VI. Provide a detailed explanation of the criteria developed and specified by the agency as necessary to perform and/or fulfill the contract and upon which the state agency reviewed available sources. (Do not use “technical jargon;” use plain English. Do not tailor the criteria simply to exclude other contractors if it is not rationally related to the purpose of the contract.)
NMDWS developed the following minimum criteria necessary to fulfill the requirements of this contract:
1. The contractor must maintain a current Memorandum of Understanding (MOU) with Be Pro Be Proud, Inc. (BPBP) authorizing the contractor to operate the BPBP Mobile Workshop program. This requirement is necessary because the BPBP Mobile Workshop is a proprietary workforce development program operated under the authority and direction of BPBP. Contractors without authorization from BPBP are not permitted to operate the workshops or represent the program.
2. The contractor must have demonstrated experience managing and operating mobile educational outreach programs. Required experience includes transportation logistics, tour scheduling, mobile workshop operations, event coordination, and outreach activities at middle schools, high schools, community colleges, and statewide community organizations. This experience is necessary to ensure the contractor can effectively manage the statewide operational requirements of the BPBP program.
3. Contractor personnel responsible for transportation operations must possess valid Class A Commercial Driver’s Licenses (CDL) and experience operating a 53-foot tractor trailer. This requirement is necessary because the BPBP Mobile Workshop consists of a specialized 53-foot double-expandable trailer that must be safely transported, deployed, and operated throughout the state.
4. The contractor must have experience providing maintenance and operational support for specialized mobile workshop equipment, including trailer hydraulics, generators, audiovisual systems, simulators, and onboard connectivity systems.
Based on the agency’s review of available sources, SPEVCO, Inc. is the only contractor that satisfies all required criteria. SPEVCO, Inc. maintains the required MOU with BPBP, has direct operational experience managing BPBP Mobile Workshop programs in multiple states, and employs qualified personnel with the required Class A CDL credentials and operational expertise necessary to manage the specialized mobile workshop platform.
VII. Provide a detailed, sufficient explanation of the reasons, qualifications, proprietary rights or unique capabilities of the prospective contractor that makes their company the only source capable of providing the required professional service, general service, construction or item(s) of tangible personal property.
(Please do not state the source is the “best” source or the “least costly” source.
Those factors do not justify a “sole source.”)
SPEVCO, Inc. is the only contractor capable of providing the required services because it maintains an exclusive Memorandum of Understanding (MOU) with Be Pro Be Proud, Inc. (BPBP) authorizing SPEVCO, Inc. to serve as the sole nationwide operator of the BPBP Mobile Workshops.
Under this exclusive agreement, SPEVCO, Inc. has the proprietary authority to manage, transport, maintain, and operate the BPBP Mobile Workshop program nationwide. No other contractor has authorization from BPBP to operate the workshops or provide official BPBP Mobile Workshop tour management services.
In addition to its exclusive authorization, SPEVCO, Inc. possesses specialized operational knowledge and experience directly related to the BPBP Mobile Workshop program. SPEVCO currently operates BPBP Mobile Workshops in multiple states, including Alabama, Arkansas, Georgia, New Mexico, North Carolina, South Carolina, Tennessee, and Texas.
Through its ongoing operations, SPEVCO has developed expertise in:
• Operation of the specialized 53-foot double-expandable BPBP trailer;
• Tour scheduling and statewide logistics coordination;
• Preventative maintenance and repair of BPBP-specific mobile workshop systems;
• Generator, simulator, and connectivity operations;
• Event deployment and setup procedures;
• Workforce outreach event coordination; and
• Training and support for program ambassadors and operators.
Because BPBP has granted SPEVCO exclusive operational authority for the BPBP Mobile Workshops, and because SPEVCO possesses the specialized experience and institutional knowledge necessary to operate the proprietary mobile workshop program, no other contractor is authorized or capable of providing the required services.
