15-118 Report 1 November 2015
1.0 SUMMARY
This report presents the findings of a Phase I Environmental Site Assessment (ESA) for the Former Bluffs Apartments site on Victoria Street in Hopewell, Virginia (the subject property). The subject property is one Parcel (Parcel # 061-0351) with a property address of 600 Victoria Street.
The site was vacant at the time of this report with no structures and consisting primarily of asphalt parking areas and concrete sidewalks. Victoria Street bisects the developed portion of the lot. The property was historically an undeveloped wooded lot until 1984 when ten apartment buildings and an administrative building with asphalt parking areas were built. The buildings were subsequently demolished in 2008 and the property has remained vacant since that time.
This ESA was performed by EEE Consulting, Inc. (EEE) for the City of Hopewell, who may utilize federal brownfield grant funding administered by the City of Hopewell to perform additional investigation and cleanup of any recognized environmental conditions discovered at the subject property. Therefore, the City of Hopewell is the User of this Phase I ESA per 40 Code of Federal Regulations (CFR) § 312.1(b) (2). EEE has performed this Phase I ESA of the subject property in conformance with the scope and limitations of the “American Society for Testing and Materials (ASTM) Standard E1527-13, Standard Practice for Environmental Site Assessments: Phase I Environmental Site Assessment Process” and the U.S. Environmental Protection Agency (EPA) All Appropriate Inquiry (AAI) Rule (40 CFR Part 312).
The objective of this Phase I ESA is to conduct AAI into the previous ownership and uses of the subject property consistent with good commercial or customary practice as defined in Comprehensive Environmental Recovery, Compensation, and Liability Act (CERCLA), 42 ESC Section 9601(35)(B) and identified in the ASTM Standard Practice for Environmental Site Assessments: Phase I Environmental Site Assessment Process, E1527-13.
Available public information, including historical aerial photographs, Sanborn maps, and interviews with persons familiar with the subject property, and documents on file with federal, state and local regulatory agencies was compiled and reviewed to meet the project objective.
EEE personnel conducted a site reconnaissance of the subject property on July 28, 2015. The site reconnaissance included walking the subject property, as well as a pedestrian and windshield inspection of the surrounding area, which primarily consists of residential development. Parcels adjacent to the subject property include residential houses and an apartment complex.
15-118 Report 2 November 2015
From the available public information reviewed and the site reconnaissance, one current recognized environmental condition (RECs) was identified for the subject property: potential sediment contamination in the Appomattox River on the northern property boundary, and the un-named tributary to the Appomattox River on the western property boundary of the subject property. If the subject property is to be developed in such a way as to include construction of any piers, pedestrian bridges/trails, etc. in or near the two rivers on the subject property, management of potentially contaminated sediment will need to be addressed.
2.0 INTRODUCTION
This report presents the findings of a Phase I ESA of the Former Bluffs Apartments at 600 Victoria Street in Hopewell, Virginia (the subject property). Figure 1 in Appendix A shows the location of the subject property.
The subject property was vacant with no structures at the time of this report. The central portion of the subject property was formerly developed as an apartment complex in 1984. The apartment buildings were demolished in 2007 and the debris was apparently taken off-site. The formerly developed portion of the property now consists of concrete sidewalks and asphalt parking areas.
Victoria Street bisects the developed portion of the lot. Several electrical transformers, utility easements, stormwater curb inlets and subsurface drainage pipes remain intact. The eastern, western, and northern portions of the subject property are wooded, and the property is bordered by apparent Waters of the U.S. to the west and the Appomattox River to the north.
2.1 Purpose
The objective of this Phase I ESA is to conduct All Appropriate Inquiry (AAI) into the previous ownership and uses of the property consistent with good commercial or customary practice and ASTM Standard E1527-13. The City of Hopewell is utilizing federal brownfield grant funding to identify and assess RECs at the subject property and surrounding properties with regard to potential impacts to human health and the environment prior to potential redevelopment of the subject property.
