B.4 STATEMENT OF WORK

Contract Title. Clinical Lab Deionized Tankless Water System Installation and Maintenance

Background/Dates of Service (Period of Performance).

The Central VA Healthcare System is requesting a Deionizing (DI) Tankless Water System and installation for the new Clinical Laboratory Expansion Project located on the 3rd floor of the Richmond VA Medical Center. A contract is required to ensure that the Central Virginia VA Health Care System is providing the best possible water to the Pathology and Laboratory Medicine Department.

Scope.

The Veterans Heath Administration, Richmond VA Medical Center, intends to solicit and award a contract to provide installation to sinks and instrumentation and one-year preventative maintenance service for a Deionized Tankless Water System located in the Pathology and Laboratory Department at the Richmond VA Medical Center, located at 1201 Broad Rock Blvd, Richmond, VA 23249. Services shall be in accordance with the terms, conditions, provisions and schedule of the contract. Services shall be for the period of one (1) year from time of award. The vendor shall supply and install a tankless, recirculating deionized water system, sized to fit in the footprint and complete the installation to sinks and instrumentation as indicated in the provided diagrams.

Specific Tasks-Deliverable Product.

The vendor shall provide/complete the following:

• The full installation of a tankless, recirculating RO (type II) deionized (DI) water system in the Pathology and Laboratory Medicine Department at the Richmond VA Medical Center under these specifications:

o Electric conductivity – 1.0 u S/cm or less o Supply Pressure – 0.2MPa – 0.4MPa (29psi - 58psi) o Supply Volume – 10L/h – 50L/h o Temperature of R/O water – 10 °C – 30 °C o TOC (Total organic Carbon) – less or equal to 500ppb

• Supply and install the deionized tankless water system to six (6) sinks and six (6) instruments within the clinical lab expansion, (Attachment A), ensuring it fits within the designated footprint listed in Water System Space. (Attachment B).

• Connect the deionized tankless water system to six (6) sinks, ensuring they meet VA specifications and are fully operational.

• Install faucets at all designated sinks, ensuring they meet VA specifications and are fully operational.

• Provide all necessary fittings, piping, hoses, faucets and connections required for a complete and functional installation.

• Ensure that all work is completed, to support the operational readiness of the Clinical

Lab Expansion Project.

• All labor, materials, equipment, transportation, lodging and supervision necessary to perform preventative maintenance for the Deionized Tankless Water System located in the Pathology and Laboratory Medicine Department at the Richmond VAMC, 1201 Broad Rock Blvd, Richmond, VA 23249.

• All equipment/materials are to be shipped to Central Virginia VA Health Care System, Building 500 Warehouse, ATTN: George Martin, Engineering, BE-109C, Richmond, VA 23249.

• All shipments are to arrive during normal business hours. Normal business hours are Monday through Friday 8:00am to 4:00pm, excluding federal holidays. Federal holidays are:

Hours of Operation All work for this contract is to be done Monday through Friday 8:00 a.m. to 4:00 p.m.

Emergency requests may be handled after hours.

• All shipments are to arrive during normal business hours. Normal business hours are Monday through Friday 8:00am to 4:00pm, excluding federal holidays. Federal holidays are:

• All shipments are to have a packing slip. The packing slip must include the following information:

• The warehouse staff members and equipment managers will ensure all pieces of equipment and components have arrived at the facility.

• If any equipment/parts/materials arrive defective, the vendor shall replace the item at no cost to the government within 7 to 10 working days after production of the item.

• The vendor will check in and out with the Plumbing Foreman upon arrival and departure.

• The vendor will supply all materials and equipment needed for the installation of the de-ionizing water system and components, to include but not limited to:

o Ladders and lifts.

o Safety equipment.

o Fittings and supplies.

o Tools and miscellaneous equipment.

• The vendor shall during, throughout and at the end of the installation ensure that all trash and debris for the installation site is clean prior to departure.

Performance Monitoring Various methods exist to monitor performance. The COR shall use the surveillance methods listed below in the performance monitoring of this contract.

• 6.1 Direct Observation: (Can be performed periodically or through 100% surveillance.)

• 6.2 Periodic Inspection: (Evaluates outcomes on a periodic basis. Inspections may be scheduled [Daily, Weekly, Monthly, Quarterly, or annually] or unscheduled, as required.)

a. ACCEPTABLE PERFORMANCE

The Government shall document positive performance. Any report may become a part of the supporting documentation for any contractual action.

b. UNACCEPTABLE PERFORMANCE

When unacceptable performance occurs, the COR shall inform the contractor. This will normally be in writing unless circumstances necessitate verbal communication. In any case the COR shall document the discussion and place it in the COR file.

When the COR determines formal written communication is required, the COR shall prepare a Contract Discrepancy Report (CDR) and present it to the contractor's program manager.

The contractor shall acknowledge receipt of the CDR in writing. The CDR will specify if the contractor is required to prepare a corrective action plan to document how the contractor shall correct the unacceptable performance and avoid a recurrence. The CDR will also state how long after receipt the contractor must present this corrective action plan to the COR. The Government shall review the contractor's corrective action plan to determine acceptability.

Any CDRs may become a part of the supporting documentation for any contractual action deemed necessary by the CO.

7. Security Requirements

Vendor will not have access to VA Sensitive Information, patient records, or data.

For repairs or services performed during normal work hours, 8:00 a.m. to 4:00 p.m. at the Richmond VAMCVA, contractor’s repairman shall report to the Pathology and Laboratory Medicine Service, Main Hospital, 3rd floor, room 3A137. Contractors shall sign-in through Rep Trax or obtain a temporary badge and return the badge at the end of the day. After all work is complete, the contractor’s repairman shall again report in person to the room listed above, submit a written service report outlining the services performed and completed to include location and parts used.

