Section I - Introduction
Overview
A. Agency Information
The U.S. Railroad Retirement Board (“RRB”) is an independent federal agency that administers a retirement and survivor benefit program for railroad employees and their families. The RRB was established by the Railroad Retirement Acts of 1937 and 1974. Its benefit program was the forerunner of the more familiar Social Security System. The Railroad Retirement System is unique inasmuch as it is the only federally administered benefit program covering a single private industry. The RRB also administers the Railroad Unemployment Insurance Act, which provides unemployment and sickness benefits to railroad employees. The RRB’s headquarters, is located in Chicago, Illinois. The RRB has a national network of 53 field offices.
B. Objective
The RRB seeks the services of a group of licensed physicians (ref: Section III.D.) who shall provide services for the Disability Benefits Division (DBD). Required services are detailed in the following sections and include: (1) providing medical expertise, advice and consultation in the area of disability benefit and claim matters, (2) preparing advisory medical opinions for all bureaus and offices of the RRB and (3) providing training to the disability staff as required.
C. Background
1. DBD is responsible for making agency decisions related to disability-based benefits under the Railroad Retirement Act (RRA), the Social Security Act (SSA). Similarly, RRB examiners make certain medical decisions IAW aspects of the sickness program under the Railroad Unemployment Insurance Act. The division is responsible for communicating these decisions in language understandable to the public.
2. The Disability unit is comprised of two determination sections (including clerical staff who perform functions for all parts of the office), where medical and vocational expertise is combined to provide claim decisions and advice.
3. Disability entitlement under the Railroad Retirement Act (RRA) may exist based on total disability, with medical and vocational factors considered, for railroad employees, their widows, or their children whom suffer onset of disability prior to the age of 22.
In addition, entitlement is possible if an employee who meets certain age and/or service requirements is unable to perform their regular occupation.
4. Initial medical and vocational evidence development related to disability claims is the joint responsibility of the RRB’s Field Service and Headquarters staff. The development includes accumulation of all pertinent existing medical records (hospital, clinic, etc.), a report from the applicant’s personal physician, and, when appropriate, consultative examinations and ancillary tests arranged by a disability examination services contractor at the request of RRB staff.
5. DBD is involved in requesting and reimbursing claims related and professional services required in connection with the disability program. A number of guides are available and utilized in the claim evaluation including the Railroad Retirement Act, Social Security Act, and Code of Federal Regulations.
6. By its nature, the disability claim workload is difficult to predict. RRB offers the following information to aid interested parties in making projections:
a. In Fiscal Year 2018, there were about 990,000 persons on RRB’s rolls, receiving benefits because of disability. New applications from employees, widow(er)s and children for disability-based benefits under the Railroad Retirement Act currently average about 2100 per year.
b. In the some cases, determination of entitlement is made with both the Railroad Retirement and Social Security Acts.
c. In Fiscal Year 2019, RRB requested approximately 2000 medical opinions. Based on experience and current workloads, RRB expects to request, but does not guarantee, medical opinions for approximately 1700 cases per year to be rendered on disability claims.
i. Approximately 15% (250 cases) opinions may be required for mental impairments.
ii. Approximately 65% (1100 cases) opinions may be required for physical impairments.
iii. Approximately 20% (340 cases) opinions may require a simultaneous mental and physical assessment.
7. Disability claims are most commonly related to cardiovascular, musculoskeletal, mental or neurological impairments. Very often, claims are based on a combination of impairments.
D. Questions pertaining to this solicitation must be submitted in writing and received by this office in sufficient time to allow the timely transmission of written answers by solicitation amendment. To ensure this, the RRB will only answer questions received in this

