About this file
This file comprises multiple permit authorizations and engineering plans issued by the U.S. Army Corps of Engineers Jacksonville District, the South Florida Water Management District (SFWMD), and Monroe County for the Canal #82 Restoration Project in Key Largo, Florida. The project authorizes mechanical and hydraulic vacuum dredging of 1,614 cubic yards of organic muck sediment from a 43,582 square-foot canal area, with subsequent placement of 2,931 cubic yards of clean fill material (coarse limerock and carbonate sand) across a 31,729 square-foot backfill area to restore depth levels to -8.5 feet North American Vertical Datum 1988 (NAVD88). The work area extends between Lobster Lane and Bonito Lane in Section 13, Township 62 South, Range 38 East, Key Largo, at coordinates 25.046 N, 80.4866 W. The project is authorized under Nationwide Permit 27 (Aquatic Habitat Restoration, Establishment, and Enhancement Activities) with a verification valid until March 14, 2026, and under SFWMD Environmental Resource Permit No. 44-111476-P, issued January 24, 2025, with expiration January 24, 2030. The project encompasses 1.2 acres of canal work plus 0.38 acres of upland staging area. Construction activities must commence within the permit validity periods, with completion certification required within 30 days of project finish.
The permittee is Monroe County Board of County Commissioners, with perpetual operation and maintenance responsibility assigned to the same entity. Dredged material disposal must occur at a self-contained, upland disposal site, with all fill material consisting of clean limerock free from trash, debris, and contaminants. Comprehensive environmental controls are mandated, including installation of floating turbidity barriers with weighted skirts, erosion control measures around the work perimeter, and turbidity monitoring with maximum allowable levels of 0 NTU above background outside turbidity curtains in Outstanding Florida Waters. Protected species provisions require compliance with manatee, sea turtle, and smalltooth sawfish protection standards, including idle speed/no-wake operations, 50-foot shutdown buffers, and dedicated onsite observers during in-water work. The permittee must submit a Construction Commencement Notice at least 48 hours prior to work initiation, maintain the permit and approved plans at the construction site, and submit an ENG Form 6285 Certification of Compliance within 60 days of completion. No cost or funding source information is provided in these permit documents.

Examples of submerged historical, archaeological or cultural resources include shipwrecks, shipwreck debris fields (such as steam engine parts, or wood planks and beams), anchors, ballast rock, concreted iron objects, concentrations of coal, prehistoric watercraft (such as log "dugouts"), and other evidence of human activity. The materials may be deeply buried in sediment, resting in shallow sediments or above them, or protruding into water. The Corps shall coordinate with the Florida State Historic Preservation Officer (SHPO) to assess the significance of the discovery and devise appropriate actions. Project activities shall not resume without verbal and/or written authorization from the Corps.
c. Additional cultural resources assessments may be required of the permit area in the case of unanticipated discoveries as referenced in accordance with the above Special Condition and, if deemed necessary by the SHPO or Corps, in accordance with 36 CFR 800 or 33 CFR 325, Appendix C (5). Based on the circumstances of the discovery, equity to all parties, and considerations of the public interest, the Corps may modify, suspend, or revoke the permit in accordance with 33 CFR Part 325.7. Such activity shall not resume on non-federal lands without written authorization from the SHPO for finds under his or her jurisdiction, and from the Corps.
d. In the unlikely event that unmarked human remains are identified on non-federal lands; they will be treated in accordance with Section 872.05 Florida Statutes. All work and ground disturbing activities within a 100-meter diameter of the unmarked human remains shall immediately cease and the Permittee shall immediately notify the medical examiner, Corps, and State Archaeologist within the same business day (8-hours). The Corps shall then notify the appropriate SHPO. Based on the circumstances of the discovery, equity to all parties, and considerations of the public interest, the Corps may modify, suspend, or revoke the permit in accordance with 33 CFR Part 325.7. Such activity shall not resume without written authorization from the SHPO and from the Corps.
7. Assurance of Navigation and Maintenance: The Permittee understands and agrees that, if future operations by the United States require the removal, relocation, or other alteration, of the structures or work herein authorized, or if in the opinion of the Secretary of the Army or his authorized representative, said structure or work shall cause unreasonable obstruction to the free navigation of the navigable waters, the Permittee will be required, upon due notice from the U.S. Army Corps of Engineers, to remove, relocate, or alter the structural work or obstructions caused thereby, without expense to the United States. No claim shall be made against the United States on account of any such removal or alteration.

