About this file

This document is a Sole Source Determination Form from the New Mexico Department of Transportation (NMDOT) for a contract with Bohannan Huston, Inc. (BHI) to provide floodplain modeling services for the Puerco River in the City of Gallup. The project involves updating floodplain mapping from the Interstate 40 crossing upstream to approximately 800 feet east of Ford Street, with work to be completed over a 4-year term. The scope includes multiple tasks such as data gathering, hydrologic analysis, 2D hydraulic modeling, and floodway analysis, with multiple stakeholder and FEMA coordination meetings planned throughout the project.

The total contract value is $415,064.13, excluding New Mexico gross receipts tax, with BHI being selected as the sole source contractor due to their extensive prior involvement in the Allison Road Corridor project since 2011. The justification for sole source procurement includes BHI's unique project knowledge, ownership of proprietary design documents, and critical timing related to a Railroad Crossing Elimination (RCE) Grant. The contract is time-sensitive, with strict federal grant deadlines that could be jeopardized by transitioning to a new consultant. The project is funded in part by the RCE Grant and requires precise coordination with FEMA and local stakeholders.

IV. Provide a detailed explanation of the criteria developed and specified by the agency as necessary to perform and/or fulfill the contract and upon which the state agency reviewed available sources. (Do not use “technical jargon;” use plain English. Do not tailor the criteria simply to exclude other contractors if it is not rationally related to the purpose of the contract.)

This study is a foundational component of the Railroad Crossing Elimination (RCE) Grant that NMDOT has secured for the project. As you are aware, federal grant funding of this nature comes with strict timelines and deliverables. Any disruption or reassignment of this work at this stage — particularly transitioning to a new consultant — would not only cause significant delays but also potentially jeopardize the funding associated with the RCE Grant.

BHI’s familiarity with the corridor and progress to date make them uniquely positioned to complete this study efficiently and in compliance with grant deadlines. Given the advanced stage of the drainage study and the urgent timeline tied to the RCE Grant, it is imperative that BHI be allowed to continue and complete this work without interruption

V. Provide a detailed, sufficient explanation of the reasons, qualifications, proprietary rights or unique capabilities of the prospective contractor that makes the prospective contractor the one source capable of providing the required professional service, service, construction or item(s) of tangible personal property. (Please do not state the source is the “best” source or the “least costly” source. Those factors do not justify a “sole source.”)

BHI has been the consultant of record for the Allison Road Corridor project since its inception. They were originally contracted to perform Phase I-C, I-D, and Phase II Engineering Design Services. As part of this engagement, BHI developed and owns the original construction plans and has placed their engineering stamp on the design documents. Their extensive knowledge of the project, combined with the proprietary nature of their plans, makes them uniquely qualified to complete the remaining work.

The outstanding work includes finalizing drainage elements that are essential to the completion of the project and directly tied to the recently awarded RCE Grant. This federal grant is time-sensitive, with specific deadlines and deliverables that cannot be delayed without putting the funding at risk.

BHI was performing this work under an NMDOT on-call contract that has since expired.

However, due to their unique position as the project engineer of record and their direct responsibility for the outstanding tasks, it is imperative that BHI be retained through a sole source contract to complete this work. Engaging a new consultant at this stage would cause significant delays due to the steep learning curve, duplication of work, and the need to revalidate existing data and designs. This would not only impact the project timeline but could jeopardize the RCE funding entirely.

VI. Provide a detailed, sufficient explanation of how the professional service, service, construction or item(s) of tangible personal property is/are unique and how this uniqueness is substantially related to the intended purpose of the contract.

BHI has served as the lead engineering consultant on this project since its inception and has an unmatched depth of knowledge and continuity with its development. Their involvement includes:

• Completion of the A-B Location Study in 2011, which laid the foundational alignment and corridor concept;

• Design of the Rio Puerco River crossing, which was successfully constructed in 2018;

• Ongoing engineering design of the Allison Road Corridor, which spans from NM 118 to the north side of I-40.

BHI is also the engineer of record for the Allison Road construction drawings and has placed their engineering stamp on the design plans, which they own. These documents and the underlying design decisions are proprietary and integral to the overall project development.