According to the ASTM Standard, a REC is defined as:
Recognized Environmental Conditions – the presence or likely presence of any hazardous substance or petroleum products in, on, or at a property: (1) due to release to the environment;
15-118 Report 3 November 2015
(2) under conditions indicative of a release to the environment; or (3) under conditions that pose a material threat of a future release to the environment. De minimis conditions are not recognized environmental conditions.
Specific objectives of this investigation include the following:
1. Identification and documentation of past and present activities at the subject property that may have resulted in potential impacts to the environment.
2. Identification and documentation of past or present activities at adjacent properties that may pose an environmental risk to the subject property.
2.2 Detailed Scope-of-Services
The following general work tasks were performed to meet the project objectives:
1. Compilation and review of public information on the history of the subject property and nearby properties.
2. Compilation and review of information on file with appropriate federal, state, and local environmental regulatory agencies.
3. Field survey of the subject property and surrounding areas.
4. Interviews with present owners, occupants and persons knowledgeable of the subject property.
2.3 Significant Assumptions
It is assumed that the information provided to EEE by the City of Hopewell and government officials is accurate and up to date.
2.4 Limitations and Exceptions
In addition to the limitations set forth in various sections of the ASTM Standard E1527-13 protocol, the accuracy and completeness of this report is necessarily limited by the following:
Limitations and Exceptions Yes No Access Limitations X Physical Limitation to observations (i.e. snow, rain, asphalt, buildings, etc.) X Information requested but not available at time of report preparation X Unique limitation not specified in ASTM Standard. X Data Failure X
15-118 Report 4 November 2015
2.5 Special Terms and Conditions
This Phase I ESA was performed in accordance with ASTM E1527-13 Standard Practice for Environmental Site Assessments. No special terms or conditions apply to this Phase I ESA.
2.6 User Reliance
This ESA was performed by EEE for the benefit of City of Hopewell, based on available data at the time this report was prepared. This report provides no warranties for use or reliance by other parties.
3.0 SITE DESCRIPTION
3.1 Location and Legal Description
The following subject property location and legal description was taken from the City of Hopewell Real Estate website:
Property Identification: 061-0351 Address: 600 Victoria Street Legal Description: Lot 4, Block 24 Dolin, Subdivision: Miscellaneous Acreage Size: 11.91 acres/518,800 square feet
3.2 Site and Vicinity General Characteristics
Topography at the subject property is approximately 50-feet above mean sea level (msl) (see Figure 2). The topography of the Coastal Plain province is a terraced landscape that stair-steps down to the coast and to the major rivers. According to the Hopewell, Virginia USGS topographic map, the Appomattox River and an unnamed tributary are the closest bodies of water, defining the north and western borders of the subject property, respectively.
According to the FEMA Flood Map Service Center (Panel No. 5100800016D), low-lying portions of the subject property are within the Federal Emergency Management Agency (FEMA) 100-year floodplain.
Adjacent properties are developed as residential. The subject property and surrounding area is zoned R4 (Residential, Medium Density), which includes single-family homes, multi-family residences, and second story apartment dwelling units.
15-118 Report 5 November 2015
According to the U.S. Department of Agriculture’s Web Soil Survey, soil present on the subject property is classified as Wickham (60%) and Emporia (40%), both fine sandy loams. Neither drainage nor restrictive features are described for either soil classification.
Based on published reports (i.e., “Geologic Map of Virginia; USGS, 1989), the uppermost geologic unit at the subject property is the Cretaceous-age Potomac Formation. The Potomac Formation consists of interbedded fine- to coarse-grained sands, some pebbles and minor amounts of clay and silt.
