About this file

The document is a procedural guide from the Harris County Department of Economic Equity and Opportunity detailing Minority/Women-owned Business Enterprise (M/WBE) Trucking Procedure Compliance, focusing on ensuring commercially useful function in transportation services. The guide provides comprehensive instructions for M/WBE trucking firms on how to properly participate in county contracts, emphasizing requirements for ownership, operation, leasing, and subcontracting of trucks.

Key compliance requirements include M/WBE firms must own and operate at least one truck, employ their own drivers (not independent contractors), maintain exclusive use and control of leased vehicles, and follow specific crediting mechanisms for transportation services. The document outlines multiple scenarios for truck usage, including leasing from non-M/WBE firms, subcontracting, and receiving credit towards participation goals. The guidelines are designed to prevent contrived arrangements and ensure genuine economic opportunity for minority and women-owned businesses in the trucking sector, with 100% credit available when M/WBE firms meet specified operational criteria.

Presenter Notes Presentation Notes MBE or WBE may lease trucks from a non-certified firm, including owner-operators.

Credit for non-certified firm’s leased trucks is limited and subject to specific conditions.

For example, an MWBE Contractor is operating 4 trucks on a project. They only own and operate 1 truck, lease 3, and employ 4 drivers. They will only receive 100% credit for the 1 truck they own and operate and the 1 truck they lease, up to the value of transportation services provided for the owned truck. For the other two lease trucks they will only receive credit for the fees or commissions it pays for arranging the transportation services.
