About this file
This document is a Sole-Source Determination Memo from the Oregon Health Authority (OHA) requesting a sole-source procurement for a Mainframe Survey and Migration Plan (Site Survey). This pilot effort is intended to research the viability of converting legacy mainframe code to a modern programming language (C#) on a Microsoft Azure environment. The sole-source procurement is being requested for Phase Two of a three-phase project. In Phase One, the vendor will translate a sample of mainframe COBOL code to Azure-ready C#. Phase Two will involve the vendor surveying the mainframe and working with the mainframe team to deliver a sample migration plan outlining the activities, effort, and timeline to perform a complete or partial migration of mainframe code to Azure. The estimated total contract value is $25,000. The prospective contractor is Vexcel, a subsidiary of Microsoft, and the sole-source procurement is being justified under ORS 279B.075 (2)(c) as a pilot or experimental project.
The document provides details on the background and need for this pilot effort, as well as the approval and support received from the Oregon Department of Justice and the Department of Administrative Services - Procurement Services. This sole-source procurement will allow the OHA to assess the viability of moving forward with a formal project and formal procurement for the mainframe migration.

Description of goods or services: Mainframe survey and migration plan (Site Survey). Pilot effort to research the viability of converting legacy mainframe code to a modern programming language (C#) on a Microsoft Azure environment.
1. Background: This sole source justification applies to the purchase of: Phase Two of a three phase effort.
In Phase one the vendor will translate a sample of mainframe COBOL code to Azure-ready C#. That may include a data schema too, however there would be no actual data shared. OIS will then review the resulting translated code, to determine if technical staff could maintain and enhance it effectively.
If OIS concludes that the Phase One sample code appears maintainable, we will need to understand the wider picture. A single code sample doesn’t give us enough information to determine what other activities are necessary to migrate a larger codebase, or what the general structure of a migration project should look like. In Phase Two, the vendor will survey the mainframe and work with mainframe team members to deliver a sample migration plan that gives us a high-level indication of the activities, effort and timeline to perform a complete (or partial) migration of mainframe code to Azure.
Based on phases one and two, we will determine if the overall approach is indeed a viable and appropriate one for our environment. If it is, we will use the knowledge gained from the sample translated code migration and outline migration plan to prepare a formal procurement. Without phases one and two, we will not have enough understanding of the technical and project issues to create an effective RFP.
On 04/30/21 We met with Debbie Davis (DAS-PS) and John McCormick (DOJ).
In that discussion we all agreed to move forward with Phase 1. With DOJ and DAS-PS approval and support, OIS is currently working with Microsoft via subsidiary Vexcel and subcontractor Asysco for Phase 1.
We also agreed the best path forward for Phase 2 is a sole-source procurement, pursuant to ORS 279B.075 (2)(c): Pilot or Experimental Project. Phase Two is strictly a pilot effort to assess the viability of moving forward with a formal project and formal procurement.

Agency reserves the right to purchase additional goods, services to include on-call maintenance, preventative maintenance, repair (unless available on DAS price agreement), or training.
3. Written findings of fact (market research):
The findings below must include factual information supporting the determination that meet the sole source requirement in statute.
Pursuant to ORS 279B.075, Agency must conduct market research that supports the assertion that there is only one source that can provide the goods or services. Market research includes utilization of the internet, trade journals, agency vendor lists, professional organizations, studies, catalogs/industrial periodicals, vendor sources, yellow pages, etc.
For information technology contracts, any ownership or proprietary issues should be fully addressed with written documentation to support facts. See Attachment 1.
Agency must select at least one of the findings and prepare the determination as it specifically relates to the good or service being procured. More than one finding can be addressed. The findings are as follows:
|_| Pursuant to ORS 279B.075 (2)(a): Provide findings supporting the determination that the efficient utilization of existing goods requires the acquisition of compatible goods or services from only one source.
or |_| Pursuant to ORS 279B.075 (2)(b): Provide findings supporting the determination that the goods or services required for the exchange of software or data with other public or private agencies are available from only one source.
or |X| Pursuant to ORS 279B.075 (2)(c): Provide findings supporting the determination that the goods or services are for use in a pilot or an experimental project.
Per DOJ opinion by Senior AAG John McCormick re: proof of concept.
or |_| Pursuant to ORS 279B.075 (2)(d): Any other findings that support the conclusion that the goods or services are available from only one source.