The Coastal Plain aquifer system in Virginia consists of an eastward-thickening wedge of unconsolidated to partly consolidated sediments of Cretaceous, Tertiary, and Quaternary age that, which attains a thickness of over 4,000 feet near the Atlantic coast. Older crystalline bedrock of the Piedmont underlie the Coastal Plain sediments. Groundwater occurs under water table conditions within the Potomac Formation, which is considered part of the Surficial Aquifer. Ground water is recharged principally by precipitation infiltration. The water table generally mirrors the surface topography. Groundwater flow within the Surficial Aquifer is generally toward the east-northeast toward the Appomattox and James Rivers. Vertical hydraulic gradients within the Surficial Aquifer are generally downward as leakage from the Surficial Aquifer recharges the deeper confined Coastal Plain aquifers.
3.3 Current Use of the Property
Property is currently vacant and unused.
3.4 Description of Site Improvements
Improvements on the subject property consist of asphalt roadways and parking areas, stormwater draining infrastructure and concrete sidewalks. Several electrical transformers were observed on the property as well.
Electricity, sewage, and water are available and provided by the appropriate public utility providers for future development of the property. There was no evidence of any water supply wells or septic systems on the subject property.
3.5 Current Uses of Adjoining Properties
Immediately north of the subject property runs the Appomattox River. Adjacent to the subject property to the east are the Riverside Park Apartments. A ravine and residential dwellings lie immediately to the west. South of the subject property is Woodbine Street, with all of the
15-118 Report 6 November 2015 surrounding area comprised of residential dwellings. No commercial businesses (current or former) operate in areas immediately adjacent to the subject property. An aerial photograph identifying the adjoining properties is presented as Figure 3 in Appendix A.
4.0 USER PROVIDED INFORMATION
4.1 Title Records
A title record search was performed by Quality Title Services, LTD (QTS). The report dated October 16, 2015 indicates the subject property is owned by the City of Hopewell, dated May 24, 2007. The subject property was transferred to the City of Hopewell by The Bluffs Limited Partnership. The subject property had been owned by The Bluffs since 1982, when it was purchased from Roy M. and Kathryn H. Hunter. A copy of the deed record report is included in Appendix B.
4.2 Environmental Liens/Activity and Use Limitations
The legal descriptions and City of Hopewell real estate records of the subject property, did not indicate the existence of any environmental liens or activity and use limitations. Any other documents filed or recorded in any other place were not considered to be reasonably ascertainable.
4.3 Valuation Reduction for Environmental Issues
No information was obtained indicating a valuation reduction due to environmental issues. The City of Hopewell indicated the sale price reasonably reflects the fair market value. Appendix F has the completed questionnaire which addresses the value of the property.
4.4 Owner, Property Manager & Occupant Information
The subject property is currently owned by the City of Hopewell. Mr. Benjamin Leach, representative for the City of Hopewell provided background information and access to the subject property (see Section 7.1).
4.5 Reason for Performing Phase I
This Phase I ESA was performed on behalf of the City of Hopewell (the User) prior to the adaptive reuse of the property, in accordance with 40 CFR § 312.1(b)(2): to identify potential RECs when utilizing federal brownfield grant funding for characterization and cleanup of any potential RECs.
15-118 Report 7 November 2015
5.0 RECORDS REVIEW
5.1 Standard Environmental Record Sources
The current and past regulatory status of the subject property and nearby properties was determined by a review of information on file with the EPA, the City of Hopewell and the Virginia Department of Environmental Quality (DEQ).
A records search performed by Environmental Data Resources, Inc. (EDR) of Southport, Connecticut was also reviewed. The search distance satisfies the “appropriate minimum search distance” requirement of the ASTM standard. The search distances for each database reviewed are in the EDR report (see Appendix C).
The subject property was not listed in any of the databases searched by EDR.
