Styling, design coordination, color and size availability are essential to the project. Items of other manufacturers that meet or exceed the specifications will be considered as alternates.
3.2 Approved products named in the specifications are pre-qualified, but not intended to exclude from consideration an equivalent product of a financially sound, established
523280 2 manufacturer that meets or exceeds all specified requirements and contract conditions.
Proposed substitutions must be equivalent in construction, appearance, dimensions and functions to be considered.
3.3 Bids based on manufacturers other than those specified in the Proposal, must be clearly identified as such, and bidders must include full product descriptions, drawings or photos and technical specifications with their bid.
3.4 In the event that an apparent low bidder proposes an alternate, the burden of proof to demonstrate equivalency shall rest entirely with the bidder. The bidder will be required to demonstrate equivalency by samples and/or literature.
3.5 Acceptable equivalents will be determined by the City of Rochester Information
Technology Department and the Director of Purchasing, whose decision will be final.
4. CONTRACT TERM
This shall be a One-time Purchase. The successful vendor will be required to guarantee a fixed price for 120 days should additional quantities be required.
5. QUANTITIES
The City intends to order the quantity listed on the Proposal Page upon contract award.
However, the City reserves the right to order more or less quantities based upon bids received.
6. METHOD OF AWARD
6.1 The City intends to award a contract to the responsive and responsible bidder whose bid is the lowest best value offer to the City on the basis of the Total Bid Price. The City reserves the right to award multiple contracts, if it best interest of the City.
6.2 For purposes of this bid, if one or more bids are submitted by a business certified as an
MWBE business by New York State on the date of the bid, the MWBE bidder(s) shall receive a five percent (5%) price advantage over non-MWBE bidders pursuant to Section 8 of Ordinance No. 2018-54. The lowest best value offer shall be defined as the lowest bid after adjusting for any MWBE price advantage. For example, if three bids are received, one for $100.00, one for $103.00, and one by an MWBE business for $105.00., the lowest best value offer would be the bid submitted by the MWBE business for $105.00. If instead the MWBE business submitted a bid for $105.01, the lowest best value offer would be the bid for $100.00. If award of the contract is based upon award by total bid, or by group, or by item, the City reserves the right to determine its lowest best value offer based upon total bid, group and per item prices offered.
6.3 The City reserves the right to reject any bid if unit prices are unbalanced or not consistent with current market conditions.
6.4 Any exceptions must be described in the Proposal. The City reserves the right to conduct tests, compare specifications and conduct any other research in order to verify that products offered fully meet specifications.

The Director of Purchasing hereby reserves the right to approve as an equal, or to reject as not being equal, any product or service the bidder proposes to furnish which contains major or minor variations from specification requirements of the Invitation to Bid.
If no particular brand, model, or make is specified, and if no data is required to be submitted with the bid, the City reserves the right to require any bidder to submit sufficient information to the Director of Purchasing to determine that the item(s)/service(s) offered comply with the requirements of the Invitation to Bid, and to reject any bid that does not meet said requirements

Unless otherwise specified, the City reserves the right to make an award per Total Bid Price, Group, combination of Groups or per Item or groups of Items, whichever method results in lower overall costs to the City after factoring in administrative and other costs from making multiple awards.
