SOLE SOURCE JUSTIFICATION
For Purchase and Installation of New Cubicle Parts, Reconfiguration of Existing Parts and Teardown of existing parts.
This Sole Source Justification is provided as required by FAR Part 6.302.1(c).
(1) IDENTIFICATION OF THE AGENCY AND THE CONTRACTING ACTIVITY.
Railroad Retirement Board (RRB), Acquisition Management - Procurement
(2) NATURE AND/OR DESCRIPTION OF THE ACTION BEING APPROVED.
This action is requested for a brand name purchase Trendway collaborative workspace parts and design/installation services., to include all purchased parts and labor to reconfigure the space within the Bureau of Fiscal Operations (BFO). Only Trendway purchased parts are compatible with the existing workspace parts residing in BFO, which were also procured from Trendway. The RRB anticipates issuing a firm-fixed price contract to purchase the brand name equipment and related support. The requested parts and services represent an expansion of the GSA FIT program products and services procured in recent years for BFO. Procurement of brand name parts and related labor is essential to the Government’s continuing requirements and thereby precludes consideration of a product manufactured by another company, as parts from any other manufacture will not match and/or physically connect with existing cubicle parts.
(3) A DESCRIPTION OF THE SUPPLIES OR SERVICES REQUIRED TO MEET THE
AGENCY'S NEEDS (INCLUDING THE ESTIMATED VALUE OF ACTION).
RRB’s, BFO, seeks to reconfigure, add, change and delete from one of its collaborative workspace area with an estimated purchase and installed cost of $30,000.00 which includes approximately $7-9,000 for labor/installation of all parts. The original acquisition of the overall office space reconfiguration in 2015 was procured and provided by GSA as part of the FIT program. Therefore, the RRB has to utilize these products for compatibility and fit. The initial acquisition costs were $263,625.50
(4) A DEMONSTRATION OF THE PROPOSED CONTRACTOR'S UNIQUE
QUALIFICATIONS OR THE NATURE OF THE ACQUISITION REQUIRES USE
OF THE AUTHORITY CITED.
Trendway Corp, has existing computer-aided drafting/drawings (CADD) of the particular area in which RRB, BFO intends to alter with new parts and/or reconfigure with existing parts and/or teardown current configuration. OfficeSpace Inc. was the original designer and seller of the existing configuration using Trendway Corp as the provider of the supplies and services. Purchasing and obtaining cubicle parts and installation services exclusively from Trendway Corp excludes RRB from purchasing CADD services from other potential vendors. In today’s market RRB’s Property Manager estimates that new CADD services and blueprints would cost an additional $5,000.00 for the particular area to be reconfigured
The RRB has determined that a firm-fixed price contract issued to Trendway Corp for the brand name parts, design CADD services, and installation services, as stated above, is essential to the Government’s requirements, thereby precluding consideration of services by another company.
(5) A DETERMINATION BY THE CONTRACTING OFFICER THAT THE
ANTICIPATED COST TO THE GOVERNMENT WILL BE FAIR AND
REASONABLE.
Based on recent acquisitions of like or similar products and services from both OfficeSpace, Trendway, Corporate Concepts and other like vendors, the Contracting Officer has determined the price to be fair and reasonable. This price analysis also includes a comparison of the costs for the original requirement, adjusted for changes in the marketplace.
(6) A DESCRIPTION OF THE MARKET RESEARCH CONDUCTED AND THE
RESULTS OR A STATEMENT OF THE REASON MARKET RESEARCH WAS
NOT CONDUCTED.
RRB’s market research reflected, as stated above, that no other firms can provide compatible products meeting the specifications required to complete the reconfiguration.
Therefore, recommend using Trendway Corp. to provide the required products and services to fulfil the requirement.
(7) ANY OTHER FACTS SUPPORTING THE USE OF OTHER THAN FULL AND
OPEN COMPETITION.
None
(8) A LISTING OF THE SOURCES, IF ANY, THAT EXPRESSED IN WRITING, AN
INTEREST IN THE ACQUISITION.
None
(9) A STATEMENT OF THE ACTIONS, IF ANY, THE AGENCY MAY TAKE TO
REMOVE OR OVERCOME ANY BARRIERS TO COMPETITION BEFORE ANY
SUBSEQUENT ACQUISITION FOR THE SUPPLIES OR SERVICES
REQUIRED.
RRB will continue to research industry standards and similar products that can meet RRB furnishings and workspace needs.
