LIMITED ASBESTOS CONTAINING MATERIALS INSPECTION

Prepared for:

Scranton Office of Economic and Community Development 340 North Washington Avenue (Municipal Building), Scranton, PA 18503

I. EXECUTIVE SUMMARY

An Asbestos Materials Inspection was conducted on January 19th, 2022 and updated on June 13th 2025 within the planned demolition site located at 630 Clay Avenue, Scranton, Pennsylvania. The purpose of the inspection was to determine what asbestos containing materials exist within the structure. Mr. William Sterling (PA Asbestos Inspector #057069) of Quad Three Group, Inc. conducted the inspection in conjunction with demolition scheduled at the structure.

As part of this asbestos inspection, the quantities and conditions of asbestos containing materials were identified. A total of fifty three (53) layers of material samples were collected and analyzed.

Asbestos containing materials (ACM) have been identified within the structure and include: 9 x 9 floor tile and Pipe / Fitting / Duct Insulation.

Materials that were non-suspect or were sampled and through analysis found to not contain asbestos include: wall / ceiling plaster, wall / ceiling texture, drywall ceiling, linoleum flooring, sheet flooring, and ceiling tile. Descriptions of all the material samples collected can be found in Appendix A.

The conclusions presented in this report are the result of the coalition, compilation and analysis of samples and other information obtained during the inspection. The results presented in this report represent the conditions present at the time of the inspection. Quad Three Group has no control over conditions or events that occurred following the date of inspection.

II. INTRODUCTION

On January 19 th, 2022, and updated on June 13th, 2025 a limited asbestos inspection was performed within 630 Clay Avenue, Scranton, Pennsylvania. The purpose of the inspection was to visually locate, identify and quantify asbestos containing materials (ACM) as they exist within the structure scheduled for demolition. The survey/inspection process included:

A. Inspecting the area to identify representative “suspected” asbestos-containing materials, types and sampling sites.

B. Collecting representative samples from any suspect material in order to identify all Asbestos Containing Materials (ACM). Examples of these materials include Pipe insulation, plaster, sheet-rock, floor tiles, linoleum, etc.

1.

C. Sampling was performed by experienced, licensed personnel utilizing semi -destructive sampling techniques in an attempt to locate asbestos containing materials.

D. Laboratory analysis of the materials sampled was performed at an accredited laboratory using the EPA recommended method of polarized light microscopy (PLM) for friable samples.

III. SURVEY AREA DISCUSSION

The multiple family residence consisted of six apartments comprising three floors and a basement at 630 Clay Avenue. The building primarily consists of wood floors, wood paneling, plaster walls / ceilings, and drywall ceilings. Major structural components include concrete, brick, stone, block, and wood. Access was limited at the time of the June 2025 inspection updated because of deteriorating structural conditions within the structure.

IV. MATERIALS SAMPLING AND ANALYTICAL METHODOLOGY

The building inspection was conducted by an inspector, qualified by experience, education and training in the recognition of suspect asbestos-containing materials (ACM). An initial walk through was conducted to identify suspect asbestos containing materials and to group them into homogeneous sampling areas.

Following the walkthrough, the number of samples required to determine the presence of ACM in the study areas was determined. Sample collection was performed with the intent to identify and locate asbestos containing materials and to group them into homogeneous material categories. This grouping allowed the inspectors to identify like materials within the structure to avoid over sampling or mischaracterization of an asbestos containing material.

The majority of ACM was located utilizing non-destructive techniques. Some areas of ACM may still exist in areas that could not be accessed until complete interior demolition is completed, although it is unlikely.

Representative samples of each “suspect asbestos containing material” were collected utilizing approved federal and state methods. When samples were collected, the locations were noted. Measurements were taken to determine the approximate quantity of suspect material. The condition of the material was also documented at that time.

All material samples were analyzed via Polarized Light Microscopy (PLM) as per EPA/600R- 93-116, July 1993.

The analytical results and locations for all samples collected can be found in Appendix A.

