About this file
This is a Criminal History Screening Practices Certification form required by Broward County, Florida for vendors seeking contracts valued at $100,000 or more. The certification mandates that vendors implement policies and procedures regarding criminal history inquiries for employment positions located within the United States that will perform work under a Broward County contract. Specifically, vendors must preclude inquiry into an applicant's criminal history until the applicant is selected as a finalist and interviewed for the position. The form requires vendors to certify compliance or claim exemption based on federal, state, or local law requirements or governmental agency status. Failure to comply with the criminal history screening practices constitutes a material breach of contract, and non-compliance may result in contract termination and potential debarment or suspension proceedings under Broward County Administrative Code Chapter 21.
The certification applies to the FEMA Electrical Maintenance and Repair Services contract, an open-end agreement to supply and deliver electrical maintenance and repair services for Water and Wastewater Services and other Broward County agencies. Vendors must submit responses electronically through BPRO by the specified closing date and time, with the County providing a designated period for vendors to submit questions and seek clarification. Vendor submissions must include County and State license requirements and meet Office of Economic and Small Business Development requirements, including County Business Enterprise (CBE) goal participation. The completed certification form must be returned with the vendor's submittal or submitted within three business days of County request, with failure to comply potentially rendering the vendor nonresponsive.