Section III - Statement of Work
SOW
A. Background & Objectives
Under the current contract, the contractor provides consultative medical opinions with the combination of remote and on-site services at the U.S. Railroad Retirement Board headquarters, located at 844 N. Rush St., Chicago, IL 60611. The incumbent contractor currently provides the case-related services with the qualified physician resources remotely. This same contractor provides other medical professional advisory services, including training and direct advice to claims examiners, on-site at RRB headquarters. While conducting operations during the Covid-19 pandemic, RRB authorized remote performance of the above described on-site services.
RRB requires on-site performance for other professional medical advisory services. These services will resume under the anticipated contract when requested by the RRB and will be conducted twice a week for up to eight hours per week at a minimum. The RRB anticipates requesting on-site non-case related services when the RRB’s CMO is out on scheduled leave, or when specific medical specialty training is required. The RRB is willing to accept proposals that consist of alternative methods for conducting case review and consultation, including digital conversion of case files and subcontracting with local physicians. All proposals offering alternative methods to provide consultative medical opinions must meet the requirements of this solicitation and the privacy and security clauses outlined later in this document.
B. Operational Activities
1. Claims Related Services
The Contractor must provide licensed physicians who are knowledgeable of both the Railroad Retirement Act (RRA), the Social Security Act (SSA), and conversant with the many and varied fields of medicine. Attachments 6 and 7, Section VII, are examples of the detailed information required in the consultative medical opinions provided by the contractor based on their review of the medical evidence. These reviews may be related to initial determinations, reconsideration determinations, appeal determinations, continuing entitlement determinations, or quality assurance. Reconsideration and appeal cases must be reviewed by a physician who was not involved in the prior determinations for the same individual.
a. Consultative Medical Opinions must include:

3) A complete, comprehensive and appropriate residual functional capacity (RFC) assessment (also known as the rationale of any restrictions) based on the medical evidence in file and considering RFC assessments from treating or consulting physicians (Reference 20 CFR 220.120 and 220.121a);
4) The resolution, if possible, of conflicting or deceptive evidence and opinions (Reference 20 CFR 220.112(e));
5) The Contractor shall answer specific questions as they arise in the course of case reviews by disability examiners and others.
6) A reasonable disability onset date based on the medical evidence of record, including dates of changes in the severity level of the impairment;

9) The recommendation for additional medical evidence or consultative medical examinations when a medical assessment cannot be provided based on the information in file or if needed for resolution of conflicting evidence and/or opinions. In occupational disability cases, this can include but is not limited to Functional Capacity Examinations. (Reference 20 CFR 220.13(b)(2)(iv)(C) and 220.112(d));
b. The Contractor shall render the consultative medical opinions described above within the timeframes below.
1) Standard opinions within four (4) business days, i.e. opinions requested on Monday are due on Friday. The RRB shall have sole authority in determining acceptability of medical opinions.
2) Urgent opinions identified by RRB personnel will be completed within two (2) business days, i.e. opinions requested on Monday are due on Wednesday. Approximately 10% of cases will be deemed “urgent”.
3) The Contractor shall achieve these timeliness standards in at least 95% of the cases. 3. Expert Testimonial/Affidavit Opinions
When live testimony or a sworn evidentiary affidavit by a licensed physician is requested by the RRB, the Contractor will provide the requested expert affidavit or make the requested expert available for testimony within timeframes specified in the RRB’s request, but the Contractor must acknowledge receipt of the RRB’s request within 3 business days.
4. Optional Other Medical Professional Services
The Contractor shall provide trained physicians and staff who in the past have trained non-medical professionals at all levels of expertise.
The Contractor shall render optional non-case related other Medical Professional Services when and as requested by the RRB. These activities include, but are not limited to the following:
a. Introductory Disability Examiner Training
Since 2016, the Disability Benefit Division has historically conducted an introductory Disability Examiner Training biennially. Each training had less than 10 participants. The training has been conducted over a two-week period. Each day’s training consisted of a pre-approved topic and agreed upon time. See attachment 5 titled Sample Training Outline.
1) Conduct medical training sessions for new or newly-promoted disability examiners as needed while these examiners are training.
2) Training can be in-person or via live video conferencing by qualified staff. The Contractor shall provide trained physicians and staff who in the past have trained non-medical professionals at all levels of expertise.
3) Each training class of new disability examiners requires approximately 30 hours of medical training including allotted time for DBD examiner questions and Instructor answers. The RRB may order contractor services to provide some of this training.
4) Training must include visual aids, address all requested objectives, and be consistent with both the Railroad Retirement Act and the current listings covered by the Social Security Act. Training objectives may include but are not limited to, body system structure, body system functionality, medical tests and results related to the body system, and associated limitations (i.e. residual functional capacity) and impact onto other body systems.