Furthermore, BHI was previously contracted through NMDOT’s on-call process to perform the Phase I-C, I-D, and Phase II Engineering Design Services. While much progress has been made, key components — including the final drainage study — remain incomplete due to the expiration of their on-call contract.

This work is now critically time-sensitive due to the awarding of a RCE Grant, which provides vital federal funding for this project but carries strict deadlines. Delays caused by transitioning to a new consultant would not only duplicate costs but could jeopardize this funding entirely. A new firm would be forced to restart significant portions of the design from scratch due to a lack of familiarity and access to proprietary information.

Given BHI’s historic and technical involvement, the following key points support the sole source justification:

• Continuity of Design: BHI has led the project since 2011 and developed all core plans and designs.

• Proprietary Work: BHI owns and stamped the engineering drawings, which cannot be replicated or modified without their direct involvement.

• Efficiency: A new consultant would need extensive time to review, validate, and redevelop plans—delaying the project and increasing cost.

• Grant Compliance: The RCE grant requires timely progress. Any consultant transition now risks failure to meet federal deadlines.

VII. Explain why other similar professional services, services, construction or item(s) of tangible personal property cannot meet the intended purpose of the contract.

BHI has been involved in this project since its inception. Their work includes:

• Completion of the A-B Location Study (2011);

• Design of the Rio Puerco River crossing, constructed in 2018;

• Development of construction drawings and engineering plans for the Allison Road Corridor from NM 118 to north of I-40, for which BHI is the engineer of record and holds the stamped plans.

BHI was also contracted to complete Phase I-C, I-D, and Phase II Engineering Design Services under a previous NMDOT on-call contract. While the majority of that work is complete, a small but critical portion remains, including:

• Finalization of the drainage study;

This remaining work is highly time-sensitive due to the awarding of a RCE Grant, which imposes strict deadlines and deliverables. Reassigning the work to another engineering firm would present serious risks for the following reasons:

1. Insufficient Time: A new firm would require time to research the project, understand previous design decisions, and review existing documentation. The remaining schedule does not permit this learning curve.

2. FEMA Coordination Already Underway: BHI has already begun coordination with FEMA regarding drainage and floodplain impacts related to the Rio Puerco.

A new consultant would have to start that process over, introducing unnecessary duplication and delay.

3. Continuity of Design: BHI’s proprietary plans and prior design decisions are critical to the project's completion. Transitioning to a new engineer would likely require revisiting or revalidating those plans, which would delay the project and increase costs.

4. Risk to Federal Grant Funding: Delays associated with a consultant change would put the RCE grant funding at risk, which could jeopardize the entire project.

Because BHI has already completed the majority of the design, initiated FEMA coordination, and is uniquely qualified to finalize the outstanding work within the required timeframe, a sole source contract is the most efficient and responsible path forward.

VIII. Provide a narrative description of the agency’s due diligence in determining the basis for the procurement, including procedures used by the agency to conduct a review of available sources such as researching trade publications, industry newsletters and the internet;;

contacting similar service providers; and reviewing the State Purchasing Divisions’ Statewide Price Agreements. Include a list of businesses contacted (do not state that no other businesses were contacted), date of contact, method of contact (telephone, mail, e-mail, other), and documentation demonstrating an explanation of why those businesses could not or would not, under any circumstances, perform the contract; or an explanation of why the agency has determined that no businesses other than the prospective contractor can perform the contract.

As previously stated, BHI has been the engineering firm of record on this project since 2011, beginning with the A-B Location Study, followed by the design of the Rio Puerco River crossing, which was constructed in 2018, and continuing through the current Allison Road Corridor design from NM 118 to the north side of I-40.

Under their original NMDOT on-call contract, BHI completed the majority of the engineering work, including Phases I-C, I-D, and Phase II Design Services. While much of the contract work is already complete, the following items remain outstanding:

• Finalization of the drainage study;

BHI is uniquely qualified to complete this work for the following reasons:

1. Longstanding Project Knowledge: No other engineering firm has the depth of knowledge or familiarity with this corridor. Any new consultant would require extensive time to research and understand over a decade of prior work—time that the project schedule cannot support.

2. Proprietary Plans and Stamped Drawings: BHI is the engineer of record and owns the complete set of stamped construction drawings. These documents are not transferable and cannot be modified or built upon by another firm without restarting the design process.

