LIMITED SOURCE JUSTIFICATION
J&A Number: JA19-034
Upon the basis of the following justification, I, as Procuring Activity Competition Advocate, hereby approve this limited source justification in accordance with FAR 8.405-6(a)(1)(i)(C). As described in paragraph 4(a) below, FAR 6.302-1(c) will also be used. Four of the acquisitions referenced herein are conducted under the authority of the MAS Program. The particular requirements below, only allowing limited sources to fulfill, are essential in meeting the Government’s needs.

2. NATURE/DESCRIPTION OF ACTION(S):
On January 8, 2017, DISA parted from the Data Center construct to form a Line of Business (LOB) Ecosystem that can streamline processes, while identifying improved efficiencies to support DISA partners and the warfighters. On March 24, 2017, the Director of DISA Operations Center signed a memo addressed to the Director, Procurement Services Directorate and Small Business Programs indicating that "due to multiple reorganizations over the contract lifecycles, mission changes, and added programs to support the Data Center construct, the current technical support contracts cannot adequately support the future of the new DISA Ecosystem. The LOBs will utilize the current Data Center contracts for

4. IDENTIFICATION OF LIMITED SOURCE AUTHORITY AND DEMONSTRATION OF
CONTRACTOR’S UNIQUE QUALIFICATIONS:
(a) Circumstances Justifying Limiting the Source. In accordance with (IAW) FAR 8.405-6
(a)(1)(i)(C), in the interest of economy and efficiency, four of the bridge extensions are a logical follow-on to the original FSS order. The original order was not previously issued under sole-source or limited-sources. Additionally, two of the bridge extensions, IAW FAR 6.302-1, Only one responsible source and no other supplies or services will satisfy agency requirements. Specifically, under FAR 6.302-1(a)(2)(iii), services may be deemed to be available only from the original source in the case of follow-on contracts for the continued provision of highly specialized services when it is likely that award to any other source would result in--(A) Substantial duplication of cost to the Government that is not expected to be recovered through competition, or (B) Unacceptable delays in fulfilling the agency’s requirements. (See 10 U.S.C. 2304(d)(1)(B))
(b) Description of the Justification. This justification is to bridge the services identified above, and detailed further in Attachment 1, until the on-going sources selections can be completed and adjudication of any post-award protest can be resolved. These bridge efforts continue necessary support until new requirements can be awarded.
(c) Justification:
(1) Minimum Government requirements. The Government requires services at its current level in order to support the Data Center contracts requirements. This includes Communications and Network Server Technical Support, Cyber Services Information Assurance Support, Armed Security Guards, Technical Support, Operational Support Team and PC Administration Support, as well as Data Center System Management Center - Service Desk Division Support.
(2) Proposed sole source contractor. The current contractors, as identified in Attachment
1, are the only sources that can fulfill this requirement without risk of a substantial break in service until the on-going source selections can be awarded and any potential post-award protest can be resolved. Since a new competitive acquisition has commenced and is expected to be awarded by June 1, 2019, it would not be logical or efficient for the Agency to compete these short-term bridge orders/contracts. This logical follow-on is in the best interest of the Government, in the interest of economy and efficiency, as it makes more sense to continue with the current contractors until the next competitive award is made. Further, the current contractors are the only contractors capable of fulfilling these necessary requirements in the necessary timeframe, without risk of a substantial break in service/support to the Data Centers.
On-boarding another contractor for such a short duration before the requirement comes to an end is not economical, as it would significantly increase the risk to the Government, due to the added transition time required. The current contractors are the only firms that will not incur unacceptable delays and unnecessary costs, which would negatively impact mission accomplishment.

(3) Discussion regarding cause of the limited source situation. Due to the collective approach in obtaining services for the newly formed Ecosystem and the potential of receiving a post-award protest of the award supporting the new requirements, there is a need to extend the current task orders via bridge extensions to allow for continued services until award can be made and any potential post-award protest can be resolved. Although other contractors can perform this effort, there is not time available, nor would it be in the Government’s best interest, to conduct another competitive procurement for these short duration bridge extensions.
(4) Demonstration of limited source. A break in service or degradation of support is unacceptable. Due to the current contractor’s continued support of these requirements since award of these task orders, they are the only contractors capable of providing the services without degradation in the short timeframe needed to avoid a gap in services. Any other contractor would require time to find and hire qualified personnel and time to get up to speed on the services provided through these requirements.
(5) Procurement discussion. These current requirements, supporting the Data Center infrastructures are at end-of-life. Due to the restructuring of the Data Center construct to the Ecosystem construct, new requirements have been defined. Those requirements are currently in source selection. All were competed against GSA FSS’s as small business, or other socio-economic categories, set-asides. Award is estimated to take place on or before February 1, 2019. A 4-month lead time to the performance start date of June 1, 2019 is included to allow for adjudication of any potential post-award protest received and time for contractor’s to ramp up personnel. The purpose of these bridge efforts is to ensure continued support through award of the new requirements and resolution of potential protests.
(6) Impact. Without a bridge effort, critical operational sustainment of the current service requirements would cease, thus leaving DISA vulnerable in the areas of physical security and information assurance. The loss of services would also result in DISA not being able to fulfill its obligations to mission partners that rely on the agency to provide these critical services in support of warfighter missions. All of these ramifications are unacceptable in order to meet the Government’s mission.
5. BEST VALUE DETERMINATION:
GSA has already determined that prices of fixed price services and rates for services offered at hourly rates are fair and reasonable for the purpose of establishing the schedule contract. The Government will utilize the various proposal analysis techniques described in FAR 15.404-1.
The contractor-proposed pricing will be compared to an Independent Government Cost Estimate, market research, and historical data to include other contracts for similar efforts. Based on this analysis, the contracting officer will negotiate a fair and reasonable price. By placing four of the orders against a schedule contract using the procedures in FAR Part 8, the ordering activity has concluded that the order represents the best value (as defined in FAR 2.101) and results in the lowest overall cost alternative (considering price, special features, administrative costs, etc.) to
Page 5 of 6 Pages meet the Government's needs in accordance with FAR 8.404(d). A further determination will be made by the Contracting Officer that the action represents the best value to the Government by conducting both a technical and price evaluation as part of a fair and reasonable price determination.
6. MARKET RESEARCH: Market research was completed by the program office from June 2018 – November 2018, confirming no other contractors are capable of providing the necessary support for the required PoP’s without a severe degradation or gap in service. Upon expiration on May 31, 2019, the Government will no longer have a need for these requirements.
7. ANY OTHER SUPPORTING FACTS: There are no other supporting facts.
8. ACTIONS THE AGENCY MAY TAKE TO REMOVE BARRIERS THAT LED TO THE
RESTRICTED CONSIDERATION:
(a) Procurement history: See Attachment 1
(b) These requirements are end-of-life, thus there is no need for this support after May 31, 2019.
(c) There were no previous awards that required an exception to fair opportunity under this requirement.
