About this file
This document is an Emergency Determination Form issued by the New Mexico Department of Transportation (NMDOT) for an emergency procurement of 500 CY of Class A Concrete to repair NM532 (Ski Run Road) where road failure caused closure due to flooding. The damage is in three areas, with the largest being over 200' long. The repair will consist of building a wall, backfilling with 8"-12" rock, and creating a concrete cap along the length of failure. This emergency procurement is necessary to control a serious threat to public safety caused by flooding and fire damage in the Ruidoso area. The contractor, Aggregate Technologies, LLC, was selected to provide the concrete at a cost of $96,000 excluding taxes.
The repair is crucial to prevent losing a long section of the road and to ensure the safety of the traveling public. The scope of work includes removing existing failed gabions and concrete wall barriers, installing new concrete wall barriers, and backfilling with rock to provide structural support and improve drainage. This is a temporary maintenance project until a larger construction project (CN 2104940) can be designed, bid, and constructed.

2022 Emergency Form
STATE OF NEW MEXICO
EMERGENCY DETERMINATION FORM
The emergency procurement method (NMSA 1978, Section 13-1-127) may only be used when the service, construction or item of tangible personal property procured:
1. is needed immediately to:
a. control a serious threat to public health, welfare, safety or property caused by a flood, fire, epidemic, riot, act of terrorism, equipment failure or similar event; or
b. plan or prepare for the response to a serious threat to public health, welfare, safety or property caused by a flood, fire, epidemic, riot, act of terrorism, equipment failure or similar event; and
2. cannot be acquired through normal procurement methods.
a. The agency entering into an emergency procurement should employ a competitive process to the extent practicable under circumstances.
The purchase or lease of heavy road equipment is not allowed under the emergency procurement statute.
The state purchasing agent or a central purchasing office that makes an emergency procurement shall outline its determination of the basis for the procurement and its selection of the contractor in writing and include the writing in the procurement file. (That writing can be made on this form.) Promptly thereafter:
the state purchasing agent shall post notice of the procurement on its website; or the central purchasing office shall post notice of the procurement on its website, if it maintains one, and shall transmit the notice to the state purchasing agent for posting on the state purchasing agent's website.
NOTE: the state purchasing agent or a central purchasing office that makes an emergency procurement to plan or prepare for the response to a serious threat to public health, welfare, safety or property caused by a flood, fire, epidemic, riot, act of terrorism, equipment failure or similar event shall account for the money spent in making the procurement and report on that accounting to the legislative finance committee and the department of finance and administration within sixty days after the end of the fiscal year in which the procurement was made.
I. Name of Agency: NM Department of Transportation Agency
Chief Procurement Officer: Christina Baca
Telephone Number: 505.469.8800
II. Name of Contractor: Aggregate Technologies, LLC
Address of Contractor: PO Box 289 Alamogordo, NM 88310
Amount of prospective contract: $96,000 excluding Taxes
Term of prospective contract: N/A
III. Thoroughly list the services (scope of work), construction or items of tangible personal property being procured:
500 CY of Class A Concrete to repair NM532 (Ski Run Road) where road failure caused closure due to flooding. The damage is in three areas. We will be building a wall, backfilling and creating a cap.
IV. Provide an explanation for the justification of the procurement including a description of the emergency condition(s) requiring use of emergency procurement and the practicable competition utilized in compliance with NMSA 1978, Section 13-1-127.
Due to the Ruidoso fires and floods NM532 (Ski Run Road) closed due to road failure.
There is a potential of losing a long section of this road which is unsafe for the traveling public. NMDOT will be adding a wall, backfilling with 8”-12” rock, and creating a concrete cap along the length of failure.
Repair will consist of 500 CY of class “A” concrete along the length of the damaged road.
New Concrete wall barrier to prevent overflow, water pressure and backfilled with 8” to 12” rock to provide structural support, improve drainage and prevent voids. Building a cap to reinforce road along the length of the failure to prevent erosion while enhancing structural integrity.
Since there are no Price Agreements available for this scope of work quotes were requested from Aggregate Technologies LLC, Roper Construction Inc. and Chance Materials.
Aggregate Technologies was the only vendor to respond with a quote for the 500CY need to complete the project.
V. Describe what measures are being taken to minimize the duration and effect of this emergency procurement (for example: is the emergency only in place until a competitive process can be completed, etc.).
Once the Class A concrete can be procured and used to repair the damage caused to the road by the Ruidoso floods/fire there should be no immediate threat of danger to the traveling public and the emergency will be mitigated.
VI. Describe what measures the Agency will take in the future to prevent/mitigate use of an emergency procurement under similar circumstances.

Existing failed gabions and CWB (Concrete wall barrier) will be removed. New CWB will be installed backfilled with rock to provide structural support and improve drainage to the road preventing washout and failures. The concrete cap will reinforce the Road structure to withstand erosion and water damage. This maintenance project is just a patch to keep the road from completely washing out until CN 2104940 can be designed, let and constructed. CWB’s have been placed to channel any minor storms to protect the work in place.

Subject: NM 532 Emergency Road Project
We currently have an emergency project on NM 532 (Ski Run Road) where there is road failure that has caused a closure of NM 532. District 2 has group of specially trained workers currently on the job site and need materials to finish the job. NMDOT District #2 is currently in monsoon season, and we need to finish this work ASAP before it can be damaged by future flooding. There is potential of losing the road on a long section if no emergency repairs are completed in an emergency manner. In total we are looking at using 450-500 CY of class “A” concrete before the work is finished. We ask to have this amount of concrete allocated by the latest of 8/19/2024 to minimize the risk of flooding and further damage to the road. The road is currently closed and unsafe for traffic to travel on the roadway in its current condition.
Below is a picture of the current damage. The damage is in three areas with largest being over 200’ long.
We will be adding a wall (which as of now is in place), backfilling with 8”-12” rock, and creating a concrete cap along the length of failure. Your assistance in the matter is greatly needed and appreciated. If you have any questions, please let me know at your earliest convenience.
Sincerely, Jonathan Boyle

The scope of work is Existing failed gabions and CWB will be removed. New CWB will be installed. Rock will be placed behind the CWB, and then base course and concrete will cap it. This maintenance project is just a patch to keep the road from completely washing out until CN 2104940) can be designed, let and constructed.
The progress on NM-532 is coming along nicely with more concrete expected to be finished by 8/30 and then a 14-day cure time before asphalt placement. We have so far placed concrete wall barrier to channel any minor storms to protect the work in place.
Below are pictures of our work. We plan on paving the week of September 16th to ensure 12’ lane widths. Below are pictures of the current work.
Any questions can be answered by Jonathan Boyle or Daniel Davis regarding delays or construction materials.
Sincerely, Jonathan Boyle District #2 Bridge Manager 575-626-0178