The samples were analyzed by International Asbestos Testing Laboratories of Mt. Laurel, New Jersey. IATL is accredited by the National Institute of Standards and Technology’s “National Voluntary Laboratory Accreditation Program” NVLAP (#1011500-0). IATL has developed and implemented an intra laboratory quality assurance/quality control program to ensure accuracy and consistency of results.

Asbestos is present if the material analyzed is greater than one percent (>1%) by weight.

This stipulation is outlined in the EPA Publication EPA 500/5-85-024, Section 2.2.2.2.

2.

V. INSPECTION FINDINGS AND RECOMMENDATIONS

Asbestos containing materials have been identified within the structure and are listed in the following summary along with the material condition. The quantities are approximate and should be confirmed by an abatement contractor prior to providing cost estimates for removal.

Asbestos containing 9 x 9 floor tile is located under luan within the rear entrance way on the right side of the structure of 630 Clay Avenue. The 9 x 9 floor tile is a non - friable material.

Asbestos containing pipe / fitting / duct insulation is located throughout the basement of 630 Clay Avenue. The pipe / fitting insulation is a friable material.

Asbestos containing materials are categorized as containing asbestos concentrations greater than one percent (>1.0%) by weight. Asbestos fiber concentrations less than one percent (<1.0%) by weight are still regulated under OSHA standard 1926.1101.

Below are the results of the building inspection. The results indicate the sample location, sample numbers, material and condition. Some of the materials were homogenized for sampling purposes. For example, once a homogeneous material was sampled, the sample result could be considered representative for that material throughout the residence. If one sample of a homogeneous material tested positive for asbestos, then the entire homogeneous material was classified as asbestos containing in accordance with Environmental Protection Agency Guidelines.

The conditions of the materials are designated as good, damaged or significantly damaged.

The following materials were found to contain more than one percent (>1.0%) asbestos by weight:

630 CLAY AVENUE SCRANTON PA

Analytical results for the materials sampled are located in Appendix A.

Friable materials are materials that can be crushed by applying hand pressure. Non-friable materials are materials that typically cannot be crushed by hand pressure (floor tiles/mastics). If grinding or pulverization were to occur during demolition, non-friable materials can be rendered friable.

Asbestos containing materials (friable and non-friable) located on the interior / exterior of a building, which will be disturbed during renovations / demolition, must be removed and disposed of by a licensed asbestos abatement contractor

Information Pertinent to this Report:

Analysis by US EPA 600 93-116: Determination of Asbestos in Bulk Building Materials by Polarized Light Microscopy (PLM).

Certifications:

NIST-NVLAP No. 101165-0• NYSDOH-ELAP No. 11021• AIHA-LAP, LLC No. 100188•

Quantification at <0.25% by volume is possible with this method. (PC) Indicates Stratified Point Count Method performed. (PC-Trace) means that asbestos was detected but is not quantifiable under the Point Counting regimen. PC Trace represents a <0.25% amount. Analysis includes all distinct separable layers in accordance with EPA 600 Method. If not reported or otherwise noted, layer is either not present or the client has specifically requested that it not be analyzed (ex. analyze until positive instructions). Small asbestos fibers may be missed by PLM due to resolution limitations of the optical microscope. Therefore, PLM is not consistently reliable in detecting asbestos in non-friable organically bound (NOB) materials. Quantitative transmission electron microscopy (TEM) is currently the only method that can pronounce materials as non-asbestos containing.

Analytical Methodology Alternatives: Your initial request for analysis may not have accounted for recent advances in regulatory requirements or advances in technology that are routinely used in similar situations for other qualified projects. 16) Note: This sample contains >10% vermiculite mineral. See Appendix for Recommendations for Vermiculite Analysis.

Recommendations for Vermiculite Analysis:

Several analytical protocols exist for the analysis of asbestos in vermiculite. These analytical approaches vary depending upon the nature of the vermiculite mineral being tested (e.g. un-processed gange, homogeneous exfoliated books of mica, or mixed mineral composites). Please contact your client representative for pricing and turnaround time options available.

iATL recommends initial testing using the EPA 600/R-93/116 method. This method is specifically designed for the analysis of asbestos in bulk building materials. It provides an acceptable starting point for primary screening of vermiculite for possible asbestos.

