You do this by: (a) Checking the SAM; or (b) Collecting a certification from that person; or (c) Adding a clause or condition to the covered transaction with that person. Before entering into a covered transaction with a participant at the next lower tier, you must require that participant to: (a) Comply with this subpart as a condition of participation in the transaction.
Contractor may do so by reproducing or adding this clause to the subcontract, (b) Pass the requirement to comply with this subpart to each sub-contractor with whom the participant enters into a covered transaction at the next lower tier.
16. The State grantor agency, the Department of Housing and Urban Development, the Comptroller General for the United States or any of their duly authorized representatives shall have access to any books, documents, paper and records of the contractor which are directly pertinent to this specific contract, for the purpose of audits, examinations and making excerpts and transcriptions.
17. All records connected with this contract will be maintained in a central location by the City of Bossier City for a period of three (3) years from the official date of close-out of the grant. No official of the Owner who is authorized in such a capacity and on behalf of the Owner to negotiate, accept, approve or to take part in negotiating, making, accepting or approving any architectural, engineering, inspection, construction or material supply contract or any subcontract in connection with the construction of the project, shall become directly or indirectly interested personally in this contract or in any part hereof. No officer, employee, architect, attorney, engineer or inspector of or for the Owner who is authorized in such capacity and on behalf of the Owner to exercise any legislative, executive, supervisory or other similar functions in connection with the construction of the project shall become directly or indirectly interested personally in this contract or in any part thereof or any material supply contract, subcontract, insurance contract, or any other contract pertaining to the project.
18. This instrument, which includes Part II General Conditions, Bid and Proposal with Work write-up, Project and Specifications, constitutes the entire agreement between the parties and no written or oral agreement of any kind exists to change the provisions hereof. No other work shall be done, nor additional funds paid, unless provided for in a previously written contract, signed by the parties hereto, and approved in writing by the City of Bossier City, Office of Community Development.
19. In the event there is any conflict between the provisions of this contract and the provisions of Exhibit “A”, the provisions of this contract shall, in all cases, prevail.
20. After rehabilitation, if a unit is sold or ownership transferred within five (5) years from the end of this lien period, the grant funds used to rehabilitate that unit must be pro-rated for the five (5) year period and that portion of time not lived in the house by the homeowner be converted to a dollar amount and returned to the City. (Example: A $10,000 rehabilitated unit sold after two (2) years would equate to $10,000 divided by 5 = $2000 per year or $4000 of grant money forgiven and $6000 of grant money returned to the City). If this should occur, you should notify the City immediately for instructions.
21. After rehabilitation, if a unit is refinanced within five (5) years from the end of this lien period, the grant funds used to rehabilitate that unit must be pro-rated over the five (5) year period and that portion of time not lived in the house by the homeowner be converted to a dollar amount and returned to the City (see above example) unless no payment of actual funds based on the equity are given to the homeowner. Refinancing to lower the mortgage payment, with no cash payout, is acceptable and in that case this lien may be subordinated to a new first mortgage.
22. The homeowner shall allow contractor to have total access to the home during normal working hours in order for the job to run smoothly and to cooperate with the Community Development Department and contractor; otherwise, Community Development will terminate the housing rehabilitation project.
23. If any lead hazards were discovered on the property during the initial inspection process, the homeowner may be requested to leave the property, depending on the work to be done, and then shall leave the premises and be relocated during the time that Lead Hazard Reduction work is being done on the property and shall not return until clearance testing is completed and meets the HUD standards; otherwise Community Development will terminate the housing rehabilitation project. Because lead dust, even in very small amounts, can cling to clothing and shoes and if carried from the work site, it can become a danger to other persons in other locations, especially young children.