3. FEMA Coordination: BHI has already initiated coordination with FEMA as part of the Rio Puerco drainage study. A new consultant would be forced to start over, significantly delaying the project.

4. Time-Sensitive RCE Grant: This project is funded in part by the RCE Grant, which imposes strict deadlines. Reassigning the remaining work would jeopardize the funding due to the time it would take another consultant to come up to speed.

Because of the proprietary nature of BHI’s design documents, their unique familiarity with the project, and the urgent timeline imposed by federal funding, it is clear that no other consultant could complete the remaining work without significant risk to cost, schedule, and grant compliance.

Task 1 – Data Gathering and Research and Mapping

Subtask 1A - Literature and Data Review

Bohannan Huston, Inc. (BHI) will request, compile and review available literature and data including FEMA data, the US Army Corps of Engineers (USACE) Levee documents, NM 602 as-builts, City of Farmington solar farm as-builts, other pertinent as-built plans, relevant Finished Floor Elevations (FFEs), land cover, soil type and rainfall data. Pertinent as-builts will include river bridge structures located with the floodplain placed after the effective FEMA modeling, prior to the 2018 LiDAR described in Subtask 1B. If BHI cannot obtain accurate as-builts for these structures, survey information will be required to accurately model these areas for the hydraulic model. This survey effort is not included in this scope and fee. This subtask also includes efforts for coordination with the Allison Roadway design team during this portion of the project.

Subtask 1B - Obtain and Process Topographic Data

BHI will obtain and process USGS 3DEP 1-meter Digital Elevation Model (DEM) data developed from 2018 LiDAR and a DEM developed from BLM 1973 Natural Color Historical data (Photo Scale: 31,680;

Scan – 1000dpi (25 micron) (Ortho GSD ~2.6 foot pixel / Contour Interval (CI) - ~8 ft) for the for use in the hydraulic modeling.

Subtask 1C - Field Review

BHI will visit the site up to two (2) times during the analysis period, if questions or concerns about the drainage related ground features arise. This fee covers up to two (2) site visits and includes mileage, travel time and up to 8 hours at the site for two (2) Engineers.

Task 2 – Finalize Hydrologic Analysis

Preliminary Hydrologic Analysis was performed under a previous contract. However, the analysis has not yet been documented and submitted for New Mexico Department of Transportation (NMDOT) Drainage Design Bureau (DDB) review; therefore, this task includes effort for creating a Hydrology Summary Memo as an initial task.

Subtask 2A - Finalize Hydrologic Analysis

The USACE HEC-HMS version 4.12 program (or latest version, as agreed to by NMDOT) will be utilized for the hydrologic analysis. The hydrologic study will begin at the downstream side of Interstate 40 (I-40) (including a subbasin entering the Puerco River just downstream of I-40) and extend upstream beyond Gonzales, NM to the continental divide. The watershed is approximately 600 square miles, as shown in Figure 1. The terrain source utilized in HEC-HMS is USGS 30-meter DEM created during the preliminary hydrologic analysis task (not a part of this scope of work). The analysis will utilize the NMDOT hydrologic methodology. Preliminary hydrologic analysis shows little to no impact from the Little Puerco Dam on the peak flow within the Puerco River; therefore, hydrographs from that watershed will not be included in the hydrologic analysis. Previous effort included a review of the USACE National inventory of Dams within the hydrologic boundary and determined there are no additional dams that impact the Puerco River peak flow rates within the watershed boundary.

FLOODPLAIN MODELING FOR GALLUP, NM

Comments from NMDOT will be addressed and a Draft Final Hydrology Summary Memo will be prepared for submittal to the Stakeholders and FEMA. The Stakeholders will include the City of Gallup, McKinley County, NMDOT DDB, NMDOT District 6, and the USACE. The Draft Final Hydrology Summary Memo will include a summary of the analysis, associated geographical information system (GIS) figures, and digital HEC-HMS modeling files for final review and comment.

This subtask includes addressing one (1) round of comments by stakeholders and (1) one round of comments by FEMA obtained through FEMA coordination meetings. This subtask includes up to two (2) virtual stakeholder meetings a month through the completion of Subtask 2A and one virtual (1) FEMA coordination meeting.

