About this file

This document is a Request for Information (RFI) for a lead paint abatement and remediation project at the United States Merchant Marine Academy (USMMA) in Wiley Hall. The RFI seeks clarification on multiple aspects of the project, including approved remediation methods, utility connections, containment requirements, waste handling, notification procedures, substrate replacement, painting specifications, project timeline, and administrative details. Key points include the requirement for an EPA-qualified and licensed lead abatement specialist to perform work in the Dean's Office, Reception Office, Dean's Bathroom, and Hall #4, with specific requirements such as using wet methods, negative pressure enclosures, HEPA vacuums, and EPA-approved lead encapsulant. The project requires compliance with federal, state, and local regulations, with a completion timeline of 4 days after contract award, and offers submission due by August 6th, 2025 at 0900.

(RFIs) to the Owner (USMMA)

Attn: Carmen I. Feliz – Contracting Officer, United State Merchant Marine Academy

RE: Notice ID 6923G225Q000011 Wiley Hall 2nd Deck Dean & Reception Offices Lead Paint

Abatement / Remediation

We hereby respectfully request additional clarification and/or information on the following:

1. Approved Methods of Remediation.

Can you please specify what are the approved methods of lead paint stripping by USMMA?

(e.g. chemical stripping agents, heat guns, abrasive removers - sanding or abrading equipment with HEPA dust pick-up system) Wet methods as stated in the SOW in accordance with all regulatory standards and requirements.

2. As-Built Drawings and Inspection Reports

• Can you provide an environmental test report? N/A

3. Utility Connections and Temporary Services – DPW

• Could you confirm the exact locations where DPW personnel will allow us to connect temporary water and power? Outside hose bib is available; Normal household outlets are available throughout.

• Is there a maximum amperage or water pressure limitation at those connection points?

Normal residential electric and water service is present.

4. Containment-Related Requirements

• The SOW requires negative pressure enclosures and HEPA vacuums. Are there any staging/storage areas already available on site for building our containment (e.g., a staging tent or covered area), or must we erect 100% new enclosure framing? No staging areas are designated at the academy. Contractor(s) will need to erect one.

5. Encapsulant Product Approval

• Are there any USMMA-approved lead encapsulant brands (e.g., specified by project?) or a pre-approved product list? If not, please confirm that we may propose our own EPA-approved encapsulant and submit SDS for Owner approval prior to mobilization.

Contractor may propose their own EPA-approved encapsulant and submit the SDS prior to mobilization.

6. Waste Handling, Storage, and Disposal

• Where on site is the designated staging area for temporarily storing lead-contaminated waste (e.g., labeled drums, sealed bags) before off-site transport? TBD before start of project.

• Does the Owner require a specific landfill or TSDF (Treatment, Storage, and Disposal

Facility) to be used, or may we propose any RCRA-permitted facility? Contractor may propose RCRA-permitted facility and must provide documentation of proof.

• Are there any on-site bulking or containerization restrictions (e.g., maximum container size, prohibited container types)? Not necessarily. However, container size and location can be discussed further before start of project, pending location availability and academy activities.

• Who is responsible for performing the TCLP (Toxicity Characteristic Leaching

Procedure) testing? Owner, Consultant, Contractor? The academy’s contracted

IH. TBD.

7. Notification Requirements

• Section 2(c) calls for an “Occupant Protection Plan” and notifications to COR, Public

Safety, and DPW.

o Is there a template or format that the Owner prefers for the Occupant Protection

Plan? No. The only requirement is that the plan meets all of the requirements per regulatory standards.

• Are there any additional local (Nassau County or Village of Kings Point) notification or permitting requirements (e.g., DSNY, local health department) beyond federal/state notices? State Historic Preservation Officers (SHPO).

8. Substrate Replacement Scope

• The SOW states: “If the paint cannot be removed while still leaving a clean, smooth and paintable surface, the contractor will be required to remove building material (i.e., wood pieces) in its entirety and replace with similar material.” - Procurement o Is there an allowance in the bid form for unit pricing (e.g., per linear foot or board-foot) for substrate replacement? If not, please clarify how we should account for unknown quantities of substrate removal and replacement. –

Procurement

• Does any replacement material need to match historic profiles, or is generic code-compliant lumber acceptable? – DPW – All replacement material will need to match historic profiles

9. Final Painting and Finish Requirements

• The SOW mentions “apply a lead encapsulation paint or primer, over all surfaces to be painted.” Is this encapsulant intended to be the final finish, or are we to apply a separate topcoat paint over the encapsulant? Encapsulant is final finish expected by the contractor. DPW personnel will apply topcoat of paint.

• If a topcoat is required, please specify finish type (e.g., semi-gloss exterior latex) and color(s), or indicate that the contractor should match the existing. N/A

• Does USMMA require two coats of encapsulant/topcoat, or will one coat suffice if manufacturer’s coverage guidelines are met? Two coats (2)

10. Timeline, Mobilization, and Schedule Constraints

• The SOW indicates “Completion Date: 4 days after award of contract.” Does this four-day window include the 2-day plan approval process, mobilization, abatement, sampling, and final reporting, or is it four business days for actual abatement work only? Please note that EPA must be notified 5 business days prior to the commencement of any lead remediation. The completion date can be adjusted to meet the timeframe requirements of notification(s) and the work, including clearance results.

11. Insurance, Bonds, and Permitting – Procurement

• Are there any project-specific insurance requirements beyond standard General Liability, Workers’ Compensation, and Pollution Liability?

• Will the Owner require a Performance Bond and Payment Bond; if so, what amounts

(percentage of bid) are required?

• Apart from EPA and NY State lead abatement contractor licensing, does the Village of

Kings Point require separate trade permits (e.g., Building Permit, Health Dept. Permit) to perform lead abatement work? Who is responsible for pulling those permits?

12. Project Closeout Deliverables

• What specific documentation must be submitted at project closeout? Typical items include project logbooks, waste manifest copies, Occupant Protection Plan revisions, photo log, and final invoices. Please list all required deliverables and preferred submission timelines. Deliverables are listed in the SOW for additional detail.

13. Materials to be used

• Can you please advise on the different materials that will be affected by lead abatement?

To be used at the discretion of the contractor in accordance with all federal, state and local regulations and requirements to perform the work outlined in the SOW.

14. Labeling

• Would it be possible to label the scope of work areas shown in the pictures provided on the SOW document for clarity? N/A

15. Walkthrough – Procurement

• Can you please advise if a second walk-through will be scheduled for this bid? NO additional walk thru has been determined for this project at this time.