VIII. Provide a detailed, sufficient explanation of how the professional service, general service, construction or item(s) of tangible personal property is/are unique and how this uniqueness is substantially related to the intended purpose of the contract.
During the 2024 legislative session, the Legislature appropriated funding through House Bill 2 (HB2) to the New Mexico Department of Workforce Solutions (NMDWS) to support workforce development initiatives, including employment case management and apprenticeship-related outreach activities.
As part of this initiative, NMDWS is implementing the Be Pro Be Proud (BPBP) program to introduce students and job seekers to technical and skilled trade careers through interactive mobile workshop experiences that incorporate simulators, audiovisual technology, and hands-on career exploration activities.
The BPBP Mobile Workshop is a specialized and proprietary workforce development platform designed specifically for career outreach and workforce engagement. The mobile workshop consists of a customized 53-foot double-expandable trailer equipped with industry-specific simulators, educational exhibits, audiovisual systems, generators, and connectivity infrastructure designed to support workforce development programming at schools and community events statewide.
The intended purpose of this contract is to provide statewide operation, transportation, maintenance, and deployment of the BPBP Mobile Workshop in support of New Mexico workforce development goals, including:
• Expanding awareness of skilled trades and technical careers;
• Increasing workforce participation among students and underserved populations;
• Supporting apprenticeship and career pathway development; and
• Aligning workforce training opportunities with employer needs.
SPEVCO, Inc.’s services are unique because SPEVCO is the exclusive authorized operator of the BPBP Mobile Workshops nationwide and possesses the specialized operational expertise required to safely and effectively manage the proprietary BPBP platform.
SPEVCO’s unique qualifications include:
• Exclusive authorization from BPBP to operate the mobile workshops;
• Experience operating BPBP Mobile Workshops in multiple states;
• Specialized expertise operating and maintaining the BPBP trailer systems and equipment;
• Experience managing statewide tour logistics and workforce outreach events; and
• Qualified personnel with the required CDL licensing and operational experience.
These unique capabilities are substantially related to the purpose of the contract because operation of the BPBP Mobile Workshop requires specialized authorization, training, equipment knowledge, and operational experience that are specific to the BPBP program and not generally available through other vendors.
IX. Provide a narrative description of the agency’s due diligence in determining the basis for the procurement, including procedures used by the agency to conduct a review of available sources such as researching trade publications, industry newsletters and the internet; contacting similar service providers; and reviewing the State Purchasing Divisions’ Statewide Price Agreements. Include a list of businesses contacted (do not state that no other businesses were contacted), date of contact, method of contact (telephone, mail, e-mail, other), and documentation demonstrating an explanation of why those businesses could not or would not, under any circumstances, perform the contract; or an explanation of why the agency has determined that no businesses other than the prospective contractor can perform the contract.
NMDWS contacted several specialty vehicle manufacturers and mobile operations providers to determine whether other vendors could provide the required operational services for the Be Pro Be Proud Mobile Workshop program. Through this review, NMDWS determined that the vendors contacted were not authorized or capable of providing the specialized operations and management services required for the BPBP Mobile Workshops in the same manner as SPEVCO, Inc.
NMDWS also conducted additional research regarding companies that maintain a Memorandum of Understanding (MOU) with Be Pro Be Proud, Inc. (BPBP). As part of this process, NMDWS contacted BPBP directly and obtained documentation confirming BPBP’s MOU with SPEVCO, Inc. In a letter dated September 1, 2022, BPBP confirmed SPEVCO, Inc.’s proprietary rights and exclusive authorization to manufacture and operate licensed Be Pro Be Proud Mobile Workshops nationwide.
Due to SPEVCO, Inc.’s demonstrated ability to custom-produce mobile workshops that meet the specialized requirements of the Be Pro Be Proud program, along with the quality of support and operational services provided since 2019, the Be Pro Be Proud, Inc. Board of Directors approved a Memorandum of Understanding designating SPEVCO, Inc. as the exclusive nationwide fabricator and operator of Be Pro Be Proud Mobile Workshops.
