About this file

This document is a Sole Source Request and Determination Form from the New Mexico Department of Cultural Affairs for the procurement of a specialized lift equipment. The agency seeks to purchase a CMC 72HD+ Arbor Pro specialty lift from All Access Equipment Inc. for $162,087.00, with a contract term of 12 months. The lift will be used for maintenance and work on museum exhibits, high ceilings, lighting, and building exteriors at various museums and historic sites. The equipment features unique capabilities including a 362-degree turret, hydraulic adjustable tracks, wireless remote control, single-man aluminum basket, and the ability to operate through pedestrian doors and on uneven terrain.

The sole source justification is based on the vendor being the exclusive distributor of this specific lift in the USA, Canadian Provinces, and Caribbean Islands. The agency conducted due diligence by researching alternative lift providers through websites like Boom & Bucket, Aerial Titans, and Overstock.com, and determined that existing statewide price agreement lifts do not meet their specialized requirements. The lift's key differentiators include its battery operation, ability to maneuver both vertically and horizontally, and suitability for interior museum work. The procurement is non-taxable and is intended to enhance the Facilities Management Bureau's capabilities in maintaining and working on museum facilities.

2021 Sole Source Form

STATE OF NEW MEXICO

SOLE SOURCE REQUEST AND DETERMINATION FORM

A sole source determination is not effective until the sole source request for determination has been posted for thirty (30) calendar days without challenge and subsequently approved in writing by the State Purchasing Agent or, for Professional Services Agreements, the Secretary of the General Services Department. The foregoing requirement is regardless of whether the sole source request for determination has been signed by the Agency and/or the Contractor.

I. Name of Agency: Department of Cultural Affairs

Agency Chief Procurement Officer: Melissa Catanach

Telephone Number: 505-827-7836

Agency Contact for this request: Deniece Griego-Martinez Telephone Number & Email Address:

505-476-1168, Deniece.GriegoMartinez@dca.nm.gov

II. Name of prospective Contractor: All Access Equipment Inc.

SHARE Vendor Number (must be active): 0000184553 Address of prospective Contractor: 891 Woburn Street, Wilmington, MA 01887

Contact Name, Telephone Number and Email Address: Elsa Ketchum, 978-712-4950 X 1 Amount of prospective contract before tax: $162,087.00 Estimated tax amount (tax is subject to change): N/A – Non-Taxable

Term of prospective contract: 12 months

Note: For terms longer than one year, Request for Policy Exemption from DFA MUST be included.

III. Agency is required to state purpose/need of purchase and thoroughly list the services (scope of work), construction or items of tangible personal property of the prospective contract (if this is an amendment request to an existing contract, include current contract number issued by SPD):

The contractor shall deliver the fully assembled CMC 72HD+ Arbor Pro specialty lift to the agency and hold a training course for the Agency Facilities Management Bureau staff to learn how to properly operate the lift.

IV. Provide a detailed explanation of the criteria developed and specified by the agency as necessary to perform and/or fulfill the contract and upon which the state agency reviewed available sources. (Do not use “technical jargon;” use plain English. Do not tailor the

Docusign Envelope ID: F439867F-AB75-48EC-81D8-3EE125793AEA criteria simply to exclude other contractors if it is not rationally related to the purpose of the contract.)

The CMC 72HD+ Arbor Pro specialty lift will be used to work on large museum exhibits, high ceilings, lighting for the inside of museums and lighting in parking lots. This lift will also be used for construction that may need to take place on higher levels on exterior parts of museum buildings and sites.

V. Provide a detailed, sufficient explanation of the reasons, qualifications, proprietary rights or unique capabilities of the prospective contractor that makes the prospective contractor the one source capable of providing the required professional service, service, construction or item(s) of tangible personal property. (Please do not state the source is the “best” source or the “least costly” source. Those factors do not justify a “sole source.”)

The CMC 72HD+ Arbor Pro is a specialty lift in which the vendor (All Access Equipment Inc.) is the sole distributor for in the USA, Canadian Provinces and the Islands of the Caribbean.

VI. Provide a detailed, sufficient explanation of how the professional service, service, construction or item(s) of tangible personal property is/are unique and how this uniqueness is substantially related to the intended purpose of the contract.

The lift can access the interior of the facility through pedestrian doors. This lift has Kubota Z602 diesel, 16.8 HP, vertical 4-cycle liquid cooled diesel, heavy duty stabilizers, self-loading truck chassis, 362-degree turret, horizontally hydraulic adjustable tracks, remote technical assistance, wireless remote controlling, single man aluminum basket, 180-degree basket rotation, 12V battery backup electric pump, articulating jib crane (arm that can be moved in multiple directions), and ability to raise basket & jib up out of the way while driving the tracks. Lift is fueled by diesel and backup 12V battery and can maneuver around difficult obstacles and hard to reach areas. Lift is also able to be setup on uneven terrain.

With these special features it will allow the agency’s facilities management employees to conduct job-duties at various museums and historic sites.

VII. Explain why other similar professional services, services, construction or item(s) of tangible personal property cannot meet the intended purpose of the contract.

No other vendors provide the specific lift needed to perform job duties. This specific lift meets the unique specifications of odd corners at the museum’s and meets museum standards.

VIII. Provide a narrative description of the agency’s due diligence in determining the basis for the procurement, including procedures used by the agency to conduct a review of available sources such as researching trade publications, industry newsletters and the internet;

contacting similar service providers; and reviewing the State Purchasing Divisions’ Statewide Price Agreements. Include a list of businesses contacted (do not state that no other businesses were contacted), date of contact, method of contact (telephone, mail, e-

Docusign Envelope ID: F439867F-AB75-48EC-81D8-3EE125793AEA mail, other), and documentation demonstrating an explanation of why those businesses could not or would not, under any circumstances, perform the contract; or an explanation of why the agency has determined that no businesses other than the prospective contractor can perform the contract.

The agency has searched over the following lift carriers Boom & Bucket, Aerial Titans and Overstock.com on their websites for a lift that will be needed to accommodate the interior work that will be conducted in New Mexico’s museums. Lift vendors that have been provided by statewide price agreement do not provide the type of lift needed to work inside museums because this lift is also battery operated. Man lifts that are on statewide price agreements only go vertical. The 2024 CMC 72HD+ can maneuver vertically and horizontally, which will greatly benefit the Facilities Management Bureau while working in museums. This lift can run on a 12V battery. This is vital to being able to work on interior museum projects safely. This purchase is an articulated boom lift.