For services performed outside normal working hours, the contractor’s repairman should report to the main lab, 3A-138, of the Richmond VAMCVA. After all work is complete the contractor’s repairman shall again report to 3A-138 where the repairman shall submit the report required above.

8. Government-Furnished Equipment (GFE)/Government-Furnished Information (GFI).

Solicitation to provide all labor, material, equipment, transportation, lodging and supervision necessary to perform preventative maintenance and mixed bed filter exchange and replacement for the Deionized Water system located in the Pathology and Laboratory Medicine department at the Richmond VAMC, 1201 Broad Rock Blvd, Richmond VA 23249. All DI and Carbon tanks are considered rentals and will remain the property of the vendor.

The VA Medical Center Richmond VAMC will not furnish parts and/or test equipment for the performance of this contract. It is the responsibility of the contractor to bring the appropriate equipment; and/or supplies necessary to complete the work as required within.

9. Other Pertinent Information or Special Considerations.

All work shall be performed by personnel qualified to work on the specific equipment. All work performed shall compliant with CLSI guideline GP40-A4-AMD and shall be designed to assure that the Richmond VAMCVA Medical Center is providing the best possible water for patient laboratory testing. All DI and Carbon tanks are considered rentals and will remain the property of the vendor.

Place of Performance.

The Central Virginia VA Healthcare System of the Veteran’s Health Administration, at the 1201 Broad Rock Blvd, Richmond, VA 23249. The DI Tankless Water system is located in the Pathology and Laboratory Medicine department, inside 3F Clinical Lab expansion.

11. Period of Performance

1 Year

C.3 VAAR 852.232-72 ELECTRONIC SUBMISSION OF PAYMENT

REQUESTS (NOV 2018)

(a) Definitions. As used in this clause—

(1) Contract financing payment has the meaning given in FAR 32.001;

(2) Designated agency office means the office designated by the purchase order, agreement, or contract to first receive and review invoices. This office can be contractually designated as the receiving entity. This office may be different from the office issuing the payment;

(3) Electronic form means an automated system transmitting information electronically according to the accepted electronic data transmission methods and formats identified in paragraph (c) of this clause. Facsimile, email, and scanned documents are not acceptable electronic forms for submission of payment requests;

(4) Invoice payment has the meaning given in FAR 32.001; and

(5) Payment request means any request for contract financing payment or invoice payment submitted by the contractor under this contract.

(b) Electronic payment requests. Except as provided in paragraph (e) of this clause, the contractor shall submit payment requests in electronic form. Purchases paid with a Government-wide commercial purchase card are considered to be an electronic transaction for purposes of this rule, and therefore no additional electronic invoice submission is required.

(c) Data transmission. A contractor must ensure that the data transmission method and format are through one of the following:

(1) VA’s Electronic Invoice Presentment and Payment System at the current website address provided in the contract.

(2) Any system that conforms to the X12 electronic data interchange (EDI) formats established by the Accredited Standards Center (ASC) and chartered by the American National Standards Institute (ANSI).

(d) Invoice requirements. Invoices shall comply with FAR 32.905.

(e) Exceptions. If, based on one of the circumstances in this paragraph (e), the Contracting Officer directs that payment requests be made by mail, the Contractor shall submit payment requests by mail through the United States Postal Service to the designated agency office.

Submission of payment requests by mail may be required for—

(1) Awards made to foreign vendors for work performed outside the United States;

(2) Classified contracts or purchases when electronic submission and processing of payment requests could compromise the safeguarding of classified or privacy information;

(3) Contracts awarded by contracting officers in the conduct of emergency operations, such as responses to national emergencies;

C.5 VAAR 852.246-71 REJECTED GOODS (OCT 2018)

(a) Supplies and equipment. Rejected goods will be held subject to Contractor’s order for not more than 15 days, after which the rejected merchandise will be returned to the Contractor’s address at the Contractor’s risk and expense. Expenses incident to the examination and testing of materials or supplies that have been rejected will be charged to the Contractor.

(b) Perishable supplies. The Contractor shall remove rejected perishable supplies within 48 hours after notice of rejection. Supplies determined to be unfit for human consumption will not be removed without permission of the local health authorities. Supplies not removed within the allowed time may be destroyed. The Department of Veterans Affairs will not be responsible for, nor pay for, products rejected. The Contractor will be liable for costs incident to examination of rejected products.

(d) Comptroller General Examination of Record. The Contractor shall comply with the provisions of this paragraph (d) if this contract was awarded using other than sealed bid, is in excess of the simplified acquisition threshold, as defined in FAR 2.101, on the date of award of this contract, and does not contain the clause at 52.215-2, Audit and Records—Negotiation.

(1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor's directly pertinent records involving transactions related to this contract.

(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR Subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.

(3) As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of type and regardless of form. This does not require the Contractor to create or maintain any record that the Contractor does not maintain in the ordinary course of business or pursuant to a provision of law.

(e)(1) Notwithstanding the requirements of the clauses in paragraphs (a), (b), (c), and (d) of this clause, the Contractor is not required to flow down any FAR clause, other than those in this paragraph (e)(1) in a subcontract for commercial products or commercial services. The version of FAR 52.212-1 in the addendum is tailored for Simplified Acquisition Procedures and supersedes the current version of FAR 52.212-1 contained in the FAR. The following provisions are incorporated into 52.212-1 as an addendum to this solicitation:

(1) Offer Form (Standard Form 1449) include the North American Industry Classification System (NAICS) 333310 code and small business size standard, 1,000 employees, in Block 10. Contractor’s Unique Entity ID (SAM) Number shall be entered in the block with the Offerors name and address.
