About this file

This is a Notice of Emergency Procurement issued by the South Carolina Department of Corrections on January 28, 2022, for the purchase of 3-compartment Styrofoam hinge trays measuring 9.50" x 9.25" x 3.75". The emergency procurement was initiated due to COVID-19 pandemic conditions, specifically the Omicron variant, which resulted in twenty-one correctional institutions being placed under quarantine statewide. During quarantine, the Department must provide three meals daily to all inmates in isolation, necessitating additional food service supplies to maintain safe feeding operations. The solicitation was not advertised in the South Carolina Business Opportunities (SCBO) due to the urgent nature of the procurement and supply chain constraints created by the pandemic. Sealed offers must be submitted by February 7, 2022, at 10:00 AM to the SC Department of Corrections Purchasing Branch at 4420 Broad River Road, Columbia, SC 29210. Award was scheduled to be posted on February 7, 2022, and the award notification would be available on the state procurement website at http://www.procurement.sc.gov. The Department has already entered into an emergency contract with DEM Logistics of Chapin, South Carolina, for the required trays.

The emergency procurement was established to prevent a potential threat to public health, welfare, and safety of Department employees, inmates, and surrounding community members. This notice is being posted in SCBO for at least five business days as required by South Carolina Code Section 11-35-4210(1)(c). Prospective bidders, offerors, contractors, or subcontractors who believe they are aggrieved by the intended award may file a protest with the Chief Procurement Officer at Materials Management Office, 1201 Main Street, Suite 600, Columbia, SC 29201, within five business days of the award posting date, with formal protest procedures to follow within fifteen days. Offerors must acknowledge receipt of any amendments and agree to hold their offers open for a minimum of thirty calendar days after the opening date. South Carolina vendor preferences apply by line item as outlined in Section 11-35-1524 of the South Carolina Code of Laws, and vendors claiming preferences must certify their eligibility.