The EDR report identified no sites within the ASTM search radius for the following databases: Federal National Priorities List (NPL), Federal Comprehensive Environmental Recovery, Compensation, and Liability Information System (CERCLIS), RCRA large quantity generator (RCRA-LQG), RCRA small quantity generators (RCRA-SQG), RCRA conditionally exempt small quantity generators (RCRA- CESQG), RCRA Corrective Action Report (CORRACTS), Facility Index System Registry (FINDS), Federal Emergency Response Notification System (ERNS) sites, Engineering Controls Sites List (US ENG CONTROLS), Aboveground Storage Tank (AST) sites, Voluntary Remediation Program, or Brownfields Site Specific Assessments.
The EDR report identified two SPILLS facility within ½-mile of the subject property: (1) Hopewell Marina at 1051 Riverside Drive and (2) the Stephen Pettler property at 113 N 14th Street. The DEQ’s Pollution Response Program (PREP) provides for responses to air, water, and waste pollution incidents in order to protect human health and the environment. PREP staff often work to assist local emergency responders, other state agencies, federal agencies, and responsible parties, as may be needed, to manage pollution incidents. Oil spills, fish kills, and hazardous materials spills are examples of incidents that may involve the DEQ’s PREP Program. According to the EDR report, in July 2002 a boat sank beside the Hopewell Marina in the Appomattox River, releasing oil. The boat owner was advised to clean up the spill, and the report was closed. Based on the location of this site relative to the subject property, the status of the SPILL report as ‘closed’, and the fact that the release was surficial and downstream, it is not anticipated to significantly impact the subject property. In April of 2009, a 50-gallon home heating oil tank filled with kerosene fell over on Stephen Pettler’s property approximately ½ mile from the subject property. The spill was referred for remediation and the report was closed.
15-118 Report 8 November 2015
The EDR report identified thirteen leaking underground storage tank sites (LUST/LTANKS) listed on the Virginia DEQ database within the ASTM search distance of ½-mile. The Debbie Gargis Residence was only reported in the LTANKS database; all other records were found on both the LUST and LTANKS databases. These LUST/LTANKS sites are summarized in the following Table 2, none of which are adjacent to the subject property.

The EDR report identified no registered UST facility within a search distance of ¼-mile.
The EDR report identified one public water supply well approximately ½-mile from the subject project; well ID VA3149240. However, the mapped location shown on the EDR report is incorrect.
The physical address given for the well is 1100 River Road which is more than 2 miles from the subject site.
The EDR report identified 10 orphan sites, which were unmappable due to insufficient address information. EEE personnel located these properties and determined four of the orphan sites are greater than 1-mile and thus outside of the search radius from the subject property. Three of the orphan sites are located greater than ½ mile and east-southeast of the subject property. The remaining three orphan sites are located greater than ¼-mile and east of the subject property adjacent to the Appomattox River. Groundwater in the vicinity of the orphan sites within the search radius likely flows north-northeast toward the Appomattox River and away from the subject property.
15-118 Report 9 November 2015
5.2 Additional Environmental Records
The James River, Appomattox River, and tidal tributaries to these rivers in the Hopewell area have a long history of industrial contamination due to the dumping of Kepone, also known as chordecone, a toxic, nonbiodegradable insecticide which was dumped into the James River from 1966 until 1975.
The Virginia Department of Environmental Quality (DEQ) and the Virginia Department of Health (VDH) have been periodically monitoring the fish and sediment in the James River and the mouth of the Appomattox River since 1975. Kepone contamination levels have decreased significantly since 1975 in both the sediment and fish tissue, but low levels of kepone are still detected. In addition, DEQ and VDH also monitor fish and sediment for PCB contamination.
