About this file

This is an addendum document from the NC Department of Adult Correction responding to vendor questions regarding bid number 52-IFB-1453906995-WZM for canned or jarred pears. The bid opening date is set for March 4, 2025 at 2:00 PM. The addendum clarifies specifications regarding the pears, including that imported products may be proposed following delivery and specification requirements. The current product is packed in pear juice concentrate meeting 14-18 brix specifications, though bids with 9-11 brix will be considered with samples possibly requested. The first delivery of 1,904 cases must be completed by May 19, 2025.

The addendum includes an amended Method of Award section explaining that awards will be based on responsive bids offering the lowest price meeting specifications. While the intent is to award to a single vendor, the state reserves the right to make separate awards or cancel the IFB. The document also addresses price matching opportunities for North Carolina resident vendors under Executive Order #50 and G.S. 143-59, though notes a discrepancy regarding the referenced Attachment H. The current contract value can be found in Attachment A: Pricing Form, which is not included in this addendum.

STATE’S RESPONSE TO VENDOR QUESTIONS

State’s Response to Vendor Questions

QUESTIONS ANSWERS

Will NC accept import product? • The vendor may propose imported product but should follow the requirements in Section 4.5 Delivery and Section 5.1 Specifications.

What is the current cost state is purchasing the pears?

• The prior contract value can be found in Attachment A: Pricing Form.

Can you please clarify specifications is in syrup or juice?

According to the brix, 14-18 brix would make it packed in light syrup, possibly heavy syrup (juice pack is usually around 9-11 brix.

• The current product is packed in pear juice concentrate which meets our current specifications of 14-18 brix. However, if a bid is submitted with a 9-11 brix it will still be evaluated. Please note that this would be a deviation, and samples may be requested during the bid evaluation process.

The bottom of page 8 states the following:

If a Vendor selected for award is determined by the State to be a non-resident of North Carolina, all responsive bids will be reviewed to determine if any of them were submitted by a North Carolina resident Vendor who requested an opportunity to match the price of the winning bid, pursuant to Executive Order #50 and G.S.

143-59 (for more information, please refer to

ATTACHMENT H: VENDOR REQUEST FOR

EXECUTIVE ORDER #50 PRICE MATCHING. If such bid(s) are identified, the State will then determine whether any such bid falls within the price-match range, and, if so, make a Contract award in accordance with the process that implements G.S. 143-59 and Executive Order #50.

The question I have is, attachment H on the bid does not reference Executive order #50 and G.S 143-59. Is there another document I would need to submit as a North Carolina resident vendor to request the opportunity to match the price of the winning bid?

• SECTION 3.1 METHOD OF AWARD - This section amended as follows:

“North Carolina G.S. 143-52 provides a general list of criteria the State shall use to award contracts, as supplemented by the additional criteria herein. The Goods or Services being procured shall dictate the application and order of criteria; however, all award decisions shall be in the State’s best interest.

All responsive bids will be reviewed, and award or awards will be based on the responsive bid(s) offering the lowest price that meets the specifications provided herein, to include any required verifications set out herein such as but not limited to past performance, references, and financial documents.

While the intent of this IFB is to award a Contract(s) to a single Vendor for all line items, the State reserves the right to make separate awards to different Vendors for one or more line items, to not award one or more line items or to cancel this IFB in its entirety without awarding a Contract, if it is considered to be most advantageous to the State to do so.

The State reserves the right to waive any minor informality or technicality in bids received”

When will the first delivery be needed? • The first delivery is to be completed by May 19, 2025.

Can the 6-can packs be placed inside a master carton?

• Cans must be packed as per specifications.

What is the quantity for the first order? • The first quantity will be 1,904 cases.
