About this file
This is a Sole Source Request and Determination Form submitted by the New Mexico Higher Education Department (NMHED) for a partnership with Burrell College of Osteopathic Medicine. The contract encompasses four primary service areas: enhancing and expanding clinical clerkship training for medical students in New Mexico-based hospitals, clinics, and federally qualified healthcare centers under the supervision of practicing Doctors of Osteopathic Medicine in specialties including family medicine, emergency medicine, and surgical specialties; supporting the enhancement and expansion of graduate medical education (GME) and community health outreach programs; implementing community-based outreach learning and preventative healthcare services in affiliation with existing community safety net health programs; and providing comprehensive annual reporting to NMHED with summaries due no later than June 30 of each year. The contract term is 12 months, with the sole source determination posted on June 3, 2026, following the required 30-calendar-day protest period.
The contract value is $1,500,000.00 before tax, funded through a New Mexico State Legislature appropriation to NMHED for FY27, with total program costs not expected to exceed $3,000,000.00. Burrell College of Osteopathic Medicine, located at 3501 Arrowhead Drive in Las Cruces, New Mexico, is justified as the sole source based on its unique qualifications as the only college of osteopathic medicine in New Mexico with direct experience designing and administering osteopathic medicine outreach programs targeting underserved Hispanic and Native American populations in rural areas. The college previously received a sole source procurement in FY25 to initiate program development and possesses demonstrated expertise in diversity, cultural awareness, and providing healthcare access to underserved communities. No other osteopathic medicine institutions exist within the state to fulfill these specialized requirements.

A. Enhance and expand clinical clerkship training for medical students during medical school in New Mexico-based hospitals, clinics, and federally qualified healthcare centers. The clerkship rotation program for students will occur under the overall supervision of a practicing Doctor of Osteopathic Medicine to include the following specialties: family medicine, emergency medicine and various surgical specialties. During this training, students will encounter and provide healthcare service under medical supervision. The services include taking patient histories, performing physicals, and providing preventative healthcare education and services.
B. Support the enhancement and expansion of graduate medical education (GME) and community health outreach programs in New Mexico.
C. Implement, enhance, and expand community-based outreach learning and provision of preventative healthcare services by students in affiliation with existing community safety net health programs and providers.
D. Provide the New Mexico Higher Education Department with all required reporting including a comprehensive summary of activities with an annual report due no later than June
30 of each year.
V. Provide a detailed explanation of the criteria developed and specified by the agency as necessary to perform and/or fulfill the contract and upon which the state agency reviewed available sources. (Do not use “technical jargon;” use plain English. Do not tailor the criteria simply to exclude other contractors if it is not rationally related to the purpose of the contract.)
The New Mexico State Legislature appropriated an additional $1,500,000.00 to NMHED in
FY27 for a partnership with a college of osteopathic medicine to continue to develop and enhance a comprehensive outreach program to increase interest in the healthcare field within the state of New Mexico, costs are not expected to exceed $3,000,000.00. In order for the Burrell
College of Osteopathic Medicine to continue to administer this outreach program NMHED must use the appropriated funds to work with a college of osteopathic medicine who can provide community outreach, minority student services, and to assist with enhancing and expanding graduate medical education programs within New Mexico.
VI. Provide a detailed, sufficient explanation of the reasons, qualifications, proprietary rights or unique capabilities of the prospective contractor that makes their company the only source capable of providing the required professional service, general service, construction or item(s) of tangible personal property. (Please do not state the source is the “best” source or the “least costly” source. Those factors do not justify a “sole source.”)
The Burrell College of Osteopathic Medicine educates a diverse osteopathic physician workforce committed to improving the quality and access to healthcare in underserved communities. The College is focused on diversity that fosters inclusiveness and cultural awareness among all learners and educators with the goal to increase diversity in the regional physician workforce. The College prepares students to effectively address the health needs of diverse populations, with emphasis on the southwest border region, particularly among Hispanic and Native American populations. The Burrell College of Osteopathic Medicine received the appropriation to develop the program in FY25 through a sole source procurement.
VII. Provide a detailed, sufficient explanation of how the professional service, general service, construction or item(s) of tangible personal property is/are unique and how this uniqueness is substantially related to the intended purpose of the contract.
NMHED is looking to continue to partner with a college of osteopathic medicine within the state of New Mexico who has experience in the design and creation of an outreach program committed to improving the quality and access to healthcare in underserved New Mexico communities. The Burrell College is the only school of osteopathic medicine in New Mexico who has direct experience in osteopathic medicine, allowing them the opportunity to increase interest in the healthcare field while considering cultural awareness among Hispanic and Native American populations. Providing these opportunities and services to New Mexico Hispanic and
Native American populations within rural areas of the state is extremely important, and Burrell College is uniquely situation to provide these services.
VIII. Provide a narrative description of the agency’s due diligence in determining the basis for the procurement, including procedures used by the agency to conduct a review of available sources such as researching trade publications, industry newsletters and the internet;
contacting similar service providers; and reviewing the State Purchasing Divisions’
Statewide Price Agreements. Include a list of businesses contacted (do not state that no other businesses were contacted), date of contact, method of contact (telephone, mail, e-mail, other), and documentation demonstrating an explanation of why those businesses could not or would not, under any circumstances, perform the contract; or an explanation of why the agency has determined that no businesses other than the prospective contractor can perform the contract.
The State of New Mexico does not have another college of osteopathic medicine.
NMHED partnered with Burrel College for 12 months in FY25 under a sole source procurement to begin the development of this program. NMHED is looking to enhance and expand graduate medical education (GME) and community health outreach programs in New Mexico during the term, which will include documenting both existing GME provider needs, and overall community health service needs and services provided to the sick and indigent via such GME programs. The focus will be on defining BCOM's role in facilitating healthcare service providers to address those underserved communities with inadequate access to services by the general population, including sick and indigent individuals.