8. Jacksonville District Programmatic Biological Opinion (JAXBO): Structures and activities authorized under this permit will be constructed and operated in accordance with all applicable project design criteria’s (PDCs) contained in the JAXBO, based on the permitted activity. Johnson’s seagrass and its critical habitat were delisted from the Endangered Species Act on May 16, 2022. Therefore, JAXBO PDCs required to minimize adverse effects to Johnson’s seagrass and its critical habitat are no longer applicable to any project. Failure to comply with applicable PDCs will constitute noncompliance with this permit. In addition, failure to comply with the applicable PDCs, where a take of listed species occurs, would constitute an unauthorized take. The NMFS is the appropriate authority to determine compliance with the Endangered Species Act. The most current version of JAXBO can be accessed at the Jacksonville District Regulatory Division website in the Endangered Species section of the Sourcebook located at:
http://www.saj.usace.army.mil/Missions/Regulatory/SourceBook.aspx
JAXBO may be subject to revision at any time. The most recent version of the JAXBO must be utilized during the design and construction of the permitted work.
9. Manatee Conditions: The Permittee shall comply with the “Standard Manatee Conditions for In-Water Work – 2011” (attached). The most recent version of the Manatee Conditions must be utilized.
10. Manatee Condition for Clamshell Dredge: During clamshell dredging operations, the dredge operator shall gravity-release the clamshell bucket only at the water’s surface, and only after confirmation that there are no manatees within the safety distance identified in the standard construction conditions (or a 75-foot buffer if dredging is authorized at night).
11. Dredged Material Disposal: The Permittee shall place all dredged material in a self-contained, upland disposal site as detailed in the attached date-stamped by the Corps on June 5, 2025. The Permittee shall maintain the upland disposal site to prevent the discharge of dredged material and associated effluent into waters of the United States.
12. Turbidity Barriers: Prior to the initiation of any of the work authorized by this permit, the Permittee shall install floating turbidity barriers with weighted skirts that extend within 1 foot of the bottom around all work areas that are in, or adjacent to, surface waters. The turbidity barriers shall remain in place and be maintained daily until the authorized work has been completed and turbidity within the construction area has returned to ambient levels. Turbidity barriers shall be removed upon stabilization of the work area.
13. Erosion Control: Prior to the initiation of any work authorized by this permit, the Permittee shall install erosion control measures along the perimeter of all work areas http://www.saj.usace.army.mil/Missions/Regulatory/SourceBook.aspx
-6-to prevent the displacement of fill material outside the work area into waters of the United States. The erosion control measures shall remain in place and be maintained until all authorized work is completed and the work areas are stabilized.
14. Fill Material: The Permittee shall use only clean fill material for this project. The fill material shall be free from items such as trash, debris, automotive parts, asphalt, construction materials, concrete block with exposed reinforcement bars, and soils contaminated with any toxic substance in toxic amounts, in accordance with Section 307 of the Clean Water Act.
15. Wetland Avoidance Areas: The jurisdictional wetlands, as shown in attached drawings date stamped by the Corps on June 5, 2025, were avoided in accordance with the Section 404(b)(1) guidelines and Public Interest Review. Any proposed discharge of dredged or fill material to these areas would require re-evaluation for the Department of Army authorization.
16. Work Vessel Anchoring: This permit does not authorize construction work vessels anchoring or spudding down in areas where submerged aquatic vegetation, mangroves, and corals are present. Construction work vessels anchoring or spudding down shall be limited within the dredged channel/canal in areas devoid of submerged aquatic vegetation, mangroves, and corals.
17. Structure Failure: The contractors must notify the Corps within 24 hours of any structures that failed due to the dredging activities and what emergency measures will be taken to prevent further damage. The Corps must review and approve any preventative measures (i.e. shoring of property with riprap boulders, driving of temporary piles to prevent seawall or dock failures) before they are implemented.
18. Structures in Navigable Waters: This permit does not authorize any work other than maintenance dredging. If the contractor identifies any structures that will need to be reinstalled, repaired, and/or replaced a separate permit from the Corps will be required. The Permittee shall obtain all necessary permits prior to commencement of the reinstallation/repair/replacement work.
19. Utility Lines: Prior to any maintenance dredging activities the contractor shall ensure that all underground and subaqueous utility lines within the dredge footprint are identified and that the proper safety procedures are implemented to avoid impacts to these existing structures.
20. Construction Methodology: The Permittee shall ensure that the staging area and construction methodology is conducted in accordance with the attached drawings date-stamped by the Corps on June 5, 2025.
