About this file

This addendum to Request for Bid No. 510073 is issued by the Wisconsin Department of Transportation's Central Purchasing division for tactical equipment and accessories intended for the Division of State Patrol's SWAT team. The bid encompasses specialized weapons, weapon accessories, protective gear, and equipment specified by make and model for uniformity across state agency teams. The addendum was issued on October 2, 2017, with a bid submission deadline of October 12, 2017, at 2:00 PM. Bidders are permitted to submit partial bids covering only selected line items rather than all items in the solicitation. Specific line items include Bushnell binoculars (40 units), Bushnell laser rangefinders (14 units), 5.11 Tactical padded slings (14 units), suppressor covers, rifle cases, and other tactical equipment; certain items require Federal Firearms License (FFL) certification for bidding eligibility.

The addendum addresses multiple clarifications through a question-and-answer format, including corrections to model numbers (item 11 corrected to model 67605 rather than 57605, and item 3.17 Blackhawk rifle case added to the pricing list with manufacturer's part number 64RC46BK). Insurance requirements were clarified to eliminate Business Automotive Insurance when vendors are not physically present at state sites and items are drop-shipped directly from manufacturers, though General Liability, Workers' Compensation, and Employer's Liability coverage remain mandatory. Bidders without FFL certification may still submit bids on non-firearms items. The State of Wisconsin requires Disabled Veteran Business Enterprise certification at the time of bid opening for any such classification benefits, and existing state contracts were determined not to cover the solicited items, necessitating this separate bidding opportunity.

510073 Tactical Equipment and Accessories: Questions and Answers

Q1: On pages 8-9 of the bid packet you have the insurance requirements described. It states the successful vendor will be required to meet these insurance requirements. These requirements would force us to add the DOT as an additionally insured if we are the successful bidder. It would cover our employees from injury during the fulfillment of this contract while on State property. My question is why do all of the insurance requirements listed, apply to this particular bidding opportunity because all of the items requested would be drop shipped directly from the manufacturer? Our employees would never have to be in the State. All of the products would be delivered via mail courier (UPS, Fedex, etc.)

so none of our employees or company vehicles would need to be covered by an insurance policy that lists the DOT as an additionally insured. We understand why these requirements are in place for construction contracts when employees must come in to the State to perform work but since the DOT is looking to procure goods and not services, it is not necessary for our employees to enter the State.

We are asking for these insurance requirements to be stricken from the Terms and Conditions because by enforcing these requirements, the DOT will end up spending more money than is necessary. If we have to change our insurance plan to cover the DOT, our prices will have to increase.

A1: The contractor will always need the General Liability, Work Compensation and Employer’s Liability.

If they are not coming to our sites or locations, it is ok to eliminate the Business Automotive Insurance.

Q2: Would you please let me know to which agency the tactical equipment and accessories will be going.

A2: Wisconsin Department of Transportation, Division of State Patrol.

Q3: Are we able to submit partial bid? or it has to be all items on the offer?

A4: Yes you are able to submit a partial bid.

Q5: Line item 12 for the Bushnell binoculars, item #132105 has been discontinued, is there another binocular that the department would be interested in?

A5: Bushnell’s website has binocular 132105 as an option under the H20 series.

Q6: On the Pricing List, we believe that item #11 should reference a model number 67605, as shown in item 3.11 in the specification sheet, rather than the #57605 shown. Please advise if this is correct.

A6: The correct model number is 67605. The incorrect model number was typed on attachment E.

Q7: On the Pricing List, there is no listing for the item 3.17 in the specification sheet, Blackhawk Rifle Case. Is this item to be added into the Pricing List?

A7: Added. See updated Price list.

Q8: If we do not have a FFL and, therefore, must 'No Bid' Line items #17, 18, and 19 on the Pricing List, are we still eligible to submit a Bid on the remainder of the items listed?

A8: Yes, you are still eligible.

Q9: My company, Fat Cat Services, is certified as a Disabled Veteran Business Enterprise in the State of California, certification number 1709500, expiring 07/31/2019. If we provide proof of our certification in California, are we still required to register with the State of Wisconsin to qualify for Disabled Veteran Owned Business classification? If so, in the event that it takes longer to obtain this certification from the State of Wisconsin than the time remaining to submit a response to this RFB, can we reference our California certification for purposes of this RFB while we process an application with the State of Wisconsin?

A9: Per Pro D-35, to qualify as a DVB in the State of Wisconsin, you would need to be a resident of Wisconsin and the business must be certified at the time of the bid/proposal opening.

Q10: I am wondering if the SilencerCo model 1739 suppressor cover would be ok to bid on instead of the model 1981, which is specified in this bid. The difference between the two is one has a high temp heat rating and the other has a standard heat rating.

A10: No, our specification is for the high temp heat rating, model AC1981

Q11: Can you also provide a specific manufacturer’s part number/SKU for the Blackhawk rifle case you are looking for? I see many options that come close to meeting your criteria, but none that appear to be exact matches.

A11: 64RC46BK

Q12: I just saw the bid open for the Tactical gear. Surprised these items weren’t just purchased through one of the other contracts we have as they are all stock items and could’ve purchased straight out vs.

bid.

Is there any chance these can be removed and responded through an existing contract?

Bushnell Binocular 132105 40

Bushnell Laser Rangefinder 202540 14

5.11 Tactical Padded Sling 59123 14

A12: No, it was determined that these items did not fall under any current contract’s scope which is why they are on a separate solicitation.
