About this file
The document is a Defense Production Act Questionnaire that the Navy will use to determine if a proposed real estate lease involving foreign persons poses any national security risks. The questionnaire requests information on foreign persons with control over the proposed lessee, foreign persons with control over contractors/vendors, subcontractors, and whether non-U.S. citizens will be performing work on the leased premises. This information is required to assess the transaction under 50 U.S.C. 4565 and 31 C.F.R. Part 802.
The related federal contract opportunity is a solicitation by the Department of the Navy (DON) to lease 17.50 farmable acres of property at Marine Corps Air Station Yuma, Arizona for agricultural purposes. The lease term is not to exceed 5 years, beginning on September 01, 2024. The DON will evaluate proposals for private development under Title 10 USC 2667 leasing authority.

Defense Production Act Questionnaire
The Defense Production Act Questionnaire, as amended, 50 U.S.C. §§ 4501-4568, authorizes the President and the Committee on Foreign Investment in the United States (CFIUS) to review covered Real Estate Transactions involving foreign persons and to address national security concerns arising from those transactions. This questionnaire will help the Navy determine whether the proposed lease is a Covered Real Estate Transaction under 50 U.S.C. § 4565 and 31 C.F.R. Part 802 and whether measures are needed to mitigate any national security risk which may arise from involvement by Foreign Persons in the proposed lease. All capitalized terms used in this letter shall have the meanings defined in 31 C.F.R. Part 802. Please attach an additional sheet if needed.
1. Please provide the names of all Foreign Persons having Control over the proposed Lessee.
2. Please provide to the Navy the names of any Foreign Person having Control over a contractor or vendor with which the proposed Lessee has, or intends to have, a contract to perform work under the sublease or on the Leased Premises.
3. Please provide the names and addresses of subcontractors that will be involved in the proposed lease.
4. Please indicate whether non-U.S. citizens will be performing work on the Leased Premises and if so provide their planned duties under the proposed lease.
The information provided above is current, accurate, and complete to the best of my knowledge.
