About this file
This document is a Sole Source Certification letter from the Ruidoso-Ruidoso Downs Wastewater Treatment Plant in New Mexico, dated March 25, 2025, addressing a specific chemical procurement requirement. The document details the plant's need for Aluminum Sulfate to aid in phosphorous removal from the effluent stream, specifically to meet the Environmental Protection Agency (EPA) and New Mexico Environmental Department (NMED) regulatory requirement of a 1.67 30-day Average, lbs./day Phosphorous limit.
The letter identifies Chameleon Industries from Mesquite, Texas, as the sole source provider of the required liquid Aluminum Sulfate, highlighting their unique capability to deliver bulk tank trucks of the chemical at a more cost-effective rate compared to other potential suppliers. The document emphasizes the long-standing relationship between the treatment plant and Chameleon Industries, noting they have been the primary supplier for 11 years and have consistently helped the facility meet its regulatory phosphorous removal requirements. The sole source justification is further reinforced by the assertion that an alternative distributor from Georgia would result in chemical crystallization before delivery, rendering the product unsuitable for the treatment plant's needs.

RE: Letter of Determination

The Ruidoso-Ruidoso Downs Wastewater Treatment Plant requires an Aluminum Sulfate injection to aid in the removal of Phosphorous from the Effluent stream.
To meet the 1.67 30-day Average, lbs./day Phosphorous limit requires a high-quality liquid Aluminum Sulfate which is provided by Chameleon Industries out of Mesquite, Texas.
Chameleon Industries brings bulk tank trucks of Aluminum Sulfate which is much less expensive than other competitors. The only other company that can deliver bulk Aluminum Sulfate is a distributor out of Georgia which will crystalize by the time it reaches our facility.
We have been using Chameleon Industries for the last 11 years and have met our current permit of 1.67 30-day Average, lbs./day Phosphorous limit required by Environmental Protection Agency (EPA) and New Mexico Environmental Department
(NMED).
Sincerely, Isaac Garcia
Ruidoso-Ruidoso Downs Wastewater Treatment Plant
