb would need to be replaced. Please establish pay items for this work.
Response: The replacement of existing concrete curb and gutter is considered subsidiary to the asphalt concrete pavement patching, and measurement and payment statements have been added to the SCRs for clarification in Amendment 2.
5. Special Provision J-9 states: "Ensure that drains and inlets within the project limits are fully functional throughout duration of the project." We cannot determine what inlets and drains are fully functional at this time. If cleaning of existing inlets and drains are required, please provide pay items for this work.
Response: Cleaning inlets and drains requirement has been clarified in Amendment 2.
6. Will the Asphalt Cement be indexed at the current rate or do we need to include the risk?
Response: It is anticipated that the paving work will be performed within one season.
Therefore, an asphalt cement price adjustment determined by the asphalt cement index is not likely to be applicable.
7. Bid Item A0200 Type I Full Depth Asphalt Patch does not indicate anywhere the Asphalt Mix or the Aggregate Size that is required. Are we to use the 3/8"? Does it have to include 76-22 Liquid?
Response: Please see the amended Plan Sheets B01 and B02 for the asphalt concrete pavement patching requirements. Please also refer to Section 418 of the FP that requires Section 403 - Asphalt Concrete”, specifically Subsection 403.02(a) for asphalt concrete “Type 1” for further information.
8. What is the anticipated Notice to Proceed date?
Response: Once the contract is awarded, the Contactor must submit performance and payment (P&P) bonds within 14 days of the contact award (as stated in Block 12 of the SF 1442). The Notice to Proceed (NTP) will be issued after the P&P bonds are received and approved.