Deliverables:

One (1) electronic copy of the Draft Hydrologic Summary Memo (PDF format), associated GIS

Figures (PDF format), and digital HEC-HMS modeling will be provided to stakeholders and

FEMA.

One (1) electronic copy of the Final Hydrologic Summary Memo (PDF format), associated GIS Figures (PDF format), and digital HEC-HMS modeling.

Task 3 – Replica 1973 2D Hydraulic Analysis - Without and With Levee

The USACE HEC-RAS 2D version 6.6 program (or latest version, as agreed to by NMDOT) will be utilized to create the Replica 1973 2D hydraulic model. The hydraulic model limits fall within three (3) FEMA map panels, 35031C-1515E, -1520E, and -1540E, as shown in Figure 2. The downstream limit of the hydraulic model will extend sufficiently downstream of the I-40 and Puerco River intersection to capture the effects of both the main channel I-40 Bridges and the Bread Springs Wash Bridges over I-40. The confluence of Bread Springs Wash is approximately 2,000-ft downstream of I-40. While the model extent will require this additional area, the intent for any future Conditional Letter of Map Revision (CLOMR) efforts will be to tie in the newly mapped floodplain at upstream side if I-40. The upstream limit of the hydraulic model is approximately 800-ft east of Ford Drive, at the current limit of study for the effective Zone AE. BHI will produce two (2) Replica 1973 2D models under this subtask as described below.

Subtask 3A - Replica 1973 2D Hydraulic Analysis Without Levee

The terrain source for the Replica 1973 2D HEC-RAS model will be the merged 1973 and 2018 topo sources listed in Subtask 1B. The 2018 topo will be utilized for areas outside of the FEMA effective floodplain limits and areas within the Puerco River main channel. Per FEMA’s request during a meeting on October 25, 2024, fill and/or structures placed without a permit within the effective FEMA floodplain after the effective date cannot be included in the hydraulic model that determines the effective BFE used to evaluate future improvements. The 1973 terrain will be utilized within the effective floodplain limits to ensure fill and/or structures built after the FEMA effective date are not included in the Replica 1973 2D model. This model will not include the existing levee built after 1973.

The hydraulic analysis will be reviewed internally at multiple stages of the analysis for accuracy and completeness.

FLOODPLAIN MODELING FOR GALLUP, NM

BHI will prepare and provide a Draft Replica 1973 2D Hydraulic Summary for Subtask 3A, associated GIS figure(s), and digital HEC-RAS modeling files to the stakeholders for review and comment (herein referred to as Subtask 3A Package). BHI will address comments and resubmit for final stakeholder acceptance. This Subtask includes up to two (2) virtual stakeholder meetings a month for up to 4 months, or completion through Subtask 3A.

Deliverables:

One (1) electronic copy of the Draft Subtask 3A Package will be provided to stakeholders and

FEMA.

Subtask 3B - Replica 1973 2D Hydraulic Analysis with Levee

The hydraulic model associated with Subtask 3A will be copied and revised to include the existing levee.

The hydraulic analysis will be reviewed internally at multiple stages of the analysis for accuracy and completeness.

BHI will amend the Draft Subtask 3A Package to include a summary of the Draft Subtask 3B results, associated GIS figure(s), and digital HEC-RAS modeling files. This Draft Subtask 3B Package will be provided to the stakeholders for review and comment. A courtesy copy of the Subtask 3A and 3B packages will be sent to FEMA to provide an opportunity to comment. BHI will request a FEMA coordination meeting approximately 2 weeks after the courtesy copies are sent.

BHI will address one (1) round of comments by stakeholders and one (1) round of comments by FEMA under this subtask and will resubmit revised final copies of the previously submitted package to the stakeholders. This subtask includes up to two (2) virtual stakeholder meetings a month for up to 4 months, or completion through Subtask 3B, and one (1) virtual FEMA coordination meeting .

Deliverables:

One (1) electronic copy of the Draft Subtask 3B Package will be provided to stakeholders and

FEMA.

One (1) electronic copy of the Final Subtask 3A and 3B Package will be provided to stakeholders after stakeholder and FEMA comments have been addressed.

