About this file

This is a Performance Bond Form document issued by the Board of Public Education for the City of Savannah and the County of Chatham, Georgia, for use in construction-related solicitations and contracts. The form serves as a sample template for contractors bidding on projects with the Savannah Chatham County Public School System (SCCPSS), specifically referenced in relation to the Data Cabling installation project at Jacob G. Smith Elementary School. The performance bond is required when a bidder's contract exceeds $100,000 and is awarded by the school district. The bond must be furnished in an amount equal to the total contract value and may be increased as the contract amount increases. The form requires that the surety be authorized to conduct business in Georgia under a current certificate of authority from the Georgia Commissioner of Insurance or be listed on the United States Department of Treasury's list of approved bond sureties.

The performance bond obligates both the contractor and surety to ensure faithful performance and compliance with all contract terms, specifications, and drawings. The surety must provide written notice of its election to remedy defaults or perform the contract within twenty-five days of receiving a declaration of default from the owner. Additionally, the surety is responsible for ensuring all subcontractors, suppliers, and laborers are paid within twenty days of the owner's notification of non-payment for work or materials certified as completed. The bond remains in effect regardless of any changes, extensions, or alterations to the original contract terms, and the surety waives the right to notice of such modifications. The bond is subject to increase in penal amount pursuant to Georgia Code Section O.C.G.A. Title 36 Chapter 91 and related contract provisions.