The Virginia Department of Health currently has a Fish-Eating Advisory for the James River, Appomattox River, and tidal tributaries to these rivers in the Hopewell, area. The advisory is due to PCB and Kepone contamination. The VDH Fish advisory can be found at:
http://www.vdh.state.va.us/epidemiology/DEE/publichealthtoxicology/Advisories/JamesRiver.htm
The last sediment sampling event reported by DEQ was conducted in 2004 and PCB levels were reported above the National Oceanic and Atmospheric Administration (NOAA) Effects Range. The source of the PCB sediment contamination is not known. The DEQ monitoring data can be found at:
http://www.deq.state.va.us/Programs/Water/WaterQualityInformationTMDLs/WaterQualityMonit oring/FishTissueMonitoring/KeponeFishData.aspx
5.3 Physical Setting Sources
The Physical Setting of the subject property is noted in the previous Section 3.2. The following sources were used to characterize the physical setting of the subject property:
• The City of Hopewell Property Lookup Website
• USGS Topographic Maps
• USGS and USDA Soil Conservation Service aerial photographs
• Google Earth
• Geologic Maps of Virginia
5.4 Historical Use Information on the Property
A limited history, ownership and usage of the subject property and surrounding properties was developed through information provided by the User, the owner, people familiar with the subject http://www.vdh.state.va.us/epidemiology/DEE/publichealthtoxicology/Advisories/JamesRiver.htm http://www.deq.state.va.us/Programs/Water/WaterQualityInformationTMDLs/WaterQualityMonitoring/FishTissueMonitoring/KeponeFishData.aspx http://www.deq.state.va.us/Programs/Water/WaterQualityInformationTMDLs/WaterQualityMonitoring/FishTissueMonitoring/KeponeFishData.aspx
15-118 Report 10 November 2015 property, aerial photographs, historic topographic maps, and publicly available historic sources.
Historic topographic maps (from 1894 and 1994) and historical aerial photographs (from 1959 through 2012) were reviewed. Ben Leach indicated the subject property was undeveloped until the apartment complex was developed in 1984.
Historic topographic maps were available from 1894 to 1994. The subject property appears unchanged and undeveloped until 1987 when Victoria Street was extended, allowing access to the subject property. The historical topographic maps are included in Appendix D.
Historical aerial photographs were reviewed from 1959 to 2015. The aerial photos reveal the following:
• The subject property was a heavily wooded lot for much of its history, with no visible structures present.
• Between 1980 and 1984, the land was cleared and ten multi-story apartment buildings with parking areas and an administrative building were constructed.
• The buildings were leveled prior to the 2009 aerial photograph.
• No further development of the property is shown following 2009.
5.5 Historical Use Information on Adjoining Properties
As mentioned in Section 5.3, historical topographic maps and aerial photos were reviewed for dates ranging from 1894- 2009. These sources revealed the following:
• Historical topographic maps indicate little or no major development in the vicinity of the subject property.
• Historic aerial photos indicate that property immediately east of the subject property was cleared farmland from 1937 to approximately 1963. In approximately 1963, several buildings (the Riverside Apartments) are seen on the southern portion of the former farm property.
• Between 1948 and 1959, several new residences were created to the west of the of the subject property, across the ravine.
6.0 SITE RECONNAISSANCE
6.1 Methodology and Limiting Conditions
Paul Leeger and Jennifer Lightfoot from EEE conducted the site reconnaissance on July 28, 2015.
Photographs taken during the site visit are presented in Appendix E. Mr. Leeger and Ms. Lightfoot made a visual inspection of the land and the structures present on the subject property, and walked
15-118 Report 11 November 2015 the perimeter of the adjoining properties. A “drive-by” reconnaissance of the area immediately around the subject property and adjoining properties was also conducted along the public roads.
6.2 General Site Setting
The subject property is located west of downtown Hopewell, Virginia along the Appomattox River.
The subject property was vacant at the time of the site reconnaissance. The formerly developed portion of the property now consists of concrete sidewalks and asphalt parking areas and Victoria Street bisects the lot. Several electrical transformers, utility easements, stormwater curb inlets and subsurface drainage pipes remain intact. The eastern, western, and northern portions of the subject property are wooded, and the property is bordered by apparent Waters of the U.S. to the west and the Appomattox River to the north. The southeastern portion of the subject property borders Riverside Park Apartments.