Task 4 – Replica 1973 2D Hydraulic Analysis with Unpermitted Fill, Without and With Levee

Subtask 4A - Replica 1973 2D Hydraulic Analysis with Unpermitted Fill Without Levee

The Subtask 4A hydraulic model will begin as a copy of the Subtask 3A Without Levee model. Areas of unpermitted fill and unpermitted structures, placed after the Replica 1973 modeling, will be added into the model. Areas of unpermitted fill and unpermitted structures will be added to the surface using the 2018 topo and provided as-builts, respectively. If these sources do not provide complete information, additional survey will be required and provided by others. This scope does not cover the survey necessary to model unpermitted areas within hydraulic analysis. This model will not include the existing levee built after 1973.

FLOODPLAIN MODELING FOR GALLUP, NM

The hydraulic analysis will be reviewed internally at multiple stages of the analysis for accuracy and completeness.

BHI will prepare and provide a Draft Replica 1973 Hydraulic Summary for Subtask 4A, associated GIS figure(s), and digital HEC-RAS modeling files to the stakeholders for review and comment (herein referred to as Subtask 4A Package). BHI will address comments and resubmit for final stakeholder acceptance. This Subtask includes up to two (2) virtual stakeholder meetings a month for up to 4 months, or through the completion of Subtask 4A.

BHI will request a FEMA coordination meeting approximately 2 weeks after the courtesy copies are sent.

BHI will address one (1) round of comments by stakeholders and one (1) round of comments by FEMA under this subtask and will resubmit to the stakeholders, revised final copies of the previously submitted package. This subtask includes up to two (2) virtual stakeholder meetings a month for up to 4 months, or through the completion of Subtask 4B, and one (1) virtual FEMA coordination meeting.

Deliverables:

One (1) electronic copy of the Draft Subtask 4B Package will be provided to stakeholders and

FEMA.

One (1) electronic copy of the Final Subtask 4A and 4B Packages will be provided to stakeholders after stakeholder and FEMA comments have been addressed.

Task 5–Existing Conditions (2018) Hydraulic Analysis with Unpermitted Fill, Guide Banks, and Previously Constructed Allison Road Improvements, Without and With Levee

BHI will produce two (2) existing conditions (2018) 2D models as described below. These models are intended to provide a current conditions hydraulic model for the area.

FLOODPLAIN MODELING FOR GALLUP, NM

Subtask 5A - Existing Conditions (2018) 2D Hydraulic Analysis with Unpermitted Fill, Guide Banks, and Previously Constructed Allison Road Improvements Without Levee

This model will be a copy of the Subtask 4A Without Levee model, but will be revised to include the existing Guide Banks and previously constructed Allison Road Improvements. Guide Banks and Allison Road Improvements will be added to the surface utilizing the 2018 topo and associated as-builts. If complete information is not provided in these sources for the Guide Banks and Allison Road Improvements, additional survey will be required and provided by others. This scope does not cover the survey necessary to model the Guide Banks and Allison Road Improvements should the provided as-built or 2018 topo not be sufficient. This model will not include the existing levee.

The hydraulic analysis will be reviewed internally at multiple stages of the analysis for accuracy and completeness.

BHI will prepare and provide a Draft Existing Conditions (2018) Hydraulic Summary, associated GIS figure(s), and digital HEC-RAS modeling files to the stakeholders for review and comment (herein referred to as Subtask 5A Package). BHI will address comments and resubmit for final stakeholder acceptance. This subtask includes up to two (2) virtual stakeholder meetings a month for up to 4 months, or through the completion of Subtask 5A.

Deliverables:

One (1) electronic copy of the Draft Subtask 5A Package will be provided to stakeholders and

FEMA.

Subtask 5B - Existing Conditions (2018) 2D Hydraulic Analysis with Unpermitted Fill, Guide Banks, and Previously Constructed Allison Road Improvements With Levee

The hydraulic model associated with Subtask 5A will be copied and revised to include the existing levee utilizing the 2018 topo.

The hydraulic analysis will be reviewed internally at multiple stages of the analysis for accuracy and completeness.

BHI will amend the Final Subtask 5A Package to include a summary of the Subtask 5B results, associated GIS figure(s), and digital HEC-RAS modeling files. This Draft package will be provided to the stakeholders for review and comment. A courtesy copy of the Subtask 5A and 5B packages will be sent to FEMA to provide an opportunity to comment.

