PROJECT REQUEST
The City of Detroit Office of Contracting and Procurement (OCP), on behalf of the Home Revitalization Department’s Bridging Neighborhoods (BN) Division, requests bids from qualified Environmental Contractors (Vendors) to provide Hazardous Material Abatement for homes selected for renovation and demolition within BN.
BACKGROUND/DESCRIPTION OF ENVIRONMENT
Bridging Neighborhoods renovates vacant, blighted residential properties across the City of Detroit for the purpose of providing optional relocation to residents of the Delray neighborhood that will be impacted by the forthcoming Gordie Howe International Bridge and to provide quality homes for residents in Detroit. This RFQ is soliciting quotes for a Vendor(s) to abate hazardous materials in houses being renovated by BN.
BN will contract with the selected Vendor(s) for a 2-year contract term. The BN estimates it will renovate approximately 5-7 homes over the next two years.
This solicitation is specifically focusing on abatement of asbestos. However, this does not limit the range of the hazardous material that are indicated by the surveys to be abated. It is the City’s intention, only when safe and economical, to encapsulate rather than abate. The City will always confirm the specific services requested per home. A bidding list is provided and pricing should be provided for all options that the Vendor is capable and willing to perform. Note that it is essential all responding Vendors acknowledge the Scope of Work requires abatement work to be completed within 21 calendar days from the Notice to Proceed.
The contracted Vendor(s) will be issued a report of the hazardous materials found in the structure. The City will request line-item pricing (fixed rate per volume/quantity) for abatement of hazardous materials. Any request by a Vendor for an adjustment in payment for the abatement of additional materials or quantities must conform to the Contractor’s Item Cost Sheet.
STATEMENT OF WORK
3.1 Engagement with Regulatory Authorities: Prior to the abatement of all properties identified in the Notice to Proceed, the Contractor must engage the MDEQ (particularly the Air Quality Division) and MIOSHA on behalf of the City to provide the required Notice Period.
3.2 Area of Survey and Inspection: To the greatest degree possible, the Contractor must review the hazardous material survey against the field conditions to identify and locate the tested materials to be removed. If questions arise as to the location or extent of materials to be removed, a conference with the Survey Contractor and or City is to be called to clarify before proceeding with the work.
3.3 Incorrect or Unknown Address/Property: If the Contractor is unclear as to an assigned site, then the Contractor shall hold the abatement of that site and immediately contact the City for clarification. The Contractor may only proceed with the abatement after the assigned site is clarified by the City. The Contractor is solely responsible for the abatement of the site(s), as assigned on an as-needed basis.
3.4 Lead Safe Practices: BNP assumes all structures within the program are built prior to 1978, and therefore BNP also assumes all structures have lead based paint, requiring lead-safe practices regardless of the activity taking place by a contractor. The City informs the Renovation Contractors that they are responsible for safe Lead Practices. The Renovation Contractor will be responsible for the safe encapsulation, or removal and disposal of lead bearing materials. The Abatement Contractor is also advised to follow Safe Lead Practices; however, they are not responsible for removal and sanitization of lead bearing materials.
3.5 Compliance with All Applicable Health and Safety Laws, Regulations and Protocols.
Contractor shall conduct the abatement in accordance with all applicable laws, regulations and protocols pertaining to worker and public health and safety.
3.6 Abatement – Asbestos–Containing Materials.
3.6.1 Overview- Pursuant to 40 CFR 61.145, the Contractor shall:
· Identify and quantify presumed or suspect friable asbestos–containing materials and suspect Category I and Category II non–friable asbestos–containing materials
· Locate presumed or suspect friable asbestos–containing materials and suspect Category I and Category II non–friable asbestos–containing material using the Exterior Area and Functional Space Designations for each site
· Abate friable asbestos–containing materials and suspect Category I and Category II non– friable asbestos–containing materials in accordance with the protocols indicated in the referenced EPA rules.
3.7 Abatement – Other Hazardous/Regulated Materials.
3.7.1 Overview – Contractor shall abate the hazardous materials identified in BNP’s request to abate. Mold identified in the survey reports will be abated by the general contractor for the house renovation.
3.7.2 Survey/Inspection Methodology. The Contractor must abate/ remove each hazardous/regulated material which is in excess of de minimis/typical household/regulated quantities.
3.7.3 Pre–Abatement Site Review. The Abatement Contractor may request a pre–abatement review of the assigned site(s) in order to clarify or better understand the results of the survey and inspection.
3.7.4 The City will not receive, process or approve any Change Order or additional fee for the Pre–Abatement Site Review.
3.8 Discovery of Additional Materials or Quantities.
3.8.1 Re–mobilization and Inspection. If the assigned Renovation Contractor or Abatement Contractor discovers additional (presumed or suspect) asbestos–containing materials or quantities or other hazardous/regulated materials or quantities, then the Survey Contractor must re–mobilize to the site to inspect the additional materials or quantities.
3.8.2 Revised Report. The Survey Contractor will issue a revised report. The Abatement Contractor will then remove any additional materials defined by the revised report, as and only when requested by the City.
3.9 Change Orders.
The City will not receive, process or approve any Change Orders which would reimburse the Contractor for any costs associated with the discovery of additional materials or quantities.
3.10 Post–Abatement Inspection and Clearance Sampling.
The Abatement Contractor shall work with the Survey Contractor to obtain air clearances and final clearance of the property. The City of Detroit has already negotiated to pay for the passed final clearances, including any associated lab sample fees. Any failed clearances or trip fees (assessed when the Abatement Contractor requests to schedule a clearance and either cancels or the Survey Contractor determines the site is not ready for a clearance upon arrival) will be charged back to the Abatement Contractor as a pass through cost. Based on BNP’s negotiated Survey contracts, clearances generally range from $400-700 per clearance.
3.11 Deliverables.
3.11.1 The Contractor shall provide:
· An electronic pdf report indicating the abatement is complete noting the materials and quantities that were removed.
· Clearances indicating the City may proceed with renovation/ occupation of the structure.
· The report shall include complete chain of custody forms which document the abatement transport and disposal process.
3.12 Schedule.
The state notice, review, abatement, and clearance must be completed within twenty-one (21) or less days of receiving the Notice to Proceed from the City. At City’s discretion, repeated delayed engagements can result in Liquidated Damages in the amount of $300 per house and/or contract termination.
3.13 Management.
3.13.1 Industry Knowledge: Contractor must possess and maintain robust collection of knowledge of all applicable Federal, State and local laws, regulations and authorities related to the abatement of asbestos–containing materials and other hazardous/regulated materials including but is not limited to, NESHAP, MIOSHA, OSHA, NIOSH, NREPA, and RCRA; a robust collection of knowledge of industry best practices related to the aforementioned; and must possess a basic understanding and knowledge of building construction, materials and finishes through any mix of key personnel, stakeholders, subcontractors, and employees.
3.13.2 Contractor’s actual abatement activities of any City assigned site(s) shall be performed by a State of Michigan Licensed Asbestos Abatement Contractor with no less than two (2) years of full- time work experience in the abatement of sites for asbestos-containing materials or other hazardous/regulated materials.
3.13.3 The Contractor may allow an Accredited Asbestos Inspector who has less than two (2) years of full–time work experience to assist with the abatement of a site if that person is supervised in the field by another Accredited Asbestos Inspector who possesses two (2) or more years of full–time work experience.
