Sole Source Determination Summary
This is a Sole Source Request and Determination Form submitted by the New Mexico Spaceport Authority for the procurement of fuel farm equipment support, maintenance, training, and software maintenance services. The procurement encompasses five distinct service categories: annual fuel farm maintenance including meter calibration and filter replacement ($5,150.00); bi-annual maintenance of fuel trucks including oil changes, filter replacements, meter calibration, and brake inspections ($10,400.00 for two services); onsite aviation fuel handling and dispensing training conducted by licensed instructors ($8,200.00 for a two-day session); TCS Software Monitoring and Support ($3,240.00 for the period July 1, 2026 through June 30, 2027); and QT POD Software and Support ($1,425.00 for the period September 1, 2026 through October 31, 2027). The contract term is twelve months, with scheduling to be initiated by the New Mexico Spaceport Authority on or before November 2026 for maintenance and training services.
The prospective contractor is Ascent Aviation Group, Inc. (World Fuel Services), with a SHARE Vendor Number 0000137108 and a total contract amount of $28,415.00 before tax. The agency determined sole source procurement is justified because World Fuel Services originally constructed the fuel farm, built and delivered the fuel trucks, installed proprietary monitoring probes integrated into the fuel management software system, and provided initial aviation fuel training and certifications. The software controlling fuel inventory management, point-of-sale functions, invoicing capabilities, and proprietary aviation card processing is owned exclusively by World Fuel Services, making alternative contractors unable to provide bundled maintenance, training, and software support services. The agency certified that no other businesses were contacted because no other providers could meet the criteria due to the proprietary nature of the software and the inability to integrate services from multiple sources.

PROJECT BACKGROUND AND DESCRIPTION STATEMENT: The fuel farm at SpaceportAmerica, like most fuel farms, requires several forms of mandated maintenance that range from daily onsite maintenance to annual maintenance. Spaceport America has several customers who utilize our
Docusign Envelope ID: DF86B510-277B-8551-8316-D841BEF963C9 fueling services. We have technicians on site who are trained to support most aircraft operations and strive to be on the cutting edge of fueling technology. Spaceport America has staff onsite to perform fueling operations Monday through Friday, and on weekends as necessary. The fuel farm consists of a 25,000-gallon Jet-A tank, a 12,000-gallon AvGas tank, a 7,500-gallon diesel tank, and a 7,500-gallon unleaded tank. We also have an Avgas truck with a 1,000-gallon tank and a Jet-A truck with a 3,000-gallon tank. To ensure we are up to date with codes and regulations, maintenance from outside sources is required, along with proper training from licensed instructors, and all software support.

VI. Provide a detailed explanation of the criteria developed and specified by the agency as necessary to perform and/or fulfill the contract and upon which the state agency reviewed available sources. (Do not use “technical jargon;” use plain English. Do not tailor the criteria simply to exclude other contractors if it is not rationally related to the purpose of the contract.)
The purpose of this purchase is to ensure that all items pertaining to the NMSA Fuel Farm are properly maintained.
World Fuel constructed the current fuel farm, had the fuel trucks built and delivered, provided proper fuel handling training, and owns the software used to keep accurate records of fuel dispended and purchased at Spaceport America.
This contract is important in keeping to the high standards required in maintaining a fuel farm and resources pertaining to it.
VII. Provide a detailed, sufficient explanation of the reasons, qualifications, proprietary rights or unique capabilities of the prospective contractor that makes their company the only source capable of providing the required professional service, general service, construction or item(s) of tangible personal property. (Please do not state the source is the “best” source or the “least costly” source. Those factors do not justify a “sole source.”)
TCS communications links. This is necessary in order to continue to use the proprietary software that integrated with our air fuel system. The fuel storage tanks, and transport tanks have proprietary monitoring probes that track fuel levels integrated into the FBO Software allowing for proper inventory management of air fuel. Additionally, the software includes point of sale and invoicing features including the ability to accept payment from the proprietary aviation cards (Avcard), a standard in the air industry for procuring fuel by customers of spaceports. World Fuel is a respected name in the fueling industry and have proven to stand behind their work when it comes to the fuel farm.
World Fuel installed the fuel farm, had fuel trucks built to proper specifications, and performed all of the maintenance on all of the fueling equipment in the past. World Fuel has the capability and resources to bundle all required maintenance, training and software needs, which helps maintain effective record keeping.
VIII. Provide a detailed, sufficient explanation of how the professional service, general service, construction or item(s) of tangible personal property is/are unique and how this uniqueness is substantially related to the intended purpose of the contract.
The software related to the fuel farm is proprietary to World Fuel, they own the rights to it. The software is used to accurately track the type and amount of fuel sold to aviation customers. The trucks were built and delivered by
World Fuel as requested by Spaceport America in the initial RFP for the “Fuel
Farm and Trucks”, and the fuel aviation training and certifications were provided by World Fuel. This training is required to ensure that any and all aviation fuel distributed on site is performed by trained and qualified technicians. World Fuel was originally chosen for all of these items through the RFP process, pre-fuel farm construction.
IX. Provide a narrative description of the agency’s due diligence in determining the basis for the procurement, including procedures used by the agency to conduct a review of available sources such as researching trade publications, industry newsletters and the internet;;
contacting similar service providers; and reviewing the State Purchasing Divisions’
Statewide Price Agreements. Include a list of businesses contacted (do not state that no other businesses were contacted), date of contact, method of contact (telephone, mail, e-mail, other), and documentation demonstrating an explanation of why those businesses could not or would not, under any circumstances, perform the contract; or an explanation of why the agency has determined that no businesses other than the prospective contractor can perform the contract.
Other professional services cannot meet the criteria due to the fact that software for the fuel farm and fuel trucks is proprietary, nor can all of the services be bundled.
Agency certifies this sole source submission complies with NMSA 1978, Sections 13-1-28 through 13-1-199, the New Mexico Administrative Code (NMAC) and Governmental Conduct
Act, NMSA 1978, Sections 10-16-1 through 10-16-18.