This subtask includes up to two (2) virtual stakeholder meetings a month for up to 4 months, or through the completion of Subtask 5B, and one (1) virtual FEMA coordination meeting.

FLOODPLAIN MODELING FOR GALLUP, NM

Deliverables:

One (1) electronic copy of the Draft Subtask 5B Package will be provided to stakeholders and

FEMA.

One (1) electronic copy of the Final Subtask 5A and 5B Packages will be provided to stakeholders after stakeholder and FEMA comments have been addressed.

Task 6 - Floodway Analysis

Subtask 6A - Floodway Analysis

BHI will create a one (1) HEC-RAS 2D Floodway model based on equitable consideration of both overbanks starting from the Final Existing Conditions (2018) Subtask 5A model. The 5A model was chosen because the levee is currently unaccredited and will not be accepted by FEMA. If the levee becomes accredited before analysis for Task 6 has begun, the Final Existing Conditions (2018) Subtask 5B Model will be the basis of the Floodway analysis. The Floodway model will evaluate where floodways may or may not be applicable and will be evaluated for surcharge compliance.

The floodway analysis will be reviewed internally at multiple stages of the analysis for accuracy and completeness.

BHI will amend the Subtask 5A Package to include the Draft Floodway Analysis Summary (for Subtask 6A), associated GIS figure(s), and digital HEC-RAS modeling files. This Draft package will be provided to the stakeholders for review and comment. A courtesy copy of the Subtask 6A package will be sent to FEMA to provide an opportunity to comment. BHI will request a FEMA coordination meeting approximately 2 weeks after the courtesy copy is sent.

BHI will address one (1) round of comments by stakeholders and one (1) round of comments by FEMA under this subtask and will resubmit to the stakeholders, revised final copies of the previously submitted package. This subtask includes up to two (2) virtual stakeholder meetings a month for up to 4 months, or through the completion of Subtask 6A, and one (1) virtual FEMA coordination meeting.

Deliverables:

One (1) electronic copy of the Draft Subtask 6A Package will be provided to stakeholders and

FEMA during the 1st submittal.

One (1) electronic copy of the Final Subtask 6A Package will be provided to stakeholders after stakeholder and FEMA comments have been addressed.

ASSUMPTIONS AND EXCLUSIONS

1. All meetings are assumed to be virtual.

2. Viability of CLOMR will be established once a no-rise condition on existing structures within the effective FEMA floodplain can be established. A no-rise analysis, and all FEMA work such as CLOMR/LOMR work, are not included in this scope of work. It is important to note, if the no-rise requirements cannot be met, a CLOMR may not be possible.

FLOODPLAIN MODELING FOR GALLUP, NM

3. This analysis may place existing structures that are currently not in the floodplain or floodway into the floodplain and/or floodway.

4. The existing models will be a combination of 1973 and 2018 topography. The 2018 is the best available topo for the hydraulic analyses, any natural or manmade changes to the surface area within the area of study after 2018 are excluded from this scope of work. Adding surface data for post 2018 improvements at the request of FEMA or the City will need to be provided to BHI and will be per separate scope and fee.

5. The number of stakeholder and FEMA meetings is stated with each task, additional meetings will be per separate scope and fee. All meetings will be virtual.

6. The USACE will provide all information required for hydraulic modeling for the existing Levee within the project limits.

7. BHI assumes the dams within the USACE dam inventory, within the hydrologic watershed for this project, can be qualitatively eliminated from the hydrologic and hydraulic modeling. A review of the dam information and preliminary hydrologic modeling has confirmed this statement.

8. Changes in FEMA guidance that occur during the project and require rework will require an additional fee.

9. If modeling software (HEC-HMS or HEC-RAS) updates are required during the course of this task order, the level of effort will be evaluated and may require additional services.

10. FEMA has indicated that any future CLOMR / LOMR will not be allowed to include levees that are not certified. It is unclear if the USACE intends to pursue levee certification / accreditation for the levee in the modeling area. Therefore, Task 3, 4, and 5 models will be developed for both with and without levee condition.

11. Floodway analysis will be required with any models submitted to FEMA as part of a future CLOMR process. Additional floodway tasks from what is described in Task 6 would require an additional fee.