Results from this testing may be inconclusive. EPA suggests proceeding to a multi-tiered analysis involving wet separation techniques in conjunction with PLM and TEM gravimetric analysis (EPA 600/R-04/004).

For New York State customers, NYSDOH requires disclaimers and qualifiers for various vermiculite containing samples that direct analysis via ELAP198.6 and ELAP198.8 for samples that contain >10% vermiculite mineral where ELAP198.6 may be used to evaluate the asbestos content of the material. However, any test result using ELAP198.6 will be reported with the following disclaimer: “ELAP198.6 method does not remove vermiculite and may underestimate the level of asbestos present in a sample containing >10% vermiculite.”

Further information on this method and other vermiculite and asbestos issues can be found at the following: Agency for Toxic Substances and Disease Registry (ATSDR) www.atsdr.cdc.gov, United States Geological Survey (USGS) www.minerals.usgs.gov/minerals/, US EPA www.epa.gov/asbestos. The USEPA also has an informative brochure "Current Best Practices for Vermiculite Attic Insulation" EPA 747F03001 May 2003, that may assist the health and remediation professional. NYS customers please follow current NYSDOH ELAP requirements per policy on subject of surfacing and vermiculite, May 6, 2016, Testing Requirements for Surfacing Material Containing Vermiculite (https://www.wadsworth.org/sites/default/files/WebDoc/I198_8_02_2.pdf)

The following is a summary of the analytical process outlines in the EPA 600/R-04/004 Method:

1)Analytical Step/Method: Initial Screening by PLM, EPA 600R-93/116 Requirements/Comments: Minimum of 0.1 g of sample. ~0.25% for most samples.

06 62 00 E-verify Act and Form

On July 5, 2012, Gov. Corbett signed into law the Public Works Employment Verification Act (S.B. 637) which takes effect January 1, 2013.

The Act requires all public works contractors and subcontractors in Pennsylvania to use E-Verify to verify the employment eligibility of new employees and applies to projects with an estimated cost in excess of $25,000 that are funded by the Commonwealth, or its political subdivisions, authorities, or agencies. E-Verify is an internet-based system that compares information from an employee’s Form I-9, Employment Eligibility Verification, to data from the U.S. Department of Homeland Security and Social Security Administration records to confirm employment eligibility.

(5) "Public work" means construction, reconstruction, demolition, alteration and/or repair work other than maintenance work, done under contract and paid for in whole or in part out of the funds of a public body where the estimated cost of the total project is in excess of twenty-five thousand dollars ($25,000), but shall not include work performed under a rehabilitation or manpower training program.

Under the Act, a contractor must submit a verification form signed under penalty of perjury and acknowledging its compliance with the Act as a precondition of being awarded a public works contract. Subcontractors must submit the form prior to commencing work on the public works project. In addition, contractors must include in their subcontracts information about the requirements of the Act. The Department of General Services (DGS) will create the verification form and is also charged with enforcement of the Act through complaint-based as well as random audits.

A contractor or subcontractor violates the Act by failing either to use E-Verify or to provide the verification form. Sanctions for failure to use E-Verify range from a warning letter (to be posted on the DGS website) for a first violation to a one year debarment for a third and subsequent violation. A willful violation of the Act will result in a 3-year debarment. Civil penalties for failure to use the form or for false statements on the form range from $250 to $1,000 for each violation.

The Act provides significant protection for whistleblowers. If an employee of a contractor or subcontractor is retaliated against for instigating or cooperating in an investigation, the employee can bring suit (which must be brought within 180 days from the date the employee knew of the retaliation) to obtain reinstatement of employment and to collect three times lost wages, along with an award of attorney’s fees and costs.

A contractor or subcontractor who relies in good faith on E-Verify has immunity from sanctions and shall have no liability to any individual who is not hired or is discharged from employment.

Good faith is shown by a federal agency’s written acknowledgment of the use of E-Verify.

Contractors are not liable for violations by subcontractors.