6.3 Exterior Observations
The subject property is a vacant lot with several paved areas and large patches of overgrowth, and has been abandoned. The table below is a summary of the exterior observations

7.2 Interviews with Property Owner
Mr. Ben Leach, a Stormwater Systems Management Engineer for the City of Hopewell, was interviewed via telephone by Paul Leeger on October 22, 2015. According to Mr. Leach, the property was originally developed in the 1980s as a multi-family apartment complex. Mr. Leach also stated the subject property was acquired by the City of Hopewell in 2005 or 2006 following foreclosure by the former owner’s lender, BB&T bank. After the City acquired the property, the City promptly demolished all buildings on the premises Mr. Leach indicated he had no knowledge of current or historical petroleum or other chemical releases, spills, or storage on the subject property.
7.3 Interview with Current Tennant
The subject property is currently vacant.
15-118 Report 13 November 2015
7.4 Interviews with Adjacent Property Owners
Riverside Park Apartments is a multi-family apartment complex located immediately adjacent to the southeast property boundary of the subject property. Ms. Penny Gasparac, the property manager for Riverside Park Apartments, was interviewed via telephone by Paul Leeger on November 2, 2015.
According to Ms. Gasparac, the buildings on the subject property were demolished to curtail the high crime occurring after the subject property was vacant. Ms. Gasparac indicated she had no knowledge of current or historical petroleum or other chemical releases, spills, or storage on the subject property.
7.5 Interviews with Past Property Owners
The past property owners were not available for interview.
7.6 Interviews with Others
No other persons were interviewed as part of this Phase I ESA.
8.0 FINDINGS
The subject property was not listed in any of the databases searched by EDR. There were no violations reported and no Activity Use Limitations (AUL’s) were identified in connection with the subject property.
The following summarizes pertinent findings during the performance of this Phase I ESA:
• The subject property was not listed in the any of the federal or state databases searched by
EDR.
• The immediately adjacent properties were not listed in the any of the federal or state databases searched by EDR.
• The subject property northern boundary is the Appomattox River, and the western property boundary an un-named tributary to the Appomattox River. The VDH currently has a Fish- Eating Advisory for both of these sections of the river due to PCB and Kepone contamination.
• There is no documented sediment contamination on the subject property, but VDEQ sediment sampling data from 2004 indicates PCB contaminant levels in the mouth of the Appomattox River above NOAA Effects Range. The source of the PCB contamination is unknown.
• All VDEQ Pollution Complaint Files for documented petroleum releases within the ASTM search radius were closed prior to this report.
• Observations during the site reconnaissance did not indicate the presence of any RECs on the subject property.
15-118 Report 14 November 2015
9.0 OPINION
It is highly likely the sediment in the Appomattox River on the northern subject property boundary, and the sediment in the un-named tributary to the Appomattox River on the western subject property boundary of the subject property is contaminated with PCB’s above the NOAA Effects Range and Kepone. This potential contamination is identified as a REC. If the subject property is to be developed in such a way as to include construction of any piers, pedestrian bridges/trails, etc. in or near the two rivers on the subject property, management of potentially contaminated sediment will need to be addressed.
It is the opinion of the environmental professional that this Phase I ESA report satisfies the requirement for all appropriate inquiry (AAI).
10.0 CONCLUSIONS
EEE performed this Phase I ESA in conformance with the scope and limitations of ASTM Practice E1527-13 for the subject property. Any exceptions to, or deletions from this practice are described in Section 2.4 of this report.
From the available public information reviewed and the site reconnaissance, one current recognized environmental condition (RECs) was identified for the subject property: potential sediment contamination in the Appomattox River on the northern property boundary, and the un-named tributary to the Appomattox River on the western property boundary of the subject property.
11.0 DEVIATIONS
Deviations, or data gaps, indicate a lack of or inability to obtain information required by ASTM E1527-13 and may affect the ability of the Environmental Professional to identify RECs. This Phase I ESA has no data gaps.
